Law for Partial Amendments to the National Diet Library Law
Part of the National Diet Library Law (Law No.5 of 1948) shall be amended as follows:
Chapter X shall be amended as follows:
Chapter X. Deposit of Publications Printed by Government and Local Public Entities
Article 24. Of each publication coming under any of the following categories printed by or for any agency of the Government in an edition of five hundred (500) copies or more (except confidential matter, blank forms, models and other simple publication;the same shall apply hereinafter) thirty (30) copies shall be furnished immediately to the National Diet Library for its official use and for its use in international exchange for the publications of other governments and in other international exchanges. Of such works, printed in an edition of less than five hundred (500) copies, a number of copies less than thirty (30) copies shall be furnished to the National Diet Library in accordance with regulations to be made by the Chief Librarian. In cases where such works are printed in an edition of five hundred (500) copies or more, the Chief Librarian may, when he deems it necessary, request the deposit of copies more than thirty (30) and not more than fifty (50) thereof. The Chief Librarian may also request the deposit of copies less than thirty (30) thereof when he recognizes the existence of special reasons:
(1) Books;
(2) Pamphlets;
(3) Publications in series;
(4) Musical notes;
(5) Maps;
(6) Works produced by motion picture techniques;
(7) Phonographic records and works produced by machines designed to reproduced sound mechanically;
(8) Works besides those mentioned in the foregoing items, reproduced as documents or charts by printing techniques acid other mechanical or chemical processes.
2 The provisions of the foregoing paragraph shall apply to the reprinting of the publications specified in the same paragraph. However, the same provisions shall not apply to cases where the contents of the reprinted publication differs neither in volume or substance from its first or previous edition and where copies of its first or previous edition were furnished in accordance with the provisions of this Law.
Article 24-(2). When the publications as prescribed in the foregoing Article, paragraph 1, have been printed by or for agencies of the metropolitan and prefectural governments or similar agencies, such agencies shall immediately furnish them to the National Diet Library in conformity with the foregoing Article.
2 When any of the publications prescribed in the foregoing Article, paragraph 1, has been printed by or for agencies of cities (including special districts;the same shall apply hereinafter) or of corresponding bodies, such agencies shall immediately furnish copies less than ten (10) thereof to the National Diet Library for the purposes specified by the same paragraph in accordance with the regulation to be made by the Chief Librarian. Of each publication printed by agencies of towns, villages or of corresponding bodies copies less than three (3) thereof shall be furnished.
3 The provisions of paragraph 2 of the foregoing Article shall apply to the preceding paragraph.
Chapter XI hall be amended as follows:
Chapter XI. Deposit of Other Publications
Article 25. When any person other than specified by the preceding two Articles has printed, any of the publications prescribed in paragraph 1 of Article 24, he shall, in order to contribute to the accumulation and utility of cultural goods, furnish a complete copy of its best edition to the National Diet Library within thirty (30) days of its issue, excepting cases coming tinder the provisions of the preceding two Articles:provided that this shall not apply in cases where the publisher has presented or begueathed the publication to the National Diet Library and where the Chief Librarian recognizes the existence of special reasons.
2 The provisions of Article 24 paragraph 2 shall apply with necessary modifications to the foregoing paragraph. In this case, "Deposit" mentioned in Article 24 paragraph 2 shall read "deposit or presentation or bequest" .
3 To a person who has deposited publications in accordance with the provision of paragraph 1 the Chief Librarian shall give a compensation equivalent to the expenses usually required for the printing and deposit of the publication.
4 The Chief Librarian shall deliver to the successor of a person who has presented or bequeathed the publication, a part of the national publication catalogue to be issued at periodical internals in which the above publication is recorded.
Article 25-(2). If the publisher fails to furnish the publication in accordance with the provision of the foregoing Article, paragraph 2, he shall be punished with a fine equivalent to less than five times the retail price of the publication.(If no retail price is fixed, a fine considered equivalent to it).
2 If the publisher is a juridical person, the fine in the foregoing paragraph shall be imposed upon its representative.
Supplementary Provisions:
1. This Law shall come into force as from July 1, 1949.
2. The publisher of publications coming under Article 24 paragraph 1 item (6) of the revised Law shall, for the time being, be exempt from obligation to deposit in accordance with the decision to be made by the Chief Librarian and despite the provisions of the said Article, Article 24-(2), and Article 25 after the revision.
3. Deposit of publications printed prior to the enforcement of this Law shall be in accordance with the existing provisions.
