Chapter I General Provisions
(Purpose of this Law)
Article 1. The purpose of this Law is to define clearly the scope of responsibilities and the powers of the Ministry of Agriculture and Forestry, and to provide for an organization fit for the efficient conduct of the administrative affairs and enterprises under the jurisdiction of the Ministry of Agriculture and Forestry.
(Establishment)
Article 2. The Ministry of Agriculture and Forestry is hereby established under the Provisions of Article 3 paragraph 2 of the National Government Organization Law (Law No.120 of 1948).
2 The Ministry of Agriculture and Forestry shall be headed by the Minister of Agriculture and Forestry.
(Mission of the Ministry of Agriculture and Forestry)
Article 3. The Ministry of Agriculture and Forestry shall be an administrative organ responsible for the integrated administration of the following affairs and enterprises for the purpose of contributing to the advancement of national economy through improvement and development of agriculture, forestry, livestock industry and fisheries as well as through promotion of welfare of farmers, forest-men and fishermen:
(1) Increased production of agricultural, forest, livestock and marine products, foods and beverages, oils and fats, as well as of goods used exclusively for agriculture, forestry, livestock industry and fisheries;
(2) Control over circulation and consumption of agricultural, forest, livestock and marine products, foods and beverages, oils and fats, as well as goods used exclusively for agriculture, forestry, livestock industry and fisheries;
(3) Improvement in quality of the agricultural, forest, livestock and marine products, foods and beverages, oils and fats, as well as of goods used exclusively for agriculture, forestry, livestock industry and fisheries;
(4) Practice, guidance and diffusion of experiment and study concerning agriculture, forestry, livestock industry, and fisheries;
(5) Making researches and statistics concerning agriculture, forestry, livestock industry and fisheries as well as farmers, forest-men and fishermen;
(6) Improvement in living conditions of farmers, forest-men and fishermen and advancement of social and economic status thereof;
(7) Land improvement works (meaning irrigation, drainage, land reclamation and marsh land reclamation works;reconstruction works of agricultural land or of damaged facilities necessary for its preservation or utilization;other works necessary for maintenance and increase in utilization of lands in agriculture;hereinafter the same);
(8) Carrying out the business of agricultural mutual relief reinsurance, fishing boat reinsurance and forest fire insurance;
(9) Carrying out state forest enterprise;
(10) Carrying out national horse-racing enterprise and supervising local horse-racing.
(Powers of the Ministry of Agriculture and Forestry)
Article 4. For the purpose of carrying out the responsibilities as provided for in this Law, the Ministry of Agriculture and Forestry shall have the powers as listed below. Such powers shall, however, be exercised in accordance with laws (including orders issued thereunder):
(1) To make, within the limits of bugetary appropriations, obligation necessary for carrying out its responsibilities;
(2) To collect revenues and make payments necessary for carrying out its responsibilites;
(3) To establish and maintain offices and other facilities directly required for carrying out its responsibilities;
(4) To procure materials for use in business, office supplies and research materials directly required for carrying out its responsibilities;
(5) To dispose of unnecessary property;
(6) To administer personnel affairs, including appointment, dismissal, awards, and discipline of personnel;
(7) To establish and maintain facilities required for the welfare and health of personnel;
(8) To establish and maintain housing to be rented to personnel;
(9) To make, distribute or publish statistics and research data concerning the affairs under its jurisdiction;
(10) To inspect the affairs under its jurisdiction, and to take such measures as may be required in accordance with laws and orders;
(11) To disseminate information to the public concerning the affairs under its jurisdiction;
(12) To adopt the official seals of the Ministry of Agriculture and Forestry;
(13) To allocate materials concerning the affairs under its jurisdiction or control the distribution thereof;
(14) To restrict or prohibit the use of materials in acute short supply as well as to order the production (including processing and repairs), shipment or movement thereof, or the execution of construction works concerning the affairs under its jurisdiction;
(15) To restrict or prohibit the production (including processing and repairs), shipment or movement of materials, or the execution of construction works concerning the affairs under its jurisdiction;
(16) To give instruction to transfer, deliver or lend materials in acute short supply or idle facilities concerning the affairs under its jurisdiction;
(17) To give permission or approval for the Agricultural Cooperative Associations, the Central Cooperative Bank for Agriculture and Forestry or other organizations concerning the affairs under the jurisdiction of the Ministry proper;
(18) To give approval for the reconstruction and reorganization program for the enterprises concerning the affairs under its jurisdiction;
(19) To fix grades, standards and packing regulations of the export goods concerning the affairs under its jurisdiction and to inspect them;
(20) To fix standards of the designated agricultural and forestry commodities in accordance with the provisions of the Law for the Designated Agricultural and Forestry Commodities Inspection (Law No.210 of 1948);
(21) To carry out reinsurance business relative to agricultural damages;
(22) To give instructions to governors of To, Do, Fu and prefectures by setting up the agricultural program in pursuance of the Food Maintenance Temporary Measures Law (Law No.182 of 1948);
(23) To registrate agricultural chemicals and agricultural seeds and seedlings;
(24) To inspect agricultural and livestock products, fertilizers, agricultural chemicals and other commodities for agriculture and livestock industry;
(25) To quarantine, disinfect and discard imported animals and plants to prohibit the receipt thereof, or to restrict importing places thereof;
(26) To give approval concerning the Central Wholesale Market;
(27) To acquire, administer and dispose of agricultural lands, etc. for the establishment of owner-farmers;
(28) To participate in settlement of tenancy disputes or other disputes about utilization of agricultural land;
(29) To control prices, transfer and disuse of agricultural lands as well as tenant-rents;
(30) To select suitable lands for reclamation works;
(31) To make loans to settlers;
(32) To acquire, administer and dispose of machinery, implements and materials for land reclamation works;
(33) To carry out national land improvement works, or to entrust To, Do, Fu and prefectures therewith;
(34) To grant subsidies to those persons engaging in the land improvement works;
(35) To collect reports on acreage of arable lands, crop growing conditions as well as on agriculture, forestry, livestock industry and fisheries;
(36) To grant subsidies and money given for entrusted works to prefectural or other experiment and research institutions in accordance with the Law concerning Improvement and Promotion of Agriculture (Law No.165 of 1948);
(37) To inspect breeding livestock;
(38) To restrict movement and slaughter of domestic animals and of domestic fowls;
(39) To license veterinarians, horseshoers, hosetrainers, and jockeys;
(40) To carry out national horse-racing;
(41) To give approval for regulations necessary for carrying out local horse racing or to suspend local horse-racing;
(42) To conduct raw silk conditioning;
(43) To permit silkworm eggs producing, silk reeling industry, commission merchants of export raw silk, and dealers in raw silk;
(44) To order to take measures necessary for prevention and control over silkworm diseases or for inspection of mulberry seedlings;
(45) To fix delivery quotas of staple foods;
(46) To purchase, sell, process exchange, hand over or store staple foods;
(47) To fix prices of staple foods;
(48) To give permission or approval to the organizations concerning the affairs under the jurisdiction of the Food Agency;
(49) To inspect staple foods as well as foods and beverages (excluding sake and the like;hereinafter the same);
(50) To determine boundaries of state forests;
(51) To dispose of state forests;
(52) To give approval to governors of To, Do, Fu and prefectures for the affairs relative to setting fire to forests, and for control or prevention against the forest noxious insects;
(53) To inspect lumber, firewoods, charcoal and other forest products as well as processd charcoal;
(54) To give permission or approval to forest owners'associations and other organizations concerning the affairs under the jurisdiction of the Forestry Agency;
(55) To carry out preservation and river control works of private forests;
(56) To annex to or release protection forests;
(57) To carry out the business of Government-operated forest fire insurance;
(58) To designate Kinds of birds and beasts for hunting as well as areas and season of hunting;
(59) To carry out afforestation and reforestation of state forests, public forests as well as of public lands afforested by the Government, and to execute river improvement works;
(60) To dispose of products and finished goods of state forests, public forests as well as of public lands afforested by the Government;
(61) To purchase standing trees, to produce and sell lumbar or charcoal;
(62) To purchase, sell or store firewoods and charcoal;
(63) Powers as provided for in Article 2 of the Fisheries Agency Establishment Law (Law No.78 of 1948);
(64) To entrust experiments, studies and researches concerning the affairs under its jurisdiction to others, to conduct experiments and inspection at the request of others and to collect fee thereof;
(65) In addition to those listed in the preceding items, such powers as are placed under the jurisdiction of the Ministry of Agriculture and Forestry by-laws (including orders isssued thereunder).
Chapter II Ministry Proper
Section 1 Internal Subdivisions
(Internal Subdivisions)
Article 5. The Ministry proper shall have Minister's Secretariat and the following five bureaus:
Agricultural Administration Bureau
Agricultural Land Bureau
Agricultural Improvement Bureau
Livestock Bureau
Raw Silk Bureau
2 The Agricultural Administration Bureau shall have the Agricultural Cooperative Association Division;the Agricultural Land Bureau shall have the Management Division, Planning Division and Construction Division;the Agricultural Improvement Bureau shall have the Statistics and Research Division, Research Division and Extension Division;and the Livestock Bureau shall have the Horse-Raching Division.
(Special Positions)
Article 6. The Minister's Secretariat shall have a Chief of Secretariat.
2 The Chief of Secretariat shall, upon orders, administer the affairs of the Minister's Secretariat.
(Functions of Minister's Secretariat)
Article 7. Minister's Secretariat shall, in connection with the responsibilities of the Ministry of Agriculture and Forestry, take charge of the following affairs:
(1) Confidential matters;
(2) Classification, appointment and dismissal of personnel, their status, disciplinary punishment, performance of duty and other personal affairs, as well as their refinement and training;
(3) Custody of the Minister's and Ministries official seals;
(4) Receipt, despatch, compilation and custody of official documents;
(5) Budget estimate for expenditures and revenues, settlement of accounts, accounts and account audit;
(6) Control of administrative properties and articles;
(7) Health, medical treatment and other welfare measures for personnel;
(8) Administrative inspection;
(9) Liaison Affairs;
(10) Dissemination of information;
(11) Coordination and adjustment, such as examination of draft bills and orders;
(12) Adjustment concerning allocation or distribution of agricultural, forest, livestock and marine Products, and of goods used for agriculture, forestry, livestock industry and fisheries as well as maintenance of contact pertaining to transportationof these goods;
(13) Adjustment of credit, as well as guidance and supervision over the Central Cooperative Bank for Agriculture and Forestry and other banking institutions;and guidance and supervision over financing business made by the said institutions;
(14) Readjustment and advancement of enterprises, as well as guidance and supervision over commercial and industrial associations;
(15) Readjustment of agricultural debts;
(16) Coordination with regard to export and import;
(17) Coordination of standardization and inspection;
(18) In addition to the affairs listed in the preceding items, such functions of the Ministry of Agriculture and Forestry as are not in charge of other bureaus or other organs.
(Functions of Agricultural Administration Bureau)
Article 8. The Agricultural Administration Bureu shall take charge of the following affairs:
(1) Planning for agricultural administration;
(2) Improvement in agricultural management;
(3) Guidance, supervision and fostering of agricultural cooperative association and other associations relating to agriculture;
(4) Mutual relief and insurance concerning agriculture and livestock industry;
(5) Administration of Agricultural Mutual Relief Reinsurance Special Accounts;
(6) Guidance and furtherance of rural industries for the Purpose of improving the management by farmers, forestmen and fishermen;
(7) Promotion, improvement and adjustment of production, circulation and consumption of agricultural products (except raw silk)(excluding the affairs falling under jurisdiction of the Food Agency);
(8) Promotion, improvement and adjustment of production, circulation and consumption of fertilizers, agricultural machinery and implements, agricultural chemicals and other materials exclusively used for agriculture (excluding affairs concerning production of such goods used exclusively for agriculture which falls under the jurisdiction of other Ministries);
(9) Inspection of agricultural products (except raw silk and staple foods) and of materials exclusively used for agriculture;
(10) Prevention and control over diseases and noxious insects, and quarantine of import and export plants;
(11) Guidance and supervision over the Central Wholesale Market;
(12) Fertilizer Distribution Kodan.
2 The Agricultural Cooperative Association Division shall take charge of the affairs provided for in item (3) of the preceding paragraph.
(Functions of Agricultural Land Bureau)
Article 9. The Agricultural Land Bureau shall take charge of the following affairs:
(1) Planning for agricultural lands and agricultural water utilization;
(2) Special measures for owner-farmer establishment;
(3) Control over transfer and disuse of agricultural lands, and adjustment of other matters relative to agricultural lands;
(4) Investigation into lands fit for reclamation and forming plan for reclamation thereof;
(5) Guidance and furtherance of settlement and farm managemet incidental thereto;
(6) Making loans for settlers;
(7) Accounting of Owner-farmer Establishment Special Measures Special Accounts and of Settlers'Fund Financing Special Accounts;
(8) Land improvement works operated by the Government;
(9) Land development works as well as guidance, supervision and furtherance of those persons engaging therein;
(10) Management and help for procuring of machinery, implements and materials for land reclamation works.
2 The Management Division shall take charge of the affairs provided for in items (1) to (3) inclusive, (5) to (7) inclusive and (9) of the preceding paragraph.
3 The Planning Division shall take charge of the affairs concerning survey and plan for implementing state-operated land improvement projects out of such affairs as provided for in paragraph 1 items (4) and (8).
4 The Construction Division shall take charge of the affairs concerning design and construction work required for implementing the stateoperated land improvement projects out of the affairs provided for in paragraph 1 item (8).
(Functions of Agricultural Improvement Bureau)
Article 10. The Agricultural Improvement Bureau shall take charge of the following affairs;
(1) Coordination in connection with the planning and carrying out of statistic method concerning the administrative affairs for which the Ministry of Agriculture and Forestry is responsible;
(2) Inquiry into acreage of arable lands and crop growing conditions;
(3) Statistic research into the rural economy;
(4) Compilation of statistics concerning agriculture, forestry, livestock industry and fisheries, in addition to the affairs provided for in the preceding three items;
(5) Planning for natural scientific experiments and researches into agriculture (including livestock industry and excluding raw silk industry;hereinafter the same in this Article) and farmers'living conditions as well as coordination of the said experiments and researches conducted by the related experiment and research institutions;
(6) Planning and execution of economic research into agriculture and farmers'living conditions as well as coordination of the said experiments and researches made by the related experiment and research institutions;
(7) Diffusion and exchange of Knowledge about agriculture and farmers'living conditions;
(8) Furtherance of experiment, research and extension works conducted by To, Do, Fu, prefectures or other experiment and research institutions in accordance with the Law concerning Agricultural Improvement Promotion;
(9) Advancement of ability of persons engaging in experiment and research works on agriculture and farmers'living conditions;
(10) Advancement of ability of persons engaging in business pertaining to the diffusion and exchange of knowledge about agriculture and farmers'living conditions;
(11) Investigation into conditions and results of experiment and research works conducted by the experiment and research institutions concerned;
(12) Investigation into conditions and results of works carried on regarding the diffusion and exchange of knowledge about agriculture and farmers'living conditions;
(13) Collection, compilation and publication of data for diffusion and exchange of the results of experiments, research works and knowledge about agriculture and farmers'living conditions.
2 The Statistics and Research Division shall take charge of the affairs provided for in items (1) to (4) inclusive of the preceding paragraph.
3 The Research Division shall take charge of the affairs provided for in paragraph 1, items (5), (6), (9) and (11), as well as of experiments and researches relative to agriculture and farmers'living conditions out of those provided for in items (8) and (13).
4 The Extension Division shall take charge of the affairs provided for in paragraph 1 items (7), (10) and (12), as well as of diffusion and exchange of knowledge concerning agriculture and farmers'living conditions out of those provided for in items (8) and (13).
(Functions of Livestock Bureau)
Article 11. The Livestock Bureau shall take charge of the following affairs:
(1) Planning for livestock administration;
(2) Guidance, supervision and furtherance of associations engaging in livestock industry;
(3) Improvement and propagation of domestic animals and domestic fowls;
(4) Furtherance, improvement and adjustment of production, circulation and consumption of live stock products;
(5) Furtherance, improvement and adjustment of production, circulation and consumption of feedstuffs and other materials exclusively used for livestock industry (excluding the production of such goods as used exclusively for livestock industry under the jurisdiction of other Ministries);
(6) Advancement of diversified farm management;
(7) Improvement and adjustment of pasture lands;
(8) Inspection of livestock products and articles exclusively used for livestock industry;
(9) Domestic animal and fowl hygiene, and qearantine of export or import animals and livestock products;
(10) Guidance and supervision over veterinarians and horseshoers;
(11) Carrying out of national horse-racing, and guidance and supervision over local horseracing;
(12) Administration of National Horse-Racing Work Special Accounts;
(13) Feedstuff Distribution Kodan.
2 The Horse-Racing Division shall take charge of the affairs provided for in items (11) and (12) of the preceding paragraph.
(Functions of Raw Silk Bureau)
Article 12. The Raw Silk Bureau shall take charge of the following affairs:
(1) Planning for raw silk administration;
(2) Furtherance, improvement and adjustment of production, circulation and consumption of raw silk and the goods exclusively used for raw silk industry (excluding the production of such goods as used exclusively for raw silk industry under the jurisdiction of other Ministries);
(3) Prevention of silkworm diseases;
(4) Raw silk conditioning;
(5) Investigation into demand for raw silk;
(6) Guidance, supervision and furtherance of associations relative to raw silk industry;
(7) Planning of experiments and researches regarding silkworms, cocoons and raw silk, coordination of the said experiments and researches conducted by the experiment and research institutions concerned, and diffusion of knowledge about silkworms, cocoons and raw silk.

Article 13. In addition to those provided for in Article 34, the Ministry proper shall have the following auxiliary organs:

(Agricultural Experiment Station)
Article 14. The Agricultural Experiment Station shall be an organ taking charge of experiment, analysis, examination, investigation and training course related to agriculture as well as production and distribution of seeds and seedlings.
2 The Agricultural Experiment Station shall be established in Tokyo-to.
3 The Minister of Agriculture and Forestry may establish branch stations of the Agricultural Experiment Station at necessary places for the purpose of charging them with a part of the functions of the Agricultural Experiment Station.
4 The internal organization of the Agricultural Experiment Station as well as names, locations and internal organizations of branch stations shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Tea Experiment Station)
Article 15. The Tea Experiment Station shall be an organ taking charge of experiment analysis, examination, investigation and training course related to tea industry as well as production and distribution of tea seeds, seedlings and refined-tea samples.
2 The Tea Experiment Station shall be established in Shizuoka Prefecture.
3 The internal organization of the Tea Experiment Station shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Horticultural Experiment Station)
Article 16. The Horticultural Experiment Station shall be an organ taking charge of experiment, analysis, examination, investigation and training course related to horticulture as well as production and distribution of seeds, seedlings and samples thereof.
2 The Horticultural Experiment Station shall be established in Kanagawa Prefecture.
3 The Minister of Agriculture and Forestry may establish branch stations at necessary places for the purpose of charging them with a part of the functions of the Horticultural Experiment Station.
4 The internal organization of the Horticultural Experiment Station as well as names, locations and internal organizations of branch stations shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Livestock Experiment Station)
Article 17. The Livestock Experiment Station shall be an organ taking charge of experiment, analysis, examination, investigation and training course relative to livestock.
2 The Livestock Experiment Station shall be established in Chiba Prefecture.
3 The Minister of Agriculture and Forestry may establish branch stations of the Livestock Experiment Station at necessary places for the purpose of charging them with a part of the functions of the Livestock Experiment Station.
4 The internal organization of the Livestock Experiment Station as well as names, locations and internal organizations of branch stations shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(National Agricultural Research Institute)
Article 18. The National Agricultural Research Institute shall be an organ conducting the comprehensive research and study of various economic problems concerning agriculture.
2 The National Agricultural Research Institute shall be established in Tokyo-to.
3 The Minister of Agriculture and Forestry may establish branch institutes of the National Agricultural Research Institute at necessary places for the purpose of charging them with a part of the functions of the National Agricultural Research Institute.
4 The internal organization of the National Agricultural Research Institute as well as names, locations and internal organizations of branch institutes shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Land Development Research Institute)
Article 19. The Land Development Research Institute shall be. an organ taking charge of the following affairs:
(1) Research and study works in connection with development and utilization of land and water in agriculture;
(2) Research and study of farm management, farmhouseholds and communities in reclaimed lands;
(3) Training of technicians of land development works;
(4) Training course on land development works.
2 The Land Development Research Institute shall be established in Tokyo-to.
3 The Minister of Agriculture and Forestry may establish branch institutes at necessary places for the purpose of charging them with a part of the functions of the Land Development Research Institute.
4 The internal organization of the Land Development Research Institute as well as names, locations and internal organizations of branch institutes shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Agricultural Improvement Experiment Stations)
Article 20. The Agricultural Improvement Experiment Stations shall be organs taking charge of experiment and investigation concerning the improvement in agriculture.
2 The names and locations of the Agricultural Improvement Experiment Stations shall be as follows:

Article 21. The Serieultural Experiment Station shall be an organ taking charge of experiment, analysis, examination, investigation and training courses concerning raw silk, as well as production and distribution of original silkworm eggs, mulberry grafts and seedlings.
2 The Sericultural Experiment Station shall be astablished in Tokyo-to.
3 The Minister of Agriculture and Forestry may establish branch, stations at necessary places for the purpose of charging them with a part of the functions of the Sericultural Experiment Station.
4 The internal organization of the Sericultural Experiment Station as well as names, locations and internal organizations of branch stations shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Livestock Hygiene Experiment Station)
Article 22. The Livestock Hygiene Experiment, Station shall be an organtaking charge of the following affairs:
(1) Experiments and researches concerning the hygiene of livestocks;
(2) Research in methods of prevention, disinfection and medical treatment of diseases of livestocks;
(3) Manufacturing, distribution and inspection of sera and medicines exclusively used for livestock;

(Responsibilities)
Article 41. The Material Adjustment Offices shall take charge of a part of the responsibilities of the Ministry proper, pertaining to the adjustment of allocation and distribution of agricultural, forest, livestock and marine products and of production materials thereof, as well as the adjustment of business with respect to transportation of the said materials and capital therefor.

Article 54. The Industrial Food Standards Council shall be established as an auxiliary organ of the Food Agency. The Industrial Food Standards Council shall be an organ which examines the standards of industrial food and exercises the powers vested in accordance with the provisions of the Law for the Designated Agricultural and Forestry Commodities Inspection.
2 With respect to the Industrial Food Standard Council, the Law for the Designated Agricultural and Forestry Commodities Inspection shall apply.
Part 4 Local Branch Offices
(Food Offices)
Article 55. The Food Agency shall have the Food Offices as its local branch offices.
(Responsibilities)
Article 56. The Food Offices shall take charge of a part of responsibilities of the Food Agency.
2 In addition to the affairs prescribed in the preceding paragraph, the Minister of Agriculture and Forestry may charge each Food Office with a part of the responsibilities of the Ministry proper and Forestry Agency, concerning the inspection of agricultural and forest products.
3 With respect to the affairs prescribed in paragraph 2, the Food Offices shall be subject to the direction and supervision of the Chief of the Agricultural Administration Bureau or of the Director of the Forestry Agency.
4 Names, locations, areas of jurisdiction, scope of function and internal organizations of the Food Offices shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Branch Offices and Sub-branch Offices)
Article 57. The Minister of Agriculture and Forestry may establish branch and sub-branch offices of the Food Offices at necessary places for the purpose of charging them with a part of the functions of the said Offices. Their names, locations, areas of jurisdiction and internal organizations shall be provided for by Ministry of Agriculture and Forestry Ordinance.
Section 2 Forestry Agency
Part 1 General Provisions
(Mission and Head of Forestry Agency)
Article 58. The Forestry Agency shall have as its principal mission the administration and management of the state forests, public forests and public lands afforested by the Government, guidance and supervision over private forests coordination of production, circulation and consumption of forest products, and the business to urge the development and improvement of forestry industry.
2 The Forestry Agency shall be headed by the Director of the Forestry Agency.
(Powers of Forestry Agency)
Article 59. The Forestry Agency shall exercise the powers as provided for in Article 4 items (1) to (16) inclusive, item (20), items (50) to (62) inclusive, and items (64) and (65) for the purpose of discharging its responsibilities.
Part 2 Internal Subdivisions
(Internal Subdivisions)
Article 60. The Forestry Agency shall have the following three divisions:
Forestry Administration Division
Guidance Division
Operation Division
(Functions of Forestry Administration Division)
Article 61. The Forestry Administration Division shall take charge of the following affairs:
(1) Planning for forestry administration;
(2) Adjustment and coordination concerning forestry;
(3) Administration and disposition of state forests, and the administration of public forests and public lands afforested by the Government;
(4) Promotion, improvement and coordination of production, circulation and consumption of lumber and other forest products;
(5) Inspection of lumber and other forest products;
(6) Guidance, supervision and fostering of forest owners'associations and other organizations related to forestry and forest products;
(7) Guidance and supervision of forest roads;
(8) In addition to the affairs listed in the preceding items, such responsibilities of the Forestry Agency as are not in the charge of other divisions or organs.
(Functions of Guidance Division)
Article 62. The Guidance Division shall take charge of the following affairs:
(7) Coordinate planning for localization and management of the state forests and private forests;
(2) Afforestation, management and river improvement works of private forests;
(3) Protection forests;
(4) Government-operated forest fire insurance;
(5) Management of the Forest Fire Insurance Special Account;
(6) Planning for experiment, study and research concerning forestry, liaison and coordination of the experiments and researches conducted at the experiment and research institutes concerned, and promotion of improvement, development and diffusion of forestry technique;
(7) Protection and propagation of wild birds and beasts and regulation of hunting.
(Functions of Operation Division)
Article 63. The Operation Division shall take charge of the following affairs:
(1) Afforestation, management and river improvement works concerning state forests, public forests and public lands afforested by the Government;
(2) Products and finished goods of state forests, public forests and public lands afforested by the Government;
(3) Acquisition, processing and disposition of standing trees;
(4) Promotion, improvement and adjustment of production, circulation and consumption of firewood, charcoal and processed goods;
(5) Inspection of firewood, charcoal and processed goods;
(6) Management of the State Forest Enterprise Special Account and the Firewood and Charcoal Demand and Supply Adjustment Special Account.
Part 3 Auxiliary Organs
(Forest Experiment Station)
Article 64. The Forestry Agency shall have as its auxiliary organ the Forestry Experiment Station, in addition to those provided for in Article 65.
2 The Forestry Experiment Station shall be an organ taking charge of experiment, analysis, examination, investigation and training course concerning forestry, production and distribution of seeds, seedlings and samples.
3 The Forestry Experiment Station shall be established in Tokyo-to.
4 The Minister of Agriculture and Forestry may establish branch and sub-branch stations of the Forestry Experiment Station at necessary places for the purpose of charging them with a part of the functions of the Forestry Experiment Station.
5 The internal organization of the Forestry Experiment Station as well as names, locations and internal organizations of branch and subbranch stations shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Other Auxiliary Organs)
Article 65. The organs entered in the left column of the following table shall be those established as auxiliary organs of the Forestry Agency, the purpose of their establishment being given in the right column.

Temple and Shrine Owned Forest Disposal Council
To make research and deliberation on the matters placed under its powers by the provisions of the Law for Disposition of National Property Leased Without Charge to Temple, Shrine, etc.(Law No.52 of 1947).
Forest Products Standards Council
To exercise such powers provided for in the Law for the Designated agricultural and Forestry Commodities Inspection, as the inspection of the standards of forest products.
Government-Operated Forest Fire Insurance Committee
To examine the matters concerning the forest fire insurance in accordance with the provisions of the Government-Operated Forest Fire Insurance Law (Law No.25 of 1937).
Local Forest Committee
To make research and deliberation on the matters placed under its powers by the provisions of the Forestry Law (Law No.43 of 1907).
2 With respect to the Temple and Shrine Owned Forest Disposal Council, the Forest Products Standards Council, the Government-Operated Forest Fire Insurance Committee and the Local Forest Committee, the Law for Disposition of National Property Leased Without Charge to Temple, Shrine, etc., the Law for the Designated Agricultural and Forestry Commodities Inspection the Government-Operated Forest Fire Insurance Law and the Forestry Law shall apply.

2 In the areas or jurisdiction of the Regional Forestry Offices entered in the table of the preceding paragraph, the district referred to as "a part of gun" shall be decided by the Minister of Agriculture and Forestry.
3 With respect to forest product transportation facilities and the matters needed to be managed covering the areas of jurisdiction of two or more Regional Forestry Offices, the Minister of Agriculture and Forestry may designate the competent Regional Forestry Office.
4 When the administration of transportation facilities for forest products and other matters are needed particularly, the Minister of Agriculture and Forestry may cause the Regional Forestry Offices to take charge of a part of the functions of the District Forestry Offices or cause the District Forestry Offices to take charge of a part of the function of the Regional Forestry Offices.
(Internal Subdivisions)
Article 69. The Regional Forestry Offices shall have the following three divisions

Business Division
2 In addition to the provision of the preceding paragraph, the detailed organizations of the internal subdivisions of the Regional Forestry Offices shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(District Forestry Office)
Article 70. The district Forestry Offices shall take charge of a part of responsibilities of the Forestry Agency, as enumerated in the following items:
(1) Carrying out of afforestation and management of the state forests public forests and public lands afforested by the Governments;
(2) Guidance of afforestation and management of private forests;
(3) Production and disposition of forests products and finish finished goods of the state forests, public forests and public lands afforested by the Governments;
(4) Acquisition, processing and disposition of standing trees.
2 Names, locations, areas of jurisdiction and internal organizations of the District Forestry Offices shall be provided for by Ministry of Agriculture and Forestry Ordinance.
3 With respect to forest product transportation facilities and the matters needed to he managed covering the areas of jurisdiction of two or more District Forestry Offices, the Regional Forestry Office may designate the competent District Forestry Office.
(Charcoal Offices)
Article 71. Charcoal Offices shall take charge of a part of responsibilities of the Forestry Agency such as purchase, sale, etc. of firewood and charcoal.
2 Names, locations, areas of juisdiction and internal organizations of the Charcoal Offices shall be provided for by Ministry of Agriculture and Forestry Ordinance.
(Branch Offices)
Article 72. The Minister of Agriculture and Forestry may establish branch offices of the charcoal Offices at necessary places for the purpose of charging them with a part of the functions of the Charcoal Offices.
2 Names, locations, areas of jurisdiction and internal organizations of the branch offices shall be provided for by Ministry of Agriculture and Forestry Ordinance.
Part 3 Fisheries Agency
(Fisheries Agency)
Article 73. The organization, responsibilities and powers of the Fisheries Agency shall be provided for by the Fisheries Agency Establishment Law (Law No.78 of 1948).
Section 4 Personnel
(Personnel)
Article 74. With respect to appointment, dismissal;promotion, disciplinary punishment and other matters concerning personnel administration of the Ministry of Agriculture and Forestry, the provisions of the National Public Service Law (Law No.120 of 1947) shall apply.
(Fixed Number of Personnel)
Article 75. The fixed number of personnel of the Ministry of Agriculture and Forestry shall be provided for by-law separately.
Section 5 Kodans
(Establishment)
Article 76. The Kodans under the jurisdiction of the Ministry of Agriculture and Forestry shall be as follows:

2 The Fertilizer Distribution Kodan, the Feedstuff Distribution Kodan, the Food Distribution Kodan, the Grocery Distribution Kodan and the Oil and Fat Distribution Kodan shall respectively be provided for by the Fertilizer Distribution Kodan Ordinance (Imperial Ordinance No.171 of 1947), the Feedstuff Distribution Kodan Law (Law No.202 of 1947), the Food Control Law (Law No.40 of 1942), the Grocery Distribution Kodan Law (Law No.201 of 1947) and the Oil and Fat Distribution Kodan Law (Law No.203 of 1947).
Supplementary Provisions:
1. This Law shall come into force as from June 1, 1949.
2. The following Law, Imperial Ordinances and Cabinet Orders shall be abolished. However unless otherwise provided for by-laws (including orders issued thereunder), the organs existing hithertofor and personnel thereof shall become the corresponding organs and personnel under this Law and shall retain their respective identities:

3. The provisions of the proviso to the preceding paragraph shall not affect the application of the provisions of the law concerning the fixed number of personnel.
4. The State-Operated Pasture Land Offices existing on the day of enforcement of this Law shall continue to exist as auxiliary organ of the Ministry proper until June 30, 1949.
5. The responsibilities, locations, areas of jurisdiction and internal organizations of the State-Operated Pasture Land Offices which exist in accordance with the preceding paragraph shall be as heretofore.
