Law concerning the Enforcement of the Law for Certification of Educational Personnel
(Special Regulations for Holder of Certificates for Teachers under the former Ordinances)
Article 1. Those who have the certificate for teachers mentiond in each item of the left column of the following table, given in accordance with the provisions of the former National Elementary School Ordinance (Imperial Ordinance No.148 of 1941), the former Teacher Certification Ordinance (Imperial Ordinance No.134 of 1900), or the former Kindergarten Ordinance (Imperial Ordinance No.74 of 1926), shall be regarded as having the certificate for teachers mentioned in the Right Column respectively, in spite of the provisions of paragraph 1 (excluding the provision) of Article 5 of the Law for Certification of Educational Personnel (Law No.147 of 1949)(hereinafter referred to as the Certification Law):

2nd-class regular certificate for teachers of kindergartens.
2 Subject areas mentioned in paragraph 6 of Article 4 of the Certification Law with regard to the certificate for teachers of lower or upper secondary schools mentioned in the Right Column of each item of the table in the preceding paragraph shall be prescribed by Ministry of Education Ordinance.
(Issuance of Certificates to the Graduates of Schools under the former Ordinances and other Persons)
Article 2. Those who are mentioned in Left Column of the following table can be given the certificate for teachers mentioned in Right Column respectively through the examination for educational personnel provided for in paragraph 1 of Article 6 of the Certification Law:

Those who have graduated from youth school teachers'training institute under the Youth School Teachers'Training Institute Ordinance (Imperial Ordinance No.47 of 1935)(hereinafter referred to as Youth School Teachers'Training Institute).

(4)
Those who have the Bachelor's degree under the former University Ordinance (Imperial Ordinance No.388 of 1918)(excluding those mentioned in Left Column of item (15) of this table).
Temporary certificate for teachers of elementary schools and 2nd-class regular certificate for teachers of lower and upper secondary schools.
(5)
Those who have the Bachelor's degree under the former University Ordinance, and who have the competent authorities'certificate of their having served for three years or more as teachers of the corresponding schools mentioned in Right Column with good records (including the teachers of schools under the former Ordinances who are prescribed by Ministry of Education Ordinance as equivalent to the teachers of the schools mentioned in Right Column. The same in the case mentioned in item 7).
2nd-class regular certificate for teachers of elementary schools and 1st-class regular certificate for teachers of lower and upper secondary schools.

Those who have graduated from the higher course of a higher school under the former Higher School Ordinance (Imperial Ordinance No.389 of 1918)(hereinafter referred to as the higher course of higher school) or from a college under the former College Ordinance (Imprial Ordinance No.61 of 1903)(hereinafter referred to as college) or those who have finished the preparatory course of a university under the former University Ordinance (hereinafter referred to as the preparatory course of university)(excluding those who are mentioned in Left Column of item (15) in this table).

(7)
Those who have graduated from the higher course of a higher school, a college or a youth normal school teacher training institute or those who have finished the preparatory course of university, and who have the competent authorities'certificate of their having served for three years or more as teachers of the corresponding schools mentioned in Right Column with good records.
2nd-class regular certificate for teachers of elementary schools and lower secondary schools.
(8)
Those who have certificate for teachers of middle schools and girls'high schools, girls'high schools, vocational schools, higher courses and advanced courses of girls'high schools or certificate for teachers of the higher course of higher schools given under the former Teacher Certification Ordinanee or those who are mentioned in Left Column of items (12) to (15) inclusive, and who have the competent authorities'certificate of their having served for three years or more as teachers of elementary schools with good records.
2nd-class regular certificate for teachers of elementary schools.
(9)
Those who hold positions of teachers of youth schools under the former Youth School Ordinance (Imperial Ordinance No.254 of 1939) as Education Ministry Instructors or Prefectural Instructors on March 31, 1948.
Temporary certificate for teachers of elementary schools and lower secondary schools.
(10)
Those who do not come under any of the items of Left Column of this table or that of the preceding Article but have the experience holding positions of teachers of universities under the former University Ordinance, preparatory course of universities, higher course of higher schools, colleges or teacher training schools provided for in Art.1 of the former Teacher Training School Ordinance (Imperial Ordinance No.208 of 1946)(hereinafter referred to as teacher training schools).

(11)
(a) Those who have been designated by the Minister of Education before the date of the enforcement of this Law in accordance with the provisions of item (10) of Art.99 of the Enforcement Regulation of the School Education Law (Ministry of Education Ordinance No.11 of 1947) based upon the provisions of Art.8 of the School Education Law (hereinafter referred to as the Enforcement Regulation of School Education Law).
Temporary certificate for teachers of elementary schools.
(12)
Those who have graduated from a teacher training school (excluding normal schools and youth normal schools) or from a teacher training institute provided for in Art.2 of the former Regulation governing the Organization of Teacher Training Schools.
2nd-class regular certificate for teachers of lower and upper secondary schools and temporary certificate for teachers of elementary schools.
(13)
Those who have been granted the doctor's degree provided for in the former Doctorate Ordinance (Imperial Ordinance No.200 of 1920).
2nd-class regular certificate for teachers of lower and upper secondary schools.
(14)
Those who can be teachers of former vocational schools provided for in the former Middle School Ordinance (Imperial Ordinance No.36 of 1943) in accordance with the provisions of the Ministry of Education Notification No.500-(1), 1943 based upon the proviso to Art.2 of the former Teacher Certification Ordinance.
2nd-class regular certificate for teachers of lower and upper secondary schools.
(15)
Those who have graduated from a school designated with regard to the non-written examination for teachers based upon the former Teacher Certification Ordinance (Ministry of Education Notification No.30 of 1903), a public or private school of which the graduates have been admitted of taking non-written examination for teachers of normal school, middle school, girls'high school (Ministry of Education Notification No.242 of 1911) or a school which has admitted of taking non-written examination in accordance with the regulations concerning the examination for vocational school teachers (Ministry of Education Notification No.35 of 1923).
Temporary certificate for teachers of elementary schools and 2nd-class regular certificate for teachers of lower and upper secondary schools.
(16)
Those who do not come under any of the items of Left Column of this table or that of the preceding Article but were holding positions of middle school teachers on April 1, 1947.

(17)
(a) Those who have been designated by the Minister of Education before the date of the enforcement of this law in accordance with the provisions of item (4) of Art.101 of the Enforcement Regulation of School Education Law.
Temporary certificate for teachers of lower secondary schools.
(18)
Those who are regarded as having temporary certificate for teachers of upper secondary schools in accordance with the provisions of each item in Art.103-(4) of the Enforcement Regulation of School Education Law.
2nd-class regular certificate for teachers of upper secondary schools.
(19)
Those who are regarded as having temporary certificate for assistant-teachers of upper secondary schools in accordance with the provisions of Art.103-(6), Art.103-(7), or item (2) of Art.103-(8) of Enforcement Regulation of School Education Law.
Temporary certificate for teachers of upper secondary schools.
(20)
Those who are regarded as having temporary certificate for teachers of upper secondary schools in accordance with the provisions of Art.103-(9) of the Enforcement Regulation of School Education Law.
Temporary certificate for teachers of upper secondary schools.
(21)
(a) Those who are regarded as having temporary certificate for school-nurses in accordance with the provision of items 2 or 3 of Art.103 of the Enforcement Regulation of School Education Law.
2nd-class regular certificate for school-nurses.
(22)
Those who can be teachers of schools for the blind or schools for the deaf and dumb, in accordance with the provisions of par.1 of Art.10 or par.1 of Art.11 of the Regulation for Public and Private Schools for the Blind and for the Deaf and Dumb (Ministry of Education Ordinance No.34 of 1923)(hereinafter referred to as the former Regulation for Public and Private Schools for the Blind and for the Deaf and Dumb) based upon the former Schools for the Blind and for the Deaf and Dumb Ordinance (Imperial Ordinance No.375, of 1922).
2nd-class regular certificate for teachers of schools for the blind or schools for the deaf.
(23)
Those who can be teachers of the primary school section of schools for the blind or primary school section of school for the deaf and dumb in accordance with the provisions of par.2 of Art.10 or par.2 of Art.11 of the formor Regulation for Public and Private Schools for the Blind and for the Deaf and Dumb.
Temporary certificate for teachers of schools for the blind or the schools for the deaf.
(24)
(a) Those who have been designated by the Minister of Education before the date of the enforcement of this Law in accordance with the provisions of item (3) of Art.104 of the Enforcement Regulation of School Education Law.
Temporary certificate for teachers of kindergatens.
(25)
(a) Those who are regarded as having or can be given 1st-class regular certificate for teachers in accordance with the provisions of the preceding Article, this Article or Art.7, and who have the competent authorities'certificate of their having served for three years or more as educational personnel (including the principals and teachers of schools, under the former ordinances, who are prescribed by Ministry of Education Ordinance as equivalent to them. The same in the cases mentioned in items (26) to (28) inclusive), or as educational administrative personnel at national or local government offices or at private schools with good records.

(26)
Those who are regarded as having or can be given 1st-class regular certificate for teachers in accordance with the provisions of the preceding Article, this Article or Art.7, and who have the competent authorities'certificate of their having served for six years or more as educational personnel, or educational administrative peronnel at national or local government offices or at a private schools with good records, and have finished the corresponding course of the short courses prescribed by Ministry of Education Ordinance.
2nd-class regular certificate for principals.
(27)
Those who are regarded as having or can be given 1st-class regular certificate for teachers in accordance with the provisions of the preceding Article, this Article or Art.7, and who have the competent authorities'certificate of their having served for nine years or more as educational personnel, or as educational administrative personnel at national or local gervernment offices or at private schools with good records, and have finished the corresponding course of the short courses prescribed by Ministry of Education Ordinance.
1st-class regular certificate for principals.
(28)
(a) Those who have the temporary qualifications for superintendents in accordance with the provisions of par.1 of Art.78, of the Board of Education Law before the amendment (hereinafter referred to as the former par.1 of Art.78 of the Board of Education Law) or the corresponding provisions of Ministry of Education Ordinance.
Temporary certificate for superintendents.
(29)
Those who have the temporary qualifications for superintendents in accordance with the provisions of the former par.1 of Art.78 of the Board of Education Law or the corresponding provisions of Ministry of Educations Ordinance, and who are regarded as having or can be given 1st-class regular certificates for teachers in accordance with the provisions of the preceding Article, this Article or Art.7, and who have the competent authorities'certificate of their having served for three years or more as principals (including principals of schools under the former ordinance prescribed by Ministry of Education Ordinance as equivalent to those. The same in the case mentioned in item (30)) superintendents, or first and second class officials of national or local government offices (including the personnel of cities, towns, and villages and of private schools who are equivalent to these;hereinafter the same in this table) with good records.
2nd-class regular certificate for superintendents.
(30)
Those who have temporary qualifications for superintendents in accordance with the provisions of the former par.1 Art.78 of the Board of Education Law or the corresponding provisions of Ministry of Education Ordinance and who are regarded as having or can be given 1st-class regular certificate for teachers in accordance with the provisions of the preceding Article, this Article or Art.7, and who have the competent authorities'certificate of having served for six years or more as principals, superintendents or first or second class officials of national or local government offices with good records.
1st-class regular certificates for superintendents.
(31)
(a) Those who have the temporary qualifications for teacher-consultants in accordance with the provisions of Art.8 of the Enforcement Order of the Law for the Special Regulation, Educational Public Service (Cabinet Order No.6 of 1949)(hereinafter referred to as the former Art.8 of the Enforcement Order of the Law for the Special Regulation concerning Educational Public Service) or the corresponding Provisions of Ministry of Education Ordinance.
Temporary certificate for teacher-consultants.
(32)
Those who have the temporary qualifications for teacher-consultants in accordance with the provisions of the former Art.8 of the Enforcement Order of the Law for the Special Regulation concerning Educational Public Service or the corresponding provisions of Ministry of Education Ordinance, and who are regarded as having or can be given 1st-class regular certificate for teachers in accordance with the provisions of the preceding Article, this Article or Art.7 and who have the competent authorities'certificate of their having served for three years or more as teacher-consultants or teachers with good records.
2nd-class regular certificate for teacher-consultants.
(33)
Those who have the temporary qualifications for teacher-consultants in accordance with the provisions of the former Art.8 of the Enforcement Ordinance of the Law for the Special Regulation concerning Educational Public Service and are regarded as having or can be given 1st-class regular certificate for teachers in accordance with the provisions of the preceding Article, this Article or Art.7, and who have the competent authorities'certificate of their having served for six years or more as teacher-consultants or teachers with good records.
1st-class regular certificate for teacher-consultants.
(34)
Those who are regarded to have the temporary certificate for assistant-teachers in accordance with the provisions of Article 100,102,103-(2),105,106-(2),106-(4),106-(8),106-(10),106-(12),106-(15), and 106-(17) of the Enforcement Regulation of School Education Law.
Corresponding emergency certificate.
2 The subject areas mentioned in par.6 of Art.4 of the Certification Law with regard to the certificate for the teachers of lower and upper secondary schools mentioned in Right Column of each item in the table of the preceding paragraph shall be prescribed by the Regulation of the Prefectural Board of Education of the Regulation of the Prefecture in accordance with the standards provided for by Ministry of Education Ordinance.
Article 3. Those who have the certificate for teachers of schools for the blind or schools for the deaf in accordance with the provisions of items (22) and (23) in the table of the preceding Article, shall not have to comply, for the time being, with the provisions of par.3, of Art.3 of the Certification Law.
Article 4. The length of service as teachers required of those who are regarded as having the certificate or who can be given the certificate, as stated in Left Column of items (25) to (33) inclusive of Art.2, shall respectively include those years during which they held positions as educational personnel other than teachers and of educational administrative personnel at national or local government offices or at private schools in case of those mentioned in items (25) to (30) inclusive, and the years during which they held positions as teacher-consultants in case of those mentioned in items (31) to (33) inclusive.
Article 5. Those private schools referred to in Left Column of items (25) to (29) inclusive, Art.2, and in the preceding Article, shall include the private schools under the former Private School Ordinance (Ordinance No.359 of 1909)(excluding the miscellaneous schools other than those schools which were designated with regard to the entrance into colleges in accordance with the provisions of Art.11 of the Regulation for Qualifying Examination for College Applicants (Ministry of Education Ordinance No.22 of 1925)) based upon the provisions of par.2 of Art.5 of the former College Ordinance.
Article 6. The examination of scholastic attainments in the examination for educational personnel provided for in Art.2, shall be conducted, on the basis of their achievement certificates of the schools mentioned in Left Column of each item in the table of Art.2, or the certificates of completing the short courses prescribed by Ministry of Education Ordinance
(Issuance of the upper class certificate to those who are prescribed in Articles 1 and 2).
Article 7. Those who are regarded as having 2nd-class regular, temporary or emergency certificate for teaches or who can be given 2nd-class regular, temporary or emergency certificate for teachers in accordance with the provisions of Art.1 or 2, and who have the competent authorities'certificate of serving as the Educational Personnel (including the Pricipals or teachers of school under the former ordinance who are prescribed by the Ministry of Education Ordinance, and the officials who are taking the educational affairs at national or local government offices or at private schools) with good records for so many years as mentioned in each of the following items (excluding the length of service mentioned in the Left Column of the table of Art.2) and also have finished the corresponding course of the short courses prescribed by the Ministry of Education Ordinance, can be given respectively 1st-class regular certificate, 2nd-class regular certificate or temporary certificate for corresponding teachers in accordance with the examination for educational personnel mentioned in par.1 of Art.6 of the Certification Law.
(1)
When those who are regarded as having or can be given 2nd-class regular certificate for teachers of kindergartens, elementary schools or lower secondary schools, are to get 1st-class regular certificate for the same......10 years or more.
(2)
When those who are regarded as having or can be given temporary certificate for teachers of kindergartens, elementary schools or lower secondary schools, are to get 2nd-class regular certificate for the same......5 year or more.
(3)
When those who are regarded as having or can be given 2nd-class regular certificate for teachers of upper secondary schools, are to get 1st-class regular certificate for the same......5 years or more.
(4)
When those who are regarded as having or can be given temporary certificate for teachers of upper secondary schools, are to get 2nd-class regular certificate for the same......10 years or more.
(5)
When those who are regarded as having or can be given 2nd-class regular certificate for school-nurses, are to get 1st-class regular certificate for the same......7 years or more.
(6)
When those who are regarded as having or can be given 2nd-class regular certificate or temporary certificate for teachers of schools for the blind, schools for the deaf, or shools for the otherwise handicapped, are respectively to get 1st-class or 2nd-class regular certificate for the same......3 years or more.
(7)
When those who are regarded as having or can be given emergency certificate, are to get the corresponding temporary certificate......5 years or more.
2 In case the whole lenght of schooling or teacher-training of the persons provided for in the preceding paragraph from their entrance into elementary schools to their graduation from or leaving their last schools (excluding the schools prescribed by Ministry of Education Ordinance) or the teacher training institutes under Ministry of Education Ordinance is either in excess or short of years provided for in Right Column of each item of the following table according to the kind of certificate mentioned in the respective Left Column, the excess or shortage in the number of years shall be added to or reduced from the number of years of their service.

3 In applying the provisions of the preceding paragraph to the persons who have been given certificate for teachers through the examination for teachers given under the former ordinances of national elementary schools, of teachers certification, or of kindergartens (excluding the persons for whom the preceding paragraph shall apply) the number of years mentioned in the respective Right Column according to the kind of certificates mentioned in Left Column of the following table shall be regarded as the length of schooling or teacher-training provided for in the preceding paragraph:

(Temporary Treatment of the Persons who are regarded as those who have Temporary Certificates under the Former Regulations)
Article 8. Those persons who are regarded as having temporary certificate for principals, for heads of kindergartens, for teachers, for assistant teachers, for school-nurses, or for assistant school-nurses in accordance with the provisions of Art.96 or 97 of the Enforcement Regulation of School Education Law (excluding the persons who are regarded as having certificates, or who have been given them in accordance with the provisions of Art.1, 2 or 7) may hold the corresponding positions until March 31, 1951, in spite of the provisions of paragraph 1 of Article 3.
(Validity and Others of Certificate for Teachers under the Former Ordinance)
Article 9. The validity, procedures of issuance and other matters of certificates for teachers of middle schools and girls' high schools, of girls' high schools, of vocational schools, of the higher course and advanced course of girls' high schools, and of the higher course of higher schools under the former Teacher Certification Ordinance shall be held in the same way as former either until March 31, 1950 in the case of certificate for teachers of middle schools and girls' high schools, of girls' high schools, of vocational schools, and of the higher course and advanced course of girls' high school until March 31, 1951 in the case of certificate for teachers of the higher course of higher schools.
(Amendments to Related Laws)
Article 10. A part of School Education Law shall be amended as follows:
Arts.8 and 9 shall read as follows:
Art.8. Matters regarding qualifications of principals and teachers (excluding those to whom the Law for Certification of Educational Personnel shall apply) shall be prescribed by the competent authorities.
Art.9. The persons who come under any one of the following items shall not be principals or teachers:
(1) Incompetent and quasi-incompetent;
(2) Those persons who have been condemned to imprisonment with or without hard labor;
(3) Those persons who have been sentenced to the cancellation of their certificate and of whom a period of two years has not expired since the date of that disposition;
(4) Those persons who, on and after the date of the enforcement of the Constitution of Japan, have organized or belonged to a political party or association which advocates the overthrow by force, of the Constitution of Japan or the Government formed thereunder.
Article 99 shall read as follows:

Article 11. A part of the Board of Education Law (Law No.170 of 1948) shall be amended as follows:
In par.2 of Art.41, the other law concerning the certification of educational personnel shall be amended as "the Law for Certification of Educational Personnel (Law No.147 of 1949)," and in par.1 of Art.67, "the other law concerning the certification of educational personnel" shall be amended as "the Law for Certification of Educational Personnel."
Item 1 of Article 50 shall be amended as follows:
(1) Matters on the certificate for principals and teachers of national or public schools as well as superintendents and teacher-consultants, in accordance with the Law for Certification of Educational Personnel;
Article 78 shall read as follows:

Article 12. A part of the Law for Special Regulation concerning Educational Public Service (Law No.1 of 1949) shall be amended as follows:
In par.4 of Art.2, "Certificates" shall read "Certificate for Educational Personnel."
Article 29 shall read as follows:
Article 29. Deleted.
Supplementary Provisions:
1. This Law shall come into force as from September 1, 1949.
2. To those persons who are actually in the post of principal or teacher at the time of the enforcement of this Law, the provision of item 3 of Art.9 of the School Education Law before amended is applicable in spite of the provision of item (2) of Article 9 of the said Law.
3. Those persons who are actually in the post of superintendent (excluding those who are given certificate of superintendents) at the time of the enforcement of this Law, may remain in their post during the tenure, in spite of the provision of paragraph 1 of Art, 3 of the Certification Law.
4. Those persons who are actually in the post of teacher-consultant (excluding those who are given certificate of teacher-consultants) at the time of the enforcement of this Law, may remain in their post for one year from the date of enforcement of this Law, in spite of the provision of paragraph 1 of Article 3 of the Certification Law.
