Law for Disposition of National Loan Bonds and Other Securities in Custody of Ministry of Postal Services in accordance with Postal Savings Law
(Content of dispositions)
Article 1. The bonds issued before March 31 of 1948 and kept in custody for the benefit of depositors in accordance with provisions of the Postal Savings Law (Law No.144 of 1947)(hereinafter to be referred to as "disposition bonds" ) shall be sold, in place of the depositors, by the Ministry of Postal Services to the Deposit Bureau of Ministry of Finance, etc.;and the proceeds shall be credited to the ordinary deposit accounts or fixed deposit accounts to be specified by the marks and numbers of postal savings pass-books inscribed on the bond custody certificates or bond custody pass-books for the bonds. However, with regard to the disposition bonds for which return or sale has been applied by the depositors by August 31 of 1949, this provision shall not be applicable.
2 The deposit credited to the account in accordance with the provisions of the preceding paragraph (hereinafter to be referred to as "bond disposition deposit" ) shall be deemed as ordinary deposit or fixed deposit as from September 1 of 1949.
3 With regard to the sales in accordance with the provisions of principal sentence of paragraph 1, no charge shall be imposed on the depositors.
(Selling price)
Article 2. The price of the disposition bonds to be sold in accordance with the provisions of principal sentence of paragraph 1 of the preceding Article shall be fixed by the Cabinet Order.
(Entry in postal savings pass-book)
Article 3. The Local Savings Office shall, at the request of depositors, enter the amount of bond disposition deposit in the pass-book of ordinary deposit account or fixed deposit account to which the amount has been credited.
2 The application for entry in accordance with the provisions of the preceding paragraph shall be made by submitting to a post office the pass-book referred to in the same paragraph and the bond custody certificate for the disposition bond or bond custody pass-book for the same.(In case where the bond custody certificate or bond custody passbook has been lost, the statement of reason for loss.)
(Withdrawal of bond disposition deposit)
Article 4. The bond disposition deposit shall not be withdrawn before the entry of the amount of bond disposition deposit has been made in the postal saving pass-book in accordance with the provisions of paragraph 1 of the preceding Article. However, the bond disposition deposit which has turned into ordinary deposit may be withdrawn even if the entry of the amount has not been made in the pass-book, as far as the whole amount is to be withdrawn.
2 The application for payment of withdrawal to be made in accordance with the proviso to the preceding paragraph shall be made by presenting to the post office the postal savings pass-book of ordinary deposit to which the amount of bond disposition deposit has been credited, and submitting the bond custody certificates for disposition bonds or bond custody pass-book.(In case the bond costody certificate or bond custody pass-book has been lost, the statement of reason for loss.)
3 The payment of amount of withdrawal in accordance with the provisions of proviso to paragraph 1 shall be made at a post office in exchange for the warrant of withdrawal issued by the Local Savings Office.
(Lapse of right)
Article 5. In case no application for entry prescribed in paragraph 1 of Article 3, or no application for withdrawal prescribed in proviso to paragraph 1 of the preceding Article is made by August 31 of 1959, the right of depositor to bond disposition deposit shall lapse on that date.
(Application of the Postal Savings Law)
Article 6. The application for entry under the provisions of paragraph 1 of Article 3 shall be deemed to be the deposit of savings, in connection with the application of the provisions of paragraph 1 of Article 29 of the Postal Savings Law.
Supplementary Provisions:
1. The present Law shall come into force as from June 1, 1949.
2. A part of the Postal Savings Law shall be amended as follows:
In Article 9, "and other securities" shall be eliminated.
Article 65 shall be amended as follows:
Article 65.(Bond in custody) The National Loan Bond to be treated in accordance with the provisions of Article 9 shall be limited to the one with the face value of one thousand yen or more, which was or will be issued on and after April 1, 1948.
In paragraph 1 of Article 68, the proviso shall be eliminated.
