郵便貯金法の一部を改正する法律
Law for Partial Amendments to Postal
郵便貯金法（昭和二十二年法律第百四十四号）の一部を次のように改正する。
Savings Law A partial amendment shall be made to the Postal Savings Law (Law No.144 of 1947) as follows:
第十二條中「割増金」を「割増金品」に改め、同條第一項第四号中「同二年以下であるとき　年三分」を「 同一年を超え二年以下であるとき　年三分 同一年以下であるとき　年二分九厘 」に改め、同條第三項の次に次の一項を加える。
In Article 12, "premium" shall read "premium and prize" , and in item 4, paragraph 1 of the same Article, "When the said period is two years and under:3.0% per annum" shall read "When the said period is more than one year and two years and under:　3.0% per annum. When the said period is one year and under:　2.9% per annum" and next to paragraph 3 of the same Article, the following one paragraph shall be added:
割増金附定額郵便貯金及び郵便貯金切手の割増金品については、所得税及び地方税法（昭和二十三年法律第百十号）による不動産取得税を課さない。
"Income tax and real estate acquisition tax provided in the Local Tax Law (Law No.110 of 1948) shall not be imposed on premiums and prizes of the postal savings certificate with premium and postal savings coupon."
第三十二條中「五円以上」を「十円以上」に改める。
In Article 32, "five yen" shall read "ten yen" .
第三十四條を次のように改める。
Article 34 shall be amended as follows:
第三十四條（小切手の預入）　持参人拂の小切手は、省令の定めるところにより、その小切手金額でこれを通常郵便貯金に預入することができる。
Article 34.(Deposit by cheque)　Cheque payable to bearer may be deposited in the ordinary deposit at its full face value, in accordance with the provisions of Ministerial Ordinance.
前項の規定による預入に係る通常郵便貯金については、当該小切手が決済された後でなければ、貯金の現在高がその小切手による預入金額を下るような拂もどしをすることができない。
With regard to the ordinary deposit in which a deposit has been made under the provisions of the preceding paragraph, no withdrawal as may reduce the balance below the amount of deposit with the cheque, shall be made before the said cheque has been cleared.
第三十五條中「有價証券」を「小切手」に改める。
In Article 35, "Securities" shall read "cheque" .
第四十六條中「三年」を「二年」に改める。
In Article 46, "three years" shall read "two years" .
第四十七條第一項を次のように改める。
Paragraph 1 of Article 47 shall be amended as follows:
積立郵便貯金の一回の預入金額は、百円以上千二百円以下（昭和二十四年五月三十一日以前に預入した積立郵便貯金については二十円以上五十円以下）とし、預金者が、これを定める。但し、百円未満（昭和二十四年五月三十一日以前に預入した積立郵便貯金については十円未満）の端数を附けることができない。
The amount of deposit of the collection deposit at one time shall be from one hundred yen to one thousand two hundred yen (with regard to the collection deposit which was made on and before May 31, 1949, from twenty yen to five hundred yen;the amount shall be fixed by a depositor. However, no fraction of one hundred yen (with regard to the collection deposit which was made on and before May 31, 1949, fraction of ten yen) shall be allowed.
第五十二條を次のように改める。
Article 52 shall be amended as follows:
第五十二條（拂もどし制限）　定額郵便貯金においては、そのすえ置期間が経過した後でなければ、貯金を拂いもどすことができない。但し、郵政大臣は、預金者の申請があつた場合において、預金者の生計困難等のため（割増金附定額郵便貯金にあつては、天災その他非常の災害を受けた預金者の緊急な需要を充たすため）特にその必要があると認めるときは、すえ置期間内でも貯金を拂い渡すことができる。
Article 52.(Restriction on withdrawal)　No postal savings certificate shall be withdrawn before the maturity of the deferring period. However, in case the Minister of Postal Services finds justification such as difficulties of living of the depositor at his request (with regard to the savings certificate with premium, to meet the urgent needs of the depositors suffered by natural disasters or other extraordinary calamities), he may approve the withdrawal of savings even during the deferring period.
割増金附定額郵便貯金について前項但書の規定による貯金の拂渡をする場合においては、郵政省は、貯金額からその千分の五に相当する金額に拂渡の月からすえ置期間の満了の月までの月数を乘じた金額を控除する。
With regard to the postal savings certificate with premium in case the withdrawal of savings prescribed in the proviso to the preceding paragraph is made the Ministry of Postal Sarvices shall deduct, from the amount of savings, the amount obtained by multiplying the amount equivalent to five thousandths thereof by number of months from the month of withdrawal to the month of maturity of the deferring period.
第五十三條第一項中「一年」を「六箇月」に改める。
In paragraph 1 of Article 53, "one year" shall read "six months" .
附　則
Supplementary Provision:
この法律は、昭和二十四年六月一日から施行する。
The present Law shall come into force as from June 1, 1949.
