Law for Partial Amendment to the Finance Law
財政法（昭和二十二年法律第三十四号）の一部を次のように改正する。
A part of the Finance Law (Law No.34 of 1947) shall be revised as follows:
第二十三條を次のように改める。
Article 23 shall be amended as follows:
第二十三條　歳入歳出予算は、その收入又は支出に関係のある部局等の組織の別に区分し、その部局等内においては、更に歳入にあつては、その性質、歳出にあつては、その目的に從つて部に大別し、且つ、各部中においてはこれを款項に区分しなければならない。
Article 23.　The budget of revenues and appropriations shall be divided by organization unit related to the revenues and expenditures concerned, and the said organization unit shall be divided into parts, according to the source of revenues, and according to the purpose of expenditures, and each part shall be divided into titles and items.
第二十四條中「計上しなければならない。」を「計上することができる。」に改める。
In Article 24, "shall include" shall read "may include" .
第三十三條及び第三十四條を次のように改める。
Article 33 and Article 34 shall be amended as follows:
第三十三條　各省各廳の長は、歳出予算の定める各部局等の経費の金額又は部局等内の各項の経費の金額については、各部局等の間又は各項の間において彼此移用することができない。但し、予算の執行上の必要に基き、あらかじめ予算をもつて國会の議決を経た場合に限り、大藏大臣の承認を経て移用することができる。
Article 33.　The heads of the respective Ministries and Government agencies shall not transfer the amounts of appropriations apportioned to the respective organization unit or among the amounts of appropriations apportioned to the respective item under the organization unit;provided that the transfer may be made with the approval of the Minister of Finance only when the approval of the Diet was made in the budget in advance.
各省各廳の長は、各目又は大藏大臣の指定する節の経費の金額については、大藏大臣の承認を経なければ、目の間又は節の間において、彼此流用することができない。
The heads of respective Ministries and Government agencies shall not make the transfer among the amounts apportioned to the respective objects, or details designated by the Minister of Finance unless approved by the Minister of Finance.
各省各廳の長は、前項の規定により大藏大臣の指定する節以外の節の経費の金額については、各省各廳の長限り、当該節相互の間において、彼此流用することができる。
The heads of respective Ministries and Government agencies shall be able to make the transfer by himself among the amounts apportioned to the respective details except ones designated by the Minister of Finance under the provisions of the preceding paragraph.
大藏大臣は、第一項但書又は第二項の規定に基く移用又は流用について承認をしたときは、その旨を会計檢査院に通知するとともに、第一項但書の規定に基く移用については、その旨を日本銀行に通知しなければならない。
In case the Minister of Finance approved the transfer under the provisions of the proviso to paragraph 1 or the provisions of paragraph 2, he shall notify it to the Board of Audit and furthermore shall notify the transfer under the provisions of the proviso to paragraph 1 to the Bank of Japan at the same time.
第一項但書、第二項又は第三項の規定により移用又は流用した経費の金額については、歳入歳出の決算報告書において、これを明らかにするとともに、その理由を記載しなければならない。
The amount of appropriations transferred under the provisions of the proviso to paragraph 1, paragraph 2 or 3 shall be shown in the report on the settlement of revenues and expenditures together with the reasons thereof.
前五項に定めるものの外、歳出予算の経費の金額の移用及び流用に関し必要な事項は、政令でこれを定める。
Necessary matters concerning the transfer of appropriations of budget shall be prescribed by a cabinet order, besides the provisions of the preceding five paragraphs.
第三十四條　各省各廳の長は、第三十一條第一項の規定により配賦された予算に基いて、政令の定めるところにより、國の支出の原因となる契約その他の行爲（以下支出負担行爲という。）に因る所要額及び支出の所要額について、支出負担行爲担当事務職員及び支出担当事務職員ごとにこれを定め、支出負担行爲又は支拂の計画に関する書類を作製して、これを大藏大臣に送付し、その承認を経なければならない。
Article 34.　The heads of the respective Ministries and Government agencies shall determine the amount necessary for contracts and other acts which shall be the cause of the disbursement of the State (hereinafter referred to as acts to incur disbursements) and the amount necessary for disbursements separately for the respective personnel charged with acts to incur disbursements and with disbursements in accordance with the appropriations apportioned under the provisions of Article 31, paragraph 1, as prescribed by a cabinet order, shall prepare documents concerning plan of acts to incur disbursements and payments and shall send them to the Minister of Finance for his approval.
大藏大臣は、國庫金、歳入及び金融の状況並びに経費の支出状況等を勘案して、適時に、支出負担行爲又は支拂の計画の承認に関する方針を作製し、閣議の決定を経なければならない。
The Minister of Finance shall prepare opportunely the principle concerning the approval for the plan of acts to incur disbursements and of payments for the decision of the Cabinet Conference, in consideration of conditions of Treasury's money, annual revenues and banking and conditions of disbursement of expenditures and the like.
大藏大臣は、第一項の支出負担行爲又は支拂の計画について承認をしたときは、各省各廳の長及び会計檢査院に通知するとともに、支拂計画はこれを日本銀行に通知しなければならない。
In case the Minister of Finance approved the plan of acts to incur disbursements or payments under the provisions of paragraph 1, he shall inform it to the heads of respective Ministries and Government agencies and the Board of Audit and at the same time he shall also inform the plan of payments to the Bank of Japan.
第三十五條第五項を次のように改める。
Article 35, paragraph 5 shall be amended as follows:
第一項の規定は、第十五條第二項の規定による國庫債務負担行爲に、第二項、第三項本文及び前項の規定は、各省各廳の長が第十五條第二項の規定により國庫債務負担行爲をなす場合に、これを準用する。
The provisions of paragraph 1 shall apply mutatis mutandis to the contract authorizations under the provisions of Article 15, paragraph 2, and the provisions of paragraph 2, main clause of paragraph 3 and the preceding paragraph shall apply mutatis mutandis to the case where the heads of respective Ministries and Government agencies make the contract authorizations under the provisions of Article 15, paragraph 2.
附則第一條の次に次の一條を加える。
Next to Article 1 of the Supplementary Provisions, one Article shall be added as follows:
第一條の二　内閣は、当分の間、第三十一條第一項の規定により歳入歳出予算を配賦する場合において、当該配賦の際、目又は節に区分し難い項があるときは、同條第二項の規定にかかわらず、当該項に限り、目又は節の区分をしないで配賦することができる。
Article 1-(2).　In case the Cabinet allocates the budget of revenues and appropriations under the provisions of Article 31, paragraph 1 and there are items which cannot be divided into objects or details, at the time of the allocation concerned, it may allocate, for the time being, the said item exclusively without division of objects or details regardless of the provisions of paragraph 2 of the said Article.
前項の規定により目又は節の区分をしないで配賦した場合においては、各省各廳の長は、当該項に係る歳出予算の執行の時までに、大藏大臣の承認を経て、目又は節の区分をしなければならない。
In case the allocation without division of objects or details was made under the provisions of the preceding paragraph, the heads of the respective Ministries and Government agencies shall make division of the objects or details with the approval of the Minister of Finance in the execution of the appropriation concerning the said item.
大藏大臣は、前項の規定により目又は節の区分について承認をしたときは、その旨を会計檢査院に通知しなければならない。
In case the Minister of Finance approved the division of the objects and details under the provisions of the preceding paragraph, he shall notify it to the Board of Audit.
附　則
Supplementary Provisions:
１　この法律は、昭和二十四年四月一日から施行する。但し、第二十三條及び附則第一條の二の改正規定は、昭和二十四年度の予算から適用する。
1.　The present Law shall come into force as from April 1, 1949, provided that the amended provisions of Article 23 and Article 1-(2) of the Supplementary Provisions shall apply as from the budget for the fiscal year 1949-50.
２　昭和二十三年度分の歳出予算の経費の金額の流用並びに同年度分の契約等の計画及び支拂計画に関しては、なお、從前の例による。
2.　The transfer of the amount of appropriations of budget for the fiscal year 1948-49 and the plan of acts to incur disbursements and that of payment for the said fiscal year shall be settled as heretofore practised.
