Law for Partial Amendment to the Certified Public Accountant Law
The Certified Public Accountant Law (Law No.103 of 1948) shall partially be amended as follows:
In paragraph 1 of Article 8, "Accounting, Book-keeping, Cost-calculation, Economics, Enterprise Management, Finance, Money and Banking, Civil Code (excluding parts on Relations and on Succession) and Commercial Code (excluding parts on Marine Merchantile Commerce, Bills and Cheques)" shall read "Accounting (devided as Book-keeping, Theory of Financial Statements, Cost-Calculation and Auditing), Enterprise Management, Economics, and Commercial Code (excluding parts on Marine Merchantile Commerce, Bills and Cheques)."
In item 1 of Article 9, "Accounting, Bookkeeping, Cost-Calculation, Enterprise Management, and Money and Banking" shall read "Accounting and Enterprise Management" ;and in item 2 of the same Article, "Economics, Finance, and Money and Banking" shall read "Economics," and in item 3 of the same Article, "Civil Code and Commercial Code" shall read "Commercial Code."
In Article 33, the following one paragraph shall be added:
3 Interested persons and/or expert withnesses who have been ordered to attend or to express their expert opinions pursuant to the provisions of paragraph 1 may, as may be prescribed by a Cabinet Order, demand the reimbursement of travelling expenses, daily allowance or other expenses.
In paragraph 2 of Article 34, "or by paying the cost of preparation" shall read "or by paying the cost of preparation as may be prescribed by a Ministry of Finance Ordinance."
In paragraph 2 of Article 36, "among Certified Public Accountants" shall read "among abovementioned persons," and paragraph 3 of the same Article shall be deleted.
Article 42 shall amended as follows:
(Remuneration for Commissioner)
Article 42. A Commissioner shall be given a remuneration in amount as may be determined by the Minister of Finance within the appropriation in the budget.
In proviso to Article 56, "April 1" shall read "October 1" .
In item 5 of paragraph 2 of Article 57, next to "companies," "capitalized at five million yen (5,000,000)(which shall mean total amount of capital stock, total amount of subscription shares, the aggregate of total amount of capital stock and of subscription shares, or total amount of subscription funds" ) shall be added.
Next to Article 57, the following one Article shall be added.
Article 57-(2) In deciding the successful candidates of the Special Examination for Certified Public Accountant, in addition to the result of the subject or subjects of the examination, decision may be made by considering, when necessary, the number of years of experience of the candidates in such post as prescribed by any item of paragraph 2 of the foregoing Article.
2 Manner of taking the number of experiences as prescribed by the provisions of the foregoing paragraph into consideration shall be prescribed by a Public Accountant Administration Commission Regulation.
Paragraph 1 of Article 60 shall be deleted;and paragraph 2 thereof shall be made as paragraph 1, and the numbering of the paragraph to follow shall be changed accordingly:
In Article 63, "1951" shall read "1958."
In paragraph 2 of Article 65, "As regards the application of the provisions of Article 11" shall read "In case where Junior Public Accountants take the third examination, as regards the application of the provisions of Article 11."
Supplementary Provisions:
1. The present Law shall come into force as from March 31, 1949;provided, however, that the provisions amending item 5 of paragraph 2 of Article 57 shall apply to the Special Examinations for Certified Public Accountants to be held after ten months from the effective date of this Law.
2. The Law for Partial Amendment to the Certified Public Accountant Law (Law No.275 of 1948) shall be abrogated.
