未復員者給與法の一部を改正する法律
Law amending a Part of the Law concerning Undemobilized Persons'Compensation
未復員者給與法(昭和二十二年法律第百八十二号)の一部を次のように改正する。
The Law concerning Undemobilized Persons'Compensation (Law No.182, 1947) shall partially be amended as follows:
第四條第二項中「二百二十五円」を「二百五十円」に改める。
Paragraph 2 of Article 4 is hereby amended by deleting the words "225 yen" and substituting therefor the words "250 yen."
第七條中「四百五十円」を「千円」に改める。
Article 7 is hereby amended by deleting the words "450 yen" and substiuting therefor the words "1,000 yen."
第八條第一項中「八百円」を「千五百円」に、「千円」を「千五百円」に改める。
Paragraph 1 of Article 8 is hereby amended by deleting the words "800 yen" and "1,000 yen" and substituting therefor the words "1,500 yen."
第八條の次に次の五條を加える。
Five new Articles are hereby added under Article 8 as follows:
第八條の二 厚生大臣が、未復員者が自己の責に帰することのできない事由に因り疾病にかかり、又は負傷し復員後療養を要するものと認めた場合においては、復員後二年間、その者に対し、必要な療養費を支給する。
Article 8-(2). A repatriated ex-service man or a Gunzoku (hereinafter referred to as "a repatriated person" ) requiring continued medical care for illness sufferred or injury incurred from a cause not attributable to his own fault prior to his repatriation shall be awarded expenses to cover such medical care, if recognized as necessary by the Minister of Welfare, for a period not exceeding two years after his repatriation.
前項に規定する療養の範囲は、左に掲げるものとする。
The medical care as quoted in the preceding paragraph shall be limited to:
一 診察
(1) Medical examination;
二 藥剤又は治療材料の支給
(2) Supply of medicine and other therapeutic materials;
三 処置、手術その他の治療
(3) Medical treatment, operation and other therapeutic care;
四 病院又は診療所への收容
(4) Hospitalization and other clincial service;
五 看護
(5) Nursing;
六 移送
(6) Transportation.
第一項の療養費の額は、療養に要する費用で厚生大臣の定める基準に從つて算定した額とする。但し、その額は、現に要した額をこえることはできない。
The amount of expenses for medical care as may be awarded under Paragraph 1 of this Article shall be computed on the basis fixed by the Minister of Welfare;provided, that the amount of such expenses shall, in no event, exceed the actual amount paid by the repatriated person concerned.
第八條の三 前條の規定により療養費の支給を受けている者が、その間に死亡した場合においては、遺骨の埋葬に要する経費として死亡者一人当り千五百円をその遺族に支給する。
Article 8-(3). In case a repatriated person dies while receiving medical care pursuant to the provisions of the preceding Article, burial expense of the remain amounting to 1,500 yen shall be issued to the bereaved family of the deceased.
第八條第二項の規定は、前項の場合に準用する。
The provisions of Paragraph 2 of Article 8 shall be applied, mutatis mutandis to the case as provided for in the preceding paragraph.
第八條の四 未復員者が自己の責に帰することのできない事由に因り疾病にかかり、又は負傷した場合において、復員の際治ゆしているとき、復員後二年(療養費の支給を受ける者については、その受けることのできる期間)以内に治ゆしたとき又は治ゆしないがその期間を経過したときに、厚生大臣が、別表第一に掲げる程度の障害の状態にあると認めた者には、その程度に應じ、障害一時金として同表下欄の甲に定める金額を支給する。
Article 8-(4). A lump sum prescribed under Category A of the Annexed Table 1 shall be awarded to a repatriated person sufferring from physical deficiency which was caused by the illness sufferred or the injury incurred from a cause not attributable to his own fault prior to his repatriation, if the Minister of Welfare recognizes that the deficiency is comparable to one of those prescribed in the Annexed Table 1, regardless of whether the medical care for such illness or injury has been completed, either at the time of repatriation or, in the case of a person who required further medical care when repatriated, upon the completion of such medical care within two years after the date of promulgation of this Law or the date of his repatriation, whichever be the later or, upon the expiration of two years after such date.
第八條の五 障害一時金の支給を受けた者には、以後療養費を支給せず、又、重ねて障害一時金を支給しない。
Article 8-(5). Neither the expense for medical care nor the lump sum shall be awarded to a repatriated persons who has previously been awarded a lump sum under the provision of the preceding Article.
第八條の六 他の法令の規定により療養費又は障害一時金に相当する給付の支給を受ける者には、この法律による療養費又は障害一時金を支給しない。
Article 8-(6). The medical expenses or the lump sum as provided for in this Law shall not be awarded to a person eligible for such benefits, in accordance with the provisions of any other laws and ordinances, as may be comparable to the medical expenses or the lump sum provided for by this Law.
第十一條中「別表」を「別表第二」に改める。
Article 11 is hereby amended by deleting the words "the Annexed Table" and substitutingt herefor the words "the Annexed Table 2."
「別表」を「別表第二」に改める。
"Annexed Table" is hereby amended as "Annexed Table 2."
附 則
Supplementary Provisions:
第一條 この法律は、公布の日から施行する。但し、障害一時金に関する部分の規定は、昭和二十三年九月一日から、第四條第二項、第七條及び第八條第一項の改正規定は、昭和二十三年十月一日から適用する。
Article 1. The provisions of this Law shall be enforced from the day of its promulgation;provided that the provisions pertaining to the Lump Sum for physical deficiency shall be effective as from September 1, 1948 and the revised provisions of Article 4, Paragraph 2, Article 7 and Article 8, Paragraph 1 shall be applied as from October 1, 1948.
第二條 厚生大臣が、この法律施行前に復員した者が未復員中において自己の責に帰することのできない事由に因り疾病にかかり、又は負傷し療養を要するものと認めた場合においては、この法律施行の日から二年間、その者に対し、必要な療養費を支給する。
Article 2. An ex-service man or a Gunzoku who had been repatriated on or before August 31, 1948, who requires continued medical care at the time of promulgation of this Law for illness sufferred or injury incurred from a cause not attributable to his own fault prior to his repatriation, shall be awarded expenses to cover such medical care for a period not exceeding two years after the enforcement of this Law, if the Minister of Welfare recognizes that such medical care is needed.
2 第八條の二第二項及び第三項並びに第八條の三の規定は、前項の場合に準用する。
The provisions of Article 8-(2), Paragraphs 2 and 3 and Article 8-(3) shall be applied mutatis mutandis, to the case provided for in the preceding paragraph.
第三條 昭和二十三年八月三十一日以前に復員した者が未復員中において自己の責に帰することのできない事由に因り疾病にかかり、又は負傷し同日前に治ゆしているときに、厚生大臣が、別表第一に掲げる程度の障害の状態にあると認めた者には、その程度に應じ、障害一時金として同表下欄の乙に定める金額を支給する。
Article 3. A lump sum as prescribed under Category B of the Annexed Table 1 shall be awarded to an ex-service man or a Gunzoku who had been repatriated on or before August 31, 1948, who is suffering from physical deficiency which was caused by an illness sufferred or an injury incurred from a cause not attributable to his own fault prior to his repatriation, if the Minister of Welfare recognizes that the deficiency is comparable to one of those prescribed in the Annexed Table 1 and that medical care for the illness or the injury which caused such deficiency had been completed on or before August 31, 1948.
第四條 昭和二十三年八月三十一日以前に復員した者が未復員中において自己の責に帰することのできない事由に因り疾病にかかり、又は負傷し同年九月一日以後この法律施行の日から起算して二年を経過した日までの間に治ゆしたとき又は治ゆしないがこの法律施行の日から起算して二年を経過したときに、厚生大臣が、別表第一に掲げる程度の障害の状態にあると認めた者には、その程度に應じ、障害一時金として同表下欄の甲に定める金額を支給する。
Article 4. A lump sum as prescribed under Category A of the Annexed Table 1 shall be awarded to an ex-service man or a Gunzoku who had been repatriated on or before August 31, 1948, who is sufferring from physical deficiency which was caused by an illness sufferred or an injury incurred from a cause not attributable to his own fault prior to his repatriation, if the Minister of Walfare recognizes that the deficiency is comparable to one of those prescribed in the Annexed Table 1 and that the medical care necessary for the illness or injury which caused such deficiency has been completed since September 1, 1948 and within two years after the promulgation of this Law or has not been completed at the expiration of such two-year period.
第五條 この法律の規定の適用を受ける日前に同一の事由につき他の法令の規定により障害一時金に相当する年金又は一時金の支給を受けた者には、この法律による障害一時金を支給しない。
Article 5. A person who has received benefits in the form of an annuity or a lump sum under another law or ordinance shall not be entitled to any sum payment under this Law for the same cause.

Remarks:
一 視力の測定は、万國式視力表による。屈折異状のあるものについては、きよう正視力について測定する。
1. The eye-sight is measured by the international visual map. With regard to the eye of its irregular reflection, the eye-sight as measured after its correction.
二 指を失つたものとは、おや指は指関節、その他の指は第一指関節以上を失つたものをいう。
2. Loss of finger means its loss from the finger-knuckle, in case of the thumb;its loss more than the first finger-knuckle, in case of other fingers.
三 指の用を廃したものとは、指の末関節の半分以上を失い、又は掌指関節若しくは第一指関節(おや指にあつては指関節)に著しい運動障害を残すものをいう。
3. Loss of the function of finger means its loss of the half or more of the 1st segment, or retention of serious motional disorder in the hand-knuckle or in the first finger-knuckle (the finger-knuckle in case of the thumb).
四 足指を失つたものとは、その全部を失つたものをいう。
4. Loss of toe means its total loss.
五 足指の用を廃したものとは、第一指は末関節の半分以上、その他の指は末関節以上を失つたもの又はせつし関節若しくは第一指関節(第一指にあつては足指関節)に著しい運動障害を残すものをいう。
5. Loss of the function of toe means its loss of the half or more of the 1st segment, in case of the first toe, its loss from the last toe-knuckle, in case of other toes;or the joint or in the first toe-knuckle (the toe-knucle in case of the first toe).
