Law for Establishment of the Agency of Industrial Science and Technology
(Object of the Law)
Article 1. The object of this law is to promote and coordinate scientific and technological research, test and standardization activities of the Ministry of Commerce and Industry, also to promote the dissemination of the results of such research, test and standardization activities and to the promote the improvement of production technique thereby contributing to the prosperity of the economy of Japan.
(Agency of Industrial Science and Technology and Director of the Agency of Industrial Science and Technology)
Article 2. For the purpose of carrying into effect the objectives of the preceding article, the Agency of Industrial Science and Technology shall be established as an "outer bureau" of the Ministry of Commerce and Industry, the head of which will be the Director of the Agency of Industrial Science and Technology.
The Director of the Agency of Industrial Science and Technology shall deal with the matters provided for in Article 3.
(Business and Competency)
Article 3. Subject to other legislation (including orders based on such legislation) the Agency of Industrial Science and Technology shall have the following function:
1. Carrying out the test, research, analysis, certification, judgement, technical investigation and technical guidance and other incidental matters pertaining to mining and industry within the proper scope of the Ministry of Commerce and Industry.
2. Carrying out geological survey and activities related thereto.
3. Stipulation of weights and measures;custody of prototypes of weights and measures;custody of the standard electrical meters, dealing with affairs relative to certification of weighing and measuring instruments, also certification, comparative test, inspection, research, technical investigation, technical and scientific guidance relating to weigning and measuring instruments and incidental matters pertaining thereto within the proper scope of the Ministry.
4. Development, promulation and popularization of commodity standards and industrial standards.
5. Providing technical assistance to the Ministry proper and other "outer brueau" agencies of the Ministry of Commerce and Industry concerning scientific technique and reserach.
6. Encouragement and improvement of scientific technique relating to mining and industry within the scope of the Ministry of Commerce and Industry, as well as encouraging and assisting private agencies in undertakings relative to the above.
(Internal Subdivisions and Organs)
Article 4. The Agency of Industrial Science and Technology have the Industrial Technique Management Council, Industrial Technique advisory Committee and two divisions as follows, as well as laboratories and other organs established by Cabinet Order, which shall perform test, research and other business.

(Industrial Technique Management Council)
Article 5. With regard to the following affairs, the Director or the Agency of Industrial Science and Technology must decide them in accordance with the decision of the Industrial Technique Management Council;provided that this decision shall not be binding on the Minister of Commerce and Industry:(hereinafter the Industrial Technique Management Council shall be called the council in this Article).
1. Affairs concerning making of management plan, and revision thereof, of the Agency of Industrial Science and Technology.
2. Affairs concerning setting of plan, and revision thereof concerning research, investigation, standardization and technical guidance for each year.
3. Affairs concerning the request for the budget of the Agency of Industrial Science and Technology.
4. Other important affairs which are not mentioned in the above provisions, belonging to the competence of the Agency, subject to the designation of the Minister of Commerce and Industry.
The council may submit its opinon concerning the business of the Agency to the Minister of Commerce and Industry or to the Director of the Agency of Industrial Science and Technology, as well as decide the affairs under its competence in accordance with the preceding paragraphs.
If it is deemed necessary for the deliberation, the Council may require the Director of the Agency to submit the necessary reports on the affairs of the Agency.
The Council shall be composed of one chairman, one vice-chairman and 40 or less members.
Other necessary matters relating to the Council shall be provided for by the cabinet order, besides those provided for in each preceding paragraph.
(Industrial Technique Advisory Committee)
Article 6. The industrial Technique Advisory Committee (hereinafter the Industrial Technique Advisory Committee shall be called the Committee in this Article shall deliberate in following affairs, under the inquiry of the Director of the Agency of Industrial Science and Technology):
1. Affairs concerning the execation of test and research regarding the scientific technique of mining and industry within the scape of the Ministry of Commerce and Industry.
2. Affairs concerning the improvement of the production technique of mining and industry within the scape of the Ministry of Commerce and Industry.
3. Affairs concerning the propagation and popularization of the result of test and research and other affairs relative to the foregoing items.
The committee may, besides replying to the inquiry of the Director of the Agency of Industrial Science and Technology, submit the opinion concerning the affairs of each items of the foregoing paragraph to the Director of the Agency of Industrial Science and Technology.
The Committee may request the Director of the Agency of Industrial Science and Technology reports or data concerning the Subject under deliberation.
The Director of the Agency of Industrial Science and Technology shall give due consideration to the reply or opinion of the Committee.
The Committee shall be composed of 20 or less members.
The members shall be appointed by the Cabinet from among porsons of learning and experience according to the recommendation of of the Minister of Commerce and Industry.
The Committee shall have one chairman and one vice chairman elected by mutual note of the members.
Other necessary matters concerning the management of the Committee shall be provided for by Cabinet Order.
(Coordination Division)
Article 7. The Coordination Division shall take charge of the following matters:
1. Administrative affairs relative to planning, investigation and coordination within the competence of the Agency.
2. Collation and dissemination of results of researches and of technical guidance relative to it.
3. Administrative affairs relative to the establishment of the units and the certification of weights and measures.
4. Personnel affairs, accounting and documentary affairs.
5. Matters within the competence of the Agency not falling under the competence of other Divisions and organs.
(Standards Division)
Article 8. The Standards Division shall take charge of matters pertaining to the development, promulgation and popularization of commodity standards and industrial standards.
(Publication of Report)
Article 9. The Director of the the Agency of Industrial Science and Technology shall cause to be published in detail, at least once per year, the progress and results of tests, research and investigation of the laboratories and other technical organs within the Agency.
(Personnel and Organization)
Article 10. Necessary matters concerning personnel of the Agency of Industrial Scieuce and Technology shall be provided for by cabinet order.
Details about the organization of the Agency of Industrial Science and Technology shall be provided for by the Minister of Commerce and Industry.
Supplementary Provisions:
Article 11. The present Law shall come into force as from the day of its promulgation.
Article 12. A part of Regulations governing the Organization of Ministry of Commerce and Industry (Imperial Ordinance No.486 of 1945) shall be amended as follows:
In Article 1, next to "Business concerning weights and measures and monopoly of alcohol" shall be added "(exclusive of business pertaining to units and authorization concerning weights and measures)" , and in Article 5, next to "Business concerning weights and measures" shall be added (exclusive of business pertaining to units and authorization concerning weights and measures)".
Article 10 and Article 11 Deleted.
Article 13. A part of Regulations governing the Organizations of the Bureau of Patents and Standards (Imperial Ordinance No.518, 1945) shall be amended as follows:
The title shall read "the Regulations governing the Organization of the Bureau of Patents" and "Bureau of Patents and Standards" shall read "the Bureau of Patents."
In Article 1, "Design, trade mark, industria standardization and standardization of industrial products" shall read "Design and Trade Mark."
In Article 3, "5 Divisions" shall read "4 Divisions."
In Article 11, "Data concerning industrial standardization and standardization of industrial products" shall be deleted.
Article 14. In the following provisions, "Director of the Bureau of Patents and Standards" shall read "Chief of the Bureau of Patents"
The Law relating to prohibition of Private Monopoly and Methods of Preserving Fair Trade (Law No.54, 1947):Article 100 Paragraphs 2 and 3;
and the Imperial Ordinance concerning the Investigation of Use of Patented Inventions ane Others Owned by the United Nations Nationals under the Imperial Ordinance No.542 of the Twentieth Year of Showa (1945) relating to the Orders to be issued in consequence of the Accestance of the Potsdam Declaration (Imperial Ordinance No.36, 1947):
Article 15. A part of Regulations Governing the Organization of the Electrotechnical Laboratory (Imperial Ordinance No.219, 1918) shall be amended as follows:
"Regulations Governing the Organization of the Etectrotechnical Laboratory" shall read "Regulations Governing the Organization of the Electrical Communications Laboratory," and "the Electrotechnical Laboratory" shall read "the Electrical Communications Laboratory."
"In Article 1," concerning Electrotechnique "shall read" concerning telecommunication."
