The following amedments shall partially be made to the Law for the Prevention of Infectious Diseases of Domestic Animals:
"Prefectural governor (Chiho-Chokan)" shall read "Prefectural governor (To-do-fu-ken Chiji) or Mager of special city (Tokubetsu-shi-cho)" .
In Article 1, par.1, Infectious Abortion of Cattle, Texas-fever "shall read" Cattle Tuberculosis ":" Bovine and Equine Protozoan Diseases (Piroplasmosis, Anaplasmosis, Trypanosomlasis and Trichmoniasis;the same hereinafter), Brucellosis of Cattle, Goat and Swene "shall be added next to" Anthrax ";" Enzootie Equine Encephalitis, Equine Infections Anemia, Equine Paratyphus "shall be added next to" Pseud-farcy ";" Canadian Horse Pox "shall be deleted;" Swine Paratyphus "shall be added next to" Swine Erysipelas"and par.2 of the same Article shall read as follows:
In case any other disease that is deemed to prevail considerably or that is apt to have great infiuence upon the animal husbandry occurs, the Minister of Agriculture and Forestry may designate the species of animal and infectious disease other than the domestic animals and infectious diseases specified in the preceding paragraph and issue an order necessary to apply the whole or one part of this Law. However, the validity of this order shall not exceed 12 months after its promulgation.
In Article 5, par.1, item 1, "Cattle Tuberculosis" shall be added next to "Black-leg" ; "Bovine and Equine Protozoan Diseases, Brucellosis of Cattle, Goat and Swine" next to "Anthrax" ; "Enzootic Equine Encephalitis, Equine Infectious Anemia, Equine Paratyphus" shall be added next to "Pseud-farcy" ; "Canadian Horse Pox" shall be deleted and "Swine Paratyphus" shall be added next to "Swine Erysipelas" .
In Article 8, par.2, item 1, "Infectious Abortion of Cattle, Texas-fever" shall read "Cattle Tuberculosis, Bovine and Equine Protozoan Diseases, Brucellosis of Cattle, Goat and Swine, Equine Infectious Anemia" . In Article 8, par.2, item 3, "Canadian Horse Pox" shall read "Enzootic Equine Encephalitis" ; "or Swine Erysipelas" shall read "Swine Erysipelas or Swine Paratyphus" . In Article 8, par 2, item 4 "Infectious Abortion of Cattle, Texasfever" shall read "Cattle Tuberculosis, Bovine and Equine Protozoan Diseases, Brucellosis of Cattle, Goat and Swine, Equine Infectious Anemia" and "or Swine Erysipelas" shall read "Swine Erpsipelas or Swine Paratyphus" .
In Article 19, Article 20, par.1, Article 22 and Article 24. par.2 "bringing in (1-nyu)" shall read "exporting" .
Article 20-(2). No person may transport any domestic animal from a prefecture to other prefecture, unless it is certified by a health certificate issued by the prefertural governor or an authorized veterinarian. However, this shall not apply to any person who carties a certificate issued by a prefectural governor permitting him to transport the domestic animals diretly to a slaughter house for the purpose of immediate slaughter.
The form of certificate which is mentioned in the preceding paragraph shall be provided for by Order.
In Article 22-(2), par.1, "Hokkaido local expenses (Hokkaido-chiho-hi) or prefectural expenses (Fu-ken-hi)" shall read "prefectural expenses (To-do-fu-ken-hi)" . In par.2 of the same Article, "in accordance with the provisions of an Imperial Ordinance issued in pursuance of" shall read "in accordance with" .
In Article 22-(3), par.2, "Hokkaido local expenses (Hokkaido-chiho-hi) or prefectural expenses (Fu-ken hi)" shall read "prefectural expenses (To-do-fu-ken-hi)" .
Article 23. The expenses for the privention of infectious diseaes shall be borne by the government, prefecture, city, town, village or individual, pursuant to the following classification:
1. The following expenses shall be borne by the government:
(1) Travelling expenses to commissioners for the prevention of infectious diseases of domestic animals other than city, town or village officials who are the commissioners for the prevention of infectious diseases of domestic animals;
(2) Allowances and trayeliing exponses to veterinarians employed for prevention of infectious diseases;
(3) One-half of the expenses of a prefectural government which were required for the purchase or manufacture of the sera for the prevention of infecatious diseases of domestic animals;the total amount thereof in the case of rinderpest;
(4) Expenses for disinfectants necessary for the prevention of infectious diseases, except for those specified in item 3, sub-item 6 and item 4;
(5) Expenses requisite to the quarantine referred to in Article 20, except for those specified in item 3.
(6) One-third of the allowance, pursuant to the provisions of Article 22-(3), par.1;
(7) Allowances pursuant to the provisions of Article 24, pars.1 and 2;
(8) Allowances and travelling expenses to appraisers.
2. The following expenses shall be borne by the city, town or village or the special ward:
(1) Wage of workers who are employed by the commissioners for the prevention of infectious diseases of domestic animals for the purpose of preventing the infectious diseaes;
(2) Expenses for indicators under which the carcasses of domestic animals or articles are buried.
3. The following expenses shall be borne by the owner, administrator or custodian:
(1) Expenses for leading, transportation, isolation or slaughter of domestic animals, and those necessary for taking the measures specified in Article 3, par.1;
(2) Expenses for disinfection of hides of the carcasses produced by death of any domestic animal and hides of the carcasses of any domestic animal specified in Article 8, par.2, item 4 and domestic animal and carcass Produced by slaughter of any domestic animal specified in Article 8, par.2, item 6;
(3) Expenses needed for disinfection which was made without any direction in accordance with the provisions of Article 9 or Article 11;
(4) Expenses for burning or burying carcasses or other articles;
(5) Expenses for feeding and administration needed during the period of detaining of a dog by force, and the expenses for returning it in case the dog is returned;
(6) Expenses for feeding and administration needed during the period of quarsntine, inspection, isolation or keeping;
4. The expenses for disinfection of slaugher-ho use, house for transformation of carcass, livestock market and article attached to them shall be borne by the owner or establisher thereof.
5. Except for each of the matters specified in the preceding items, the expenses for the prevention of infectious diseases shall be borne by the prefecture or special city.
In Article 24, par.1, "not exceeding 30,000 yen" shall be added next to "the allowances" and "in accordance with the Cabinet Order" next to "or an article" . The proviso and item 4 of the same Article, same paragraph shall be deleted;item 5 shall be item 4;and in per.2 of the same Article, items 2, 3 and 5 "shall read" items 2 to 4 inclusive".
Article 24-(2) The "prefectural governor or Mayor of special city" refereed to in the provisions of Articles 5 to 8 inclesive and 24, shall read the "chief of the Animal and Plant Quarantine Station" in case of the quaranitne which is made with respect to import and export.
In Article 26, "500 yen" shall read "10,000 yen" .
In Article 27, "300 yen" shall read "5,000yen" .
Article 28. Any person who fails to make the report mentioned in Article 13 or who contravenes any of the provisions of Article 20-(2) shall be liable to a fine or neinor fide not exceeding 1,000 yen.
Article 30. In this Law, the provisions concerning the prefecture (To-do-fu-ken) shall apply to the general affairs association if the prefecture has the organization of a complete general affairs association or a local public office general affairs association, and the provisions concerning the city, town or village shall apply to the administrative ward in the city referred to in Article 155, par.2 of the Local Autonomy Law, and in case a city, town or village or a special ward has the organization of a complete general affairs association or local public office general affairs association, to such association.
