The Law concerning the Salary and Others for the Public Procurators
Article 1. As to the allowances for Procurator General, Assistant Procurator General and Superintending Procurators, the rules laid down in the Law concerning Salary and Others of the Prime Minister and others shall govern, and as to the allowances for the other Public Procurators, the rules for common civil officials shall be conformed, both in addition to the exceptional provisions in the Public Procurator's Office Law, this Law shall govern. But the overtime allowance prescribed in the Law concerning Temporary Measures for the Salaries and Allowances of the Government Officials in consequence of the enforcement of the Labour Standard Law, etc.(Law No.167 of 1947) shall not be paid.
Article 2. The monthly amount of salary for the Public Procurators shall be as mentioned in the Annexed List.
Article 3. The Attorney-General shall, for Procurators and Assistant Procurators, decide the salary class stated in the Annexed List, corresponding to their duties and responsibilities held and further considering their service merits done, and also according to the standard rules as to decision of salary class, such as starting salary and promotion, etc.
The Attorney-General shall, upon the deliberation with the Minister of Finance, decide the standard rules prescribed in the preceding paragraph.
Article 4. Those who are ordered to wait for the vacancy shall, in accordance with the provisions of Article 24 of the Public Procurator's Office Law, be given family allowance and special location allowance as heretofore.
Supplementary Provisions:
Article 5. This Law shall come into force as from the day of its promulgation.
Article 6. The amount of salary and other allowances (excepting traveling expense) prescribed in this Law shall be provided retroactively as from January 1, 1948.
The salaries and allowances already paid on and after January 1, 1948 shall be regarded as part payment of those salaries and allowances to be paid in accordance with the provisions of the preceding paragraph, and the exceeding amount shall (excepting the amount of retiring allowance and grant money for death), in the application of the Income Tax Law (Law No.27 of 1947), be regarded as allowances prescribed in Item 5, Par.1, Art.38 of the said Law.
Article 7. The Law concerning the Emergency Measures for Allowances and Others for the Public Procurators (Law No.66 of 1947) shall be abolished.
Article 8. Provisions of this Law shall not be construed to repeal, amend, or supersede in any particular provisions of this National Public Service Law.
Article 9. The monthly amount of salary for Procurators may, for the time being, be 14,000 yen only in special cases, notwithstanding the provisions of Article 2.
