審議経過

朕は、昭和二十年勅令第五百四十二号ポツダム宣言の受諾に伴い発する命令に関する件に基き昭和二十一年勅令第二百九十四号（連合國財產の返還等に関する件）の一部を改正する勅令を裁可し、ここにこれを公布せしめる。
I hereby give My sanction to the Imperial Ordinance concerning the partial amendments of the Imperial Ordinance No. 294 of 1946 (on Returning, etc. of Allied Nation's Property) under the Imperial Ordinance No. 542 of 1945 relating to the Orders to be issued in consequence of the Acceptance of the Potsdam Declaration, and cause the same to be promulgated.

勅令第四十六号
Imperial Ordinance No. 46
昭和二十一年勅令第二百九十四号の一部を次のように改正する。
The following partial amendments shall be made to the Imperial Ordinance No. 294 of 1946.
第一條　この勅令において聯合國財產とは、左に揭げる財產をいふ。
Article 1.　The Allied Nation's Property as mentioned in this Ordinance shall be stipulated as follows:
一　敵產管理法第一條第一項の規定による管理人の管理に付せられたことのある財產
1.　Property which has been placed under custody by administrator as prescribed in paragraph 1, Article 1 of the Hostile Property Administration Law.
二　前號に揭げるものを除く外、この勅令施行前聯合國又は聯合國人の所有に屬したことのある財產で聯合國最高司令官の要求に基き大藏大臣の指定するもの
2.　Property which has been owned by Allied Powers or Allied Nationals before enforcement of this Ordinance and designated by the Minister of Finance in conformity with the demand of the Supreme Commander for the Allied Powers, save those as mentioned in the preceding item.
前項第二號の聯合國及び聯合國人の範圍は、大藏大臣がこれを定める。
The limit of Allied Powers or Allied Nationals in item 2 of the preceding paragraph shall be designated by the Minister of Finance.
第一項第二號の規定による指定は、吿示でこれを行ふ。
The designation as prescribed in item 2, paragraph 1 shall be made by Notification.
第二條第一項中「昭和十六年十二月八日以後において」を削り、「同日午前零時において聯合國財產を所有してゐた者」を「舊所有者であつた聯合國又は聯合國人」に改める。
In paragraph 1, Article 2 "on and after December 8, 1941," shall be deleted, and "The owner thereof at 00.00 o'clock of the day" shall be amended as "The Allied Powers or Allied Nationals who was original owner."
同條に次の一項を加える。
The following paragraph shall be added to Article 2:
前項に規定するものを除く外、第一項の場合における利害關係人の間における權利の調整その他必要な事項は、大藏大臣がこれを定める。
The adjustment of rights between the persons concerned and other necessary matters in case of paragraph 1 shall be decided by the Minister of Finance, save those as prescribed in the preceding paragraph.
附　則
Supplementary Provisions:
この勅令は、公布の日から、これを施行する。
The present Ordinance shall come into force as from the day of its promulgation.
昭和二十一年勅令第二百九十四号第二條第一項の規定による命令のあつた場合の外、この勅令の施行前、連合國最高司令官の要求に基き、連合國又は連合國人に属したことのある財產を旧所有者であつた連合國又は連合國人に対し返還した場合においては、当該措置は、これを同項の規定による命令に基いてしたものとみなす。
In case where the property once owned by Allied Powers or Allied Nationals was restituted to the Allied Powers or Allied Nationals, original Owners, before enforcement of this Ordinance in conformity with the demands of the Supreme Commander for the Allied Powers, save in case the Order was issued as prescribed in paragraph 1, Article 2 of the Ordinance No. 294 of 1946, the said measure shall be regarded as taken in conformity with the Order as prescribed in the same paragraph.
