Nutritionist Law
Article 1. In the present Law, a Nutritionist shall be one whose business is to engage in guidance of nutrition, using title of Nutritionist.
Article 2. The following person may become a Nutritionist after licenced by the Governor of Tokyo Metropolis, Hokkaido and the other prefecture:
1. One who learned more than a year and acquired the knowledge and technical skill necessary for a Nutritionist at a training institution designated by the Welfare Minister;
2. One who passed the examination for Nutritionists to be given by the Welfare Minister;
Those who are admitted into the training institution for Nutritionists provided in Item 1 of the preceding paragraph are to be those who are provided for in Article 56 of the School Education Law.
Those who are able to take the examination for Nutritionists provided in Paragraph 1, Item 2 are to be those who are provided for in Article 56 of the School Education Law and who are trained in the practising business of Nutritionist more than a year.
The examination for Nutritionists provided in Paragraph 1, Item 2 shall be given concerning the necessary knowledge and technical skill as Nutritionists.
Article 3. The licence shall not be given to one who comes under any one of the following items:
1. One who is suffering from a mental disease;
2. One who is unsuitable for practising business mentioned in Art.1, being suffering from an infectious disease;
3. One who is unsuitable for practising business mentioned in Art.1, having committed a crime or done wrong deed concerning the business mentioned in Art.1;
4. One who is unsuitable for practising business mentioned in Art.1, being of nutoriously bad character.
Article 4. Licence for Nutritionist shall be executed, granting a licence for Nutritionist.
Article 5. In case a Nutritionist has come under any one of all the items of Article 4, the said Governor may cancel licence for the Nutritionist concerned or suspend the use of the title of Nutritionist for a fixed term of less than a year.
Article 6. Unless one is Nutritionist, he or she shall not use title of Nutritionist or the like.
Article 7. Necessary matters concerning licencing, written authorization and examination for Nutritionist shall, except for that provided for in the present Law, be fixed by a Ministerial Ordinance.
Article 8. One who comes under any one of the following items shall be liable to a fine not more than 50 yen:
1. One who infringed provisions of Article 6;
2. One who is a Nutritionist being suspended of the use of the title of Nutritionist and has used the title of Nutritionist or the like.
Supplementary Provisions:
Article 9. The present Law shall come into force as from January 1, 1948.
Article 10. The Nutritionist Regulations (Ministry of Welfare Ordinance No.14, 1945) shall be abrogated.
Article 11. Disposition or other act according to provisions of the Nutritionist Regulations, Ministry of Welfare Ordinance No.14, 1945, before the enforcement of the present Law, shall be regarded as disposition and other act in accordance with the corresponding provisions of the present Law or the Order to be issued under the same Law.
Article 12. One who graduated from the middle grade school course under the Middle Grade School Ordinance or one who is recognized by the Minister of Education as having more attainments than that of the one mentioned above shall be admtted into the training institution designated by the Minister of Welfare for the time being, regardless of the provisions of Article 1, Paragraph 1, Item 1.
One who graduated from the middle grade school course under the Middle Grade School Ordinance or one who is recognized dy Minister of Education as having more attainments than that of the one mentioned above and is trained in the practising business of Nutritionists for more than a year shall be able to take for the time being the examination for Nutritionists provided for in Article 2, Paragraph 1, Item 2 irrespective of the provision of Paragraph 3 of the same Article.
