審議経過

朕は、昭和二十年勅令第五百四十二號ポツダム宣言の受諾に伴ひ發する命令に關する件に基く漁業法の罰則の特例に關する勅令を裁可し、ここにこれを公布せしめる。
I hereby give My Sanction to the Imperial Ordinance concerning the special instances of punishments relating to the Fisheries Law, pertaining to the orders to be issued in accordance with the Potsdam Declaration given in the Imperial Ordinance No. 542 in the twentieth year of Showa (1945) and cause the same to be promulgated.

勅令第五百二十九號
Imperial Ordinance No. 529
第一條　左の各號の事項に關し漁業法第三十五條第二項の規定により主務大臣の定める制限又は禁止に違反した者は、同法第五十九條前段の規定にかかはらず、これを二年以下の懲役又は三萬圓以下の罰金に處する。
Article 1.　With regard to each of the following ems, any one who has violated the restrictions r prohibitions designated by the competent Minister in accordance with the provision of paragraph of Article 35 of the Fisheries Law, shall be subject to penal servitude for two years or less, or a fine of ¥30,000 (thirty thousand yen) or less, despite the provision of the former part of Article 9 of the same Law:
一　捕獲する鯨の種類、體長又は數量（鰮鯨の體長を除く。）
1.　The species, size or number of whales to be taken (excepting size of sei-whales).
二　鯨を捕獲する海面（北緯二十度以北の海面を除く。）又は期間
2.　The sea areas (excluding seas north of 20 North Latitude) or whaling period in which whales are taken.
三　南緯四十度以南の海面において有鬚鯨を處理するために使用した母船の使用
3.　The operation of factory ships used for treating baleen whales on seas south of 40 South Latitude.
四　捕獲した鯨の利用
4.　The utilization of whales taken.
五　捕鯨母船又は捕鯨船の乘組員の報酬
5.　The remunerations for the crews of factory ships or whalers.
六　有鬚鯨の捕獲又は處理のため根據地の使用
6.　The use of land stations for taking or treating baleen whales.
第二條　前條の制限又は禁止に違反した者には、情狀に因り、懲役及び罰金を併科することができる。
Article 2.　Any one who has violated the restrictions or prohibitions of the preceding Article may be subject to simultaneously penal servitude and fine according to circumstances.
第三條　法人の代表者又は法人若しくは人の代理人、使用人その他の從業者が、その法人又は人の業務に關して第一條の違反行爲をしたときは、行爲者を罰する外、その法人又は人に對して同條の罰金刑を科する。
Article 3.　In case a representative of a juridical person, an agent, an employee or any other worker of a juridical person or an inlividual has offended against the provision of Article 1 in the performance of the business of a juridcal person or an individual, not only the actual offender shall be punished, but the juridical person or the individual shall also be subject to the monetary penalty of the same Article.

Supplementary Provision:
この勅令は、公布の日から、これを施行する。
The present Ordinance shall come into force as from the day of its promulgation.
