Imperial Ordinance No. 524
The Enforcement Ordinance of the Temporary Special Instances of the Pensions Law.
Art. 1. The Officials prescribed in par. 4 of the supplementary provisions of the Imperial Ordinance No. 435 of 1946, who are not applied to the provisions of Art. 1 of the said Ordinance (hereinafter to be called the applicable), shall be in accordance with the following Special Instances, for the purpose of the application of the Law concerning the Temporary Special Instances of the Pensions Law (hereinafter to be called the Law).
1. With regard to the application of the provisions of Art. 1 par. 2 of the Law, the amount corresponding to that of 400 per cent (in the case of the educational personnels of the National Schools and the schools of the similar kind, or the Police or Prison personnels, 200 per cent) of the salary which the applicable received actually on June 30, 1921 (hereinafter to be called the former salary), shall be regarded as the amount of salary which may be received by the applicable.
2. With regard to the application of the provisions of Art, 3 of the Law, the amount corresponding to that of 130 per cent (in the case of the applicable who has been received of office or is dead on account of the wound or sickness caused by official service, 140 per cent) of the monthly amount of the former salary, shall, respectively be, notwithstanding the provisions of the Table No. 1 of the Annexed Table of the Law, the monthly amount of the provisory salary of the applicable.
3. With regard to the application of the provisions of Art. 4 and Art. 6 inclusive of the Law, in the columns of grades and classes of the Tables Nos. 2 to 7 of the Annexed Tables of the Law, "monthly amount of salary at the time of retirement", "1,050 yen", "850 yen", "800 yen", "700 yen", "580 yen" and "390 yen", shall read respectively "Monthly amount of the provisory salary of the preceding item", "260 yen", "190 yen", "175 yen", "145 yen", "115 yen", asd "65 yen".
Art. 2. The increase of the pensions prescribed in Art. 8 of the Law, shall be made without the claim of the pensioners.
Art. 3. With regard to the application of the provisions of Art. 25 of the Enforcement Ordinance of the Pensions Law, 130 yen" and "800 yen" shall read respectively "800 yen" and "390 yen". However, it shall be applied to those persons prescribed in Art. 1.
Supplementary Provision:
The present Imperial Ordinance shall be applied as from July 1, 1946.
