審議経過

朕は、金融機關經理應急措置法及び會社經理應急措置法に基く公證人の目錄及び明細書の認證等の手數料に關する勅令を裁可し、ここにこれを公布せしめる。
I hereby give My Sanction to the Imperial Ordinance concerning Notary Public-Fee with regard to certification of statement of assets, etc. and cause the same to be promulgated.

Imperial Ordinance No. 398
第一條　金融機關經理應急措置法第八條又は會社經理應急措置法第八條第二項若しくは第五項の規定による目錄又は明細書の認證、目錄又は明細書及び附屬書類の謄本の交付竝びに目錄又は明細書及び附屬書類の閱覽について公證人の受くべき手數料については、この勅令の定めるところによる。
Article 1.　Fees charged by the notaries for the following matters shall be prescribed by this Ordinance: For certifying statements of assets according to the provisions of Article 8 of the Law regarding the Emergency Measures for Accounts of Financial Institutions, and Paragraph 2 or 5 of Article 8 of the Law regarding the Emergency Measures for Accounts of Companies. For giving certified copies of statements of assets and their accompanying documents according to the above-mentioned provisions. For giving permission to read statements of assets and their accompanying documents according to the above-mentioned provisions.
第二條　目錄又は明細書の認證の手數料は、一件につき、その紙數が三十枚までの場合においては五十圓とし、三十枚を超える場合においては、その超える紙數十枚ごとに五圓を加へる。この場合において、十枚に滿たない端數の紙數は、これを十枚として計算する。
Article 2.　Fees chaged for certifying statements of assets shall be 50 yen where one case does not exceed 30 sheets. An additional charge of 5 yen shall be made for every extra 10 sheets or any odd number of extra sheets.
前項の紙數は、一行二十字詰二十四行を以て一枚とする。この場合において、一枚に滿たない端數の行數は、これを一枚として計算する。
One sheet shall consist of 24 lines, each line including 20 words; however, a sheet containing less than 24 lines shall be reckoned as one sheet.
第三條　目錄又は明細書及び附屬書類の謄本の交付についての手數料は、一枚につき一圓三十錢とする。但し、謄本を請求する者において、謄本に記載すべき事項を自ら記載して公證人の署名捺印のみを請求する場合においては、手數料は、一枚につき九十錢とする。
Article 3.　Fees for a certified copy of a statement of assets and its accompanying documents shall be 1 yen 30 sen per sheet; however, 90 sen shall be charged per sheet for signing a copy already filled in by the applicant.
前條第二項の規定は、前項の紙數の計算にこれを準用する。
The provisions of Paragraph 2 of the preceding article shall apply correspondingly to the reckoning of the number of sheets mentioned in the preceding paragraph.
第四條　目錄又は明細書及び附屬書類の閱覽についての手數料は、一回につき九十錢とする。
Article 4.　Fees for giving permission to read a statement of assets and its accompanying documents shall be 90 sen every time.
第五條　前三條に規定するものの外、第一條に揭げる手數料については、公證人手數料規則及び昭和二十一年勅令第二百八十號（公證人の手數料等の增額に關する勅令）の適用がある。
Article 5.　The Notary Public Fee Regulations and the Imperial Ordinance No. 280, 1946 (The Imperial Ordinance concerning the Increase of Notary Public Fee and others) shall apply in regard to the fees mentioned in Article 1 of this Ordinance, unless provided otherwise than in the preceding three articles of this Ordinance.
附　則
Supplementary Provision:
この勅令は、公布の日から、これを施行する。
The present Imperial Ordinance shall come into force as from the day of its promulgation.
