審議経過

朕は、臨時法制調査會官制を裁可し、ここにこれを公布せしめる。
I hereby given My Sanction to the Regulations concerning the Organization and Function of the Temporary Committee for the Investigation of Legal Systems and Cause the same to be promulgated.

臨時法制調査會官制
The Regulations concerning the Organization and Function of the Temporary Committee for the Investigation of Legal Systems.
第一條　臨時法制調査會は、內閣總理大臣の監督に屬し、その諮問に應じて、憲法改正に伴ふ諸般の法制の整備に關する重要事項を調査審議する。
Article 1.　The Temporary Committee for the Investigation of Legal Systems is placed under the supervision of Prime Minister, and, upon the inquiry made by the Prime Minister, deliberates upon the important matters concerning the arrangement of various legal systems resulting from the amendments of this Imperial Constitution.
第二條　調査會は、會長一人、副會長一人及び委員若干人で、これを組織する。
Article 2.　The Committee consists of one Chairman, one Vice-Chairman and Committee-members.
第三條　會長は、內閣總理大臣を以て、これに充てる。
Article 3.　The position of Chairman is filled by the Prime Minister.
副會長は、國務大臣を以て、これに充てる。
The position of Vice-Chairman is filled by a Minister of State.
委員は、內閣總理大臣の奏請により、內閣でこれを命ずる。
The Committee-members are appointed by the Cabinet upon the recommendation of the Prime Minister.
第四條　會長は、會務を總理する。
Article 4.　The Chairman presides over the functions of the Committee.
副會長は、會長を補佐し、又、會長に事故があるときは、その職務を代理する。
The Vice-Chairman renders assistance to the Chairman, and, in case some hindrance occurs to him, fulfils his function on his behalf.
第五條　內閣總理大臣は、必要に應じ、調査會に部會を置き、その所掌事項を分掌させることができる。
Article 5.　The Prime Minister, in case of necessity, may set up sub-committees in the Committee and cause them to discharge some parts of the function assigned to the Committee.
部會に部會長を置き、內閣總理大臣の指名により、副會長又は委員を以て、これに充てる。
The sub-committees shall have chiefs, of which the position shall be filled by either the Vice-Chairman or Committee-members as are nominated by the Prime Minister.
部會所屬の委員は、會長が、これを指名する。
The Committee members to be attached to sub-committees shall be nominated by the President.
第六條　調査會は、その定めるところにより、部會の決議を以て調査會の決議とすることができる。
Article 6.　The Committee can make the resolutions of the sub-committees the resolutions of the same committee according to its provisions.
第七條　調査會に幹事長及び幹事を置く。
Article 7.　The Committee shall have Chief Secretary and Secretaries.
幹事長は、法制局長官を以て、これに充てる。
The position of Chief Secretary is filled by the Director of the Legislative Bureau.
幹事は、內閣總理大臣の奏請により、內閣でこれを命ずる。
The Secretaries are appointed by the Cabinet upon the recommendation of the Prime Minister.
幹事長及び幹事は、上司の命を承け、庶務を整理し、會議事項について、調査及び立案を掌る。
The Chief Secretary and Secretaries arrange the general affairs by order of the senior officials and research or plan for the matters to be discussed in the meeting.
第八條　調査會に主事を置き、內閣でこれを命ずる。
Article 8.　The Committee shall have a manager, who shall be nominated by the Cabinet.
主事は、上司の指揮を承け、庶務を掌る。
The Manager transacts the general affairs under the guidance of the seniors officials.
附　則
Supplementary Provision:
この勅令は、公布の日から、これを施行する。
The present Ordinance shall come into force as from the day of its promulgation.
