MEMORANDUM FOR

THE JAPANESE GOVERNMENT.

THROUGH

SUBJECT

Responsibilities of the Japanese Government for the Packaging, Transfer, and Delivery of Equipment and Records Allocated to Claimant Nations Under the Reparations Program

1. For planning purposes, the Japanese Government is hereby informed that on the initiation of the reparations transfer program, the principles and procedures outlined in the following paragraphs will be applicable.
2. In delivering reparations assets to claimant nations, the Japanese Government will bear all costs and perform all operations relative to the packaging, transfer, storage, delivery to a port in Japan for water-borne or air-borne craft, handling, and stowage on board the claimant nation’s craft at that port.
3. Prior to the receipt of an allocation notice, the Japanese Government may be requested to furnish to the Supreme Commander for the Allied Powers a detailed step by step plan for the dismantling, packaging, and transportation of each plant or facility designated for reparations removal other than aircraft factories, army and navy arsenals, and privately owned munitions plants. Reference is Annex 1 for instructions.
4. Upon receipt of an allocation notice from the Supreme Commander for the Allied Powers (references are Annex 2 and Annex 3 for forms), the Japanese Government will accomplish and be responsible for performing the following operations or actions:
a. Acquiring title from present owners to allocated reparations assets which are not already the property of the Japanese Government.
b. Necessary dismantling and disassembly of plants and equipment. Reference is Annex 4 for instructions. Dismantling and disassembly operations will follow previously prepared plans.
c. Cleaning and preservation, and packaging of equipment to standards which will ensure its stowage aboard the craft of the claimant nation in good order. References are Annex 5 for instructions on cleaning, preservation, and inner packaging; and Annex 6 for instructions on the construction of exterior wooden shipping containers.
d. Supplying all materials and equipment required for dismantling, disassembly, cleaning and preservation, packaging, transportation to a port in Japan, storage in Japan, and loading and stowing with proper dunnage and bracing aboard the craft of the claimant nation.
e. Marking of containers and preparing packing lists. Reference is Annex 7 for instructions.
f. Preparing necessary constructional plans, drawings, and engineering data required for purposes of re-assembly, re-installation and/or re-erection.
g. Transporting equipment to ports in Japan, designated by the Supreme Commander for the Allied Powers, for water-borne or air-borne craft according to shipping schedules established by the Supreme Commander for the Allied Powers. Reference is Annex 8 for transportation permit form, designating the port and authorizing shipments thereto in order to meet established shipping schedules.
h. Storing equipment whenever necessary prior to stowage aboard the claimant nation’s craft.
i. Handling and loading of equipment up to, and including stowage with proper dunnage and bracing in, the claimant nation’s craft. Stowage operations will be performed under the direction of the craft’s officers.
j. Guarding the equipment while enroute and in storage in Japan.
k. Reporting the progress of removal operations. Reference is Annex 9 for instructions.
l. Reporting the detailed costs of removal operations. The Japanese Government will furnish to Supreme Commander for the Allied Powers within thirty (30) days of receipt of this memorandum copies of the forms proposed for cost accounting use. The proposed forms will be reviewed by Supreme Commander for the Allied Powers for their acceptability. Reported costs of removal will be subject to review by Supreme Commander for the Allied Powers who will disapprove any unjustified charge. Reports will be submitted according to the same schedule as prescribed for Progress Reports, reference Annex 9.
m. Making good any damage or shortage resulting from carelessness or negligence in the processes of dismantling, packaging, transporting, handling, storing, and stowing on board carrier if such damage or shortage occurred prior to final acceptance by the claimant nation aboard the carrier.
n. Making good any damage sustained by the carrier, resulting from loading, stowage and bracing cargo therein in a careless or negligent manner.
o. Other operations, not listed above, relative to the packaging, transfer, and delivery of allocated reparations assets.
5. Damage which is the result of faulty gear of the recipient nation’s carrier, sustained by the equipment or carrier in the process of loading and stowing, will be the responsibility of the recipient nation.
6. Injury to Japanese personnel engaged in the loading and stowage of the recipient nation’s carrier will be the responsibility of the Japanese Government.
7. Receipt for equipment delivered to the claimant nations for reparations will be given by the claimant nation upon the completion of the proper stowage of equipment aboard the claimant nation’s craft. Reference is Annex 10 for receipt form and instructions. After the delivery receipt has been executed, the equipment will become the entire responsibility of the claimant nation. A representative of the claimant nation may be present at the dismantling of each facility and all subsequent operations up to the execution of the delivery receipt.
8. The Japanese Government will have qualified representatives prepared on call to report to the Commanding General, Eighth Army, to receive detailed instructions to accomplish the purpose of this memorandum.

1. With reference to memorandum SCAPIN 1751, this Headquarters to the Japanese Government, the following is published for the information of all concerned.
2. Purpose of the memorandum is to define the responsibility of the Japanese Government in the packaging, transfer and delivery of reparations assets allocated to claimant nations, in order that the Japanese Government may accomplish necessary planning prior to the initiation of the reparations transfer program.
3. In delivering reparations equipment to claimant nations, the Japanese Government will bear all costs and perform all operations relative to the packaging, transfer and delivery to a port in Japan for water-borne or air-borne craft, and handling and stowage with proper bracing and dunnage aboard the claimant nation's craft at the port.
4. Detailed instructions regarding the packaging, transfer and delivery of allocated reparations assets are contained in the memorandum.
5. Surveillance by the Occupation Forces will be that required to insure proper handling and delivery of reparations assets and records.
6. Command instructions pertaining to the executions of surveillance follow, through command channels.
