Subject | Relaxation of Control of Property Owned by United Nations Nationals Outside of Japan |
1. Reference is made to the following memoranda for the Japanese Government from General Headquarters, Supreme Commander for the Allied Powers:
a. File AG 091.3 (22 Sep 45) ESS SCAPIN 44, 22 September 1945, subject, “Controls over exports and imports of gold, silver, Securities and financial instruments”
b. File AG 130 (22 Sep 45) ESS, SCAPIN 45, 22 Septmber 1945, subject, “Control of Financial Transactions”
c. File AG 386.3 (6 May 46) CPC, SCAPIN 926, 6 May 1946, subject, “Procedure for Returning Property in Japan to Nationals of the United Nations”
2. Paragraph 1e of reference 1a is hereby rescinded and the following substituted therefor.
“e. Powers of attorney, proxies, or other authorizations or instructions to effect financial or property transactions within or outside of Japan except wherein powers of attorney or proxies so state and are imported into Japan for purposes incident to restitution of property in Japan”
3. Paragraph 1d of reference 1b is hereby rescinded and the following substituted therfor,
“d. Property in Japan which is, or on or since 7 December 1941, has been, owned or controlled directly or indirectly, in whole or in part, by any person outside of Japan except wherein such property is being administered by an agent of a United Nations National holding a powere of attorney accredited by General Headquarters, Supreme Commander for the Allied Powers;”
4. So much of paragraph 1, reference 1c as reads, “The Imperial Japanese Government is directed to follow the procedure outlined below in the restitution of property in Japan to Nationals of the United Nations who are residing in Japan or who may hereafter return to Japan:”, is hereby rescinded and the following substituted therefor:
“1. The Japanese Government is directed to follow the procedure outlined below in the restitution of property in Japan to nationals of the United Nations who are residing in Japan or who may hereafter return to Japan or to the authorized representatives therof:”
