SUBJECT | Procedure for Returning Property in Japan to Nationals of the United Nations. |
1. The Imperial Japanese Government is directed to follow the procedure outlined below in the restitution of property in Japan to nationals of the United Nations who are residing in Japan or who may hereafter return to Japan:
a. The present Japanese custodians or administrators of properties in Japan owned by United Nations nationals on 7 December 1941 will be instructed by the Imperial Japanese Government to inform any United Nations national who applies for return of his property that three copies of an application in the form attached marked Annex A should be submitted through the representative of his Government in Japan to General Headquarters, Supreme Commander for the Allied Powers.
b. One (1) copy of this application will be forwarded by General Headquarters, Supreme Commander for the Allied Powers to the Imperial Japanese Government for examination. The Imperial Japanese Government will, as promptly as possible, return the application to General Headquarters, Supreme Commander for the Allied Powers, furnishing complete information as to (1) complete documentary record of title to ownership on 7 December 1941; (2) the present physical condition and location of the property; (3) whether or not sold and if sold all pertinent data relative to the sale including the name and address of the purchaser and present owner; (4) the financial status of the property, including proceeds of sales made, amounts credited to and withdrawn from the account and present balance of the account, and (5) any other pertinent data.
c. All the above (a and b) shall be in the English language except that data or evidence submitted by the nationals of United Nations may be in Japanese. In case of need and if available original documents may be exhibited but not filed with the Japanese Government authorities or custodians.
d. General Headquarters, Supreme Commander for the Allied Powers will subsequently instruct the Imperial Japanese Government as to what action will be taken in each case of restitution.
2. The term “property” as used in this Memorandum shall include money, checks, drafts, bullion, bank deposits, savings accounts, any debts, indebtedness, or obligations, financial securities commonly dealt in by bankers, brokers and investment houses, notes, debentures, stocks, bonds, coupons, bankers, acceptances, mortgages, pledges, liens or other right in the nature of security, warehouse receipts, bills of lading, trust receipts, bills of sale, any other evidences of title, ownership, or indebtedness, goods, wares, merchandise, chattels, stocks on hand, ships, goods on ships, real estate mortgages, vendors, sales agreements, land contracts, real estate and any interest therein, leaseholds, ground rents, options, negotiable instruments, trade acceptances, royalties, book accounts, accounts receivable, judgements, patents trademarks, copyrights, contracts or licenses affecting or involving patents, trademarks or copyrights, insurance policies, safe deposit boxes and their contents, annuities, pooling agreements, contracts of any nature whatsoever, etc.
3. The filling of demands for restitution of property shall not prejudice the right of the claimant or applicant to claim for compensation at a subsequent time.
4. Direct communication between the appropriate agencies of the Imperial Japanese Government and the Civil Property Custodian, General Headquarters, Supreme Commander for the Allied Powers, is hereby authorized to implement this Memorandum.
5. Six (6) copies of all ordinances issued to comply with provisions of this Memorandum shall be furnished to General Headquarters, Supreme Commander for the Allied Powers by 27 May 1946. Such copies shall contain both the English and Japanese text.
