Law for Partial Amendment to the Patent Law
The Patent Law (Law No.96 of 1921) shall be partially amended as follows:
In Article 32, next to "provided for by a Treaty or those similar thereto" shall be added "and in the case where it is provided for that the country to which the person belongs allows the Japanese nationals to enjoy a patent right or a right relating to patent under the same condition with that of the nationals of the said country or it is provided for that, if Japan allows the nationals of that country to enjoy a patent right or a right relating to a patent, the Japanese nationals are allowed to enjoy a patent right or a right relating to a patent in the country to which the person belongs under the same condition with that of the nationals of the said country" .
Supplementary Provisions:
1 This Law shall come into force as from the day of the first coming into force of the Treaty of Peace with Japan.
2 During the period from the day of enforcement of this Law to the day on which Japan becomes one of the State parties to the Convention on International Civil Aviation, aircrafts of the State parties to the Convention on International Civil Aviation engaging in international aviation service (excluding those countries which are not the State parties to the International Convention for the Protection of Industrial Property signed at Paris on the March 20, 1883, and which are other than those which allow the nationals of all other State parties to the Convention on International Civil Aviation to enjoy a patent right, utility model right, design right and the other rights relating to a patent, utility model or a design) or equipments thereof or equipments imported to be used for the aircraft shall be deemed to come under each of the items of Article 36 of the Patent Law (including the cases where the same applies mutatis mutandis in Article 26 of the Utility Model Law (Law No.97 of 1921) and Article 25 of the Design Law (Law No.98 of 1921);hereinafter the same) even if the above does not come under any of the items of Article 36 of the Patent Law.
