Law for Partial Amendments to the Law concerning Provisional Measures for Subsidy by Treasury for Disasters Rehabilitation Works Expenses for Facilities of Agriculture, Forestry and Fishery
農林水産業施設災害復旧事業費国庫補助の暫定措置に関する法律（昭和二十五年法律第百六十九号）の一部を次のように改正する。
The Law concerning Provisional Measures for Subsidy by Treasury for Disasters Rehabilitation Works Expenses for Facilities of Agriculture, Forestry and Fishery (Law No.169 of 1950) shall be partially amended as follows:
第三條第三項中「前項の規定」を「第二項及び第三項の規定」に改め、同項を第五項とし、同條第二項の次に次の二項を加える。
"Provision of the preceding paragraph" in Article 3 paragraph 3 shall be amended as "provisions of paragraphs 2 and 3" ;the same paragraph shall be made paragraph 5;and the following two paragraphs shall be added next to paragraph 2 of the same Article:
３　その年の一月一日から十二月三十一日までに発生した災害により甚大な被害を受けた地域に限り、その被害を受けた農地、農業用施設、林道及び漁港施設の災害復旧事業の事業費（第五項の超過事業費を除く。）のうち政令で定める額に相当する部分につき、第一項の規定により国が行う補助の比率は、前項の規定にかかわらず、左の区分による。
3　With respect to the portion corresponding to the amount fixed by Cabinet Order of the works expenses (excluding the excess works expenses mentioned in paragraph 5) for the disasters rehabilitation works on such agricultural lands, facilities for agricultural use, forest roads and fishing port facilities as are damaged in disasters that may have occurred at any time from January 1 to December 31 of the year concerned, the rate of subsidy to be granted by the State in accordance with the provision of paragraph 1, in so far as areas seriously damaged in the foresaid disasters are concerned, shall be classed as follows, irrespective of the provision of the preceding paragraph:
一　農地に係るもの　　　　　当該部分の十分の八
二　農業用施設に係るもの　　当該部分の十分の九
三　林道に係るもの
　イ　奥地幹線林道に係るもの　　当該部分の十分の九
　ロ　その他の林道に係るもの　　当該部分の十分の七・五
四　漁港施設に係るもの　　　当該部分の十分の九
(1)Concerning agricultural land:80 per cent of the amount of the said portion
(2)Concerning facilities for agricultural use:90 per cent of the amount of the said portion
(3)Concerning forest-roads:
a. Inaccessible trunk forest-road:90 per cent of the amount of the said portion
b. Other forest-road:75 per cent of the amount of the said portion
(4)Concerning fishing port facilities:90 per cent of the amount of the said portion
４　前項の地域は、その年ごとに農林大臣が指定する。
4　The areas as mentioned in the preceding paragraph shall be designated each year by the Minister of Agriculture and Forestry.
附　則
Supplementary Provision:
この法律は、公布の日から施行し、昭和二十六年一月一日以後に発生した災害に係る災害復旧事業について適用する。
This Law shall come into force as from the day of its promulgation and apply to the disasters rehabilitation works with respect to such disasters as occurred on and after January 1, 1951.
