Law concerning Temporary Measures for Court Officials
As to matters regarding the position classification plan, examination, appointment and dismissal, compensation, efficiency, status, disciplinary punishment, guarantee, performance of duty and pension of court officials other than judges and confidential secretaries to judges, the provisions of the following Laws shall apply mutatis mutandis for the time being, except as otherwise specially provided for by Law. In this case, in the provisions (with the exception of the provisions of Article 29 paragraph 5 and Article 38 paragraph 4 of the National Public Service Law (Law No.120 of 1947)) of the said Laws, "The National Personnel Authority" shall read "The Supreme Court," and "The National Personnel Authority Rule" shall read "The Supreme Court Rule."
1. The National Public Service Law (with the exception of the provisions of Articles 1 to 26 inclusive, 28, 55, Article 63 paragraph 2, Article 64 paragraph 2, Article 67, Article 72 paragraph 2, Article 73 paragraph 2, Article 95 and Article 108 paragraph 4, and of the penal provisions concerning such provisions)
2. The Law concerning the Position-Classification Plan of National Public Service (Law No.180 of 1950)
3. The Law concerning Compensation of Employees in the Regular Government Service (Law No.95 of 1950)(with the exception of the provisions of Article 2, Article 10 paragraph 3 and Article 24)
4. The Law for Payment of the Gold District Allowance and Coal Allowance to the National Public Service Personnel (Law No.200 of 1949)(with the exception of the provisions of Article 3 paragraph 2)
5. The Government Employees'Accident Compensation Law (Law No.191 of 1951)
Supplementary Provisions:
1 This Law shall come into force as from January 1, 1952.
2 This Law shall also apply to any matter which has arisen before the enforcement of this Law. However, it shall not preclude the effect produced under the provisions of the Laws mentioned in the main provisions of this Law.
3 The disposition, procedure or other acts made in accordance with the provisions of the Laws mentioned in the main provisions of this Law before the enforcement of this Law shall be deemed to have been made in accordance with the provisions of this Law, as to the application of this Law.
4 As to the application of the penal provisions to the acts done before the enforcement of this Law, the former rule shall still apply, even after the enforcement of this Law.
5 The Law concerning Compensation for National Public Service Personnel in the Special Government Service (Law No.252 of 1949) shall be partially amended as follows:
In Article 1 item (18), "items 8 and 12" shall be amended as "item 8" and there shall be added "and confidential secretaries to judges provided for by the Court Organization Law (Law No.59 of 1947)" next to "the National Public Service Law (Law No.120 of 1947)."
