Law for Partial Amendments to the Law concerning Compensation of Employees in the Regular Government Service
The Law concerning Compensation of Employees in the Regular Government Service (Law No.95 of 1950) shall be partially amended as follows:
Article 1 paragraph 1 shall be amended as follows:
The object of this Law is to provide for such matters as are relating to the compensation and work hours of the employees in the regular government service as defined in Article 2 of the National Public Service Law (Law No.120 of 1947)(hereinafter referred to as "employee" or "employees" ), unless otherwise provided for by law.
In Article 6 paragraph 2 item (2),"
Salary schedule for seamen (Appendix 4)
"shall be amended as"
Salary schedule for seamen (Appendix 4)
Salary schedule for enterprise agency employees (Appendix 5)
", and the following one paragraph shall be added to the same Article:
5　The salary schedule for enterprise agency employees shall be applicable to employees enumerated in the following items (except guards, office boys, janitors, employees engaged in sundry jobs and persons designated by rules of the National Personnel Authority):
(1)　Employees working at factories of the Mint Agency;
(2)　Employees working at factories of the Printing Agency;
(3)　Employees working at factories attached to Regional Forestry Offices or in Local Forestry Offices;
(4)　Employees working at alcoholic factories of Regional Bureaus of International Trade and Industry;
(5)　Employees working in Local Savings Branch Offices, Local Post Office Life Insurance Branch Offices or Post Offices;
(6)　Employees working in Construction and Installation Divisions of Local Telecommunications Bureaus or such sections of Local Telecommunications Divisions as managing the construction works, Local Telecommunications Districts, Local Telephone or Telegraph Offices and branch offices of the Supply Division of the Plant Engineering Bureau of the Ministry of Telecommunications.
In Article 8 paragraph 4, "three hundred (300) yen" shall be amended as "400 yen" , "six hundred (600) yen" as "1,000 yen" ;and in paragraph 6 of the same Article, "Appendix No.1 of the Supplementary Provisions (Table of Comparison of Previous and New Base Pays) of the Law for Partial Amendment to the Law concerning Compensation of Employees in the Regular Government Service (Law No.299 of 1950)" as "Appendix No.2 of the Supplementary Provisions of the Law for Partial Amendments to the Law concerning Compensation of Employees in the Regular Government Service (Law No.278 of 1951)" .
In Article 12 paragraph 3, "provided for by law separately" shall be amended as "as mentioned in Appendix No.6" and the following one paragraph shall be added next to the same paragraph:
4　As to the classification of areas under each item of paragraph 2 which serves as a basis of computing area allowance of employees working at offices located in specially designated areas, in case it has been deemed highly inappropriate to apply the provision of the preceding paragraph, judging from the circumstances pertaining to commodities which constitute an important element of the living cost in the area adjacent to the said areas, the location of the offices concerned, etc., exceptions may be established by rules of the National Personnel Authority within the limit of budgetary appropriations, regardless of the provision of the preceding paragraph.
In Article 22 paragraph 1, "1,850 yen" shall be amended as "2,200 yen" .
Article 23 shall be amended as follows:
(Compensation of Employees in Temporary Retirement)
Article 23.　In case an employee has been injured or has contracted a disease in performance of duty and has been temporarily retired against his will falling under the cases mentioned is Article 79 item (1) of the National Public Service Law, he shall be paid the total amount of his compensation for the term of his temporary retirement.
2　In case an employee has contracted a tuberculous disease and has been temporarily retired against his will falling under the cases mentioned in Article 79 item (1) of the National Public Service Law, he may be paid 80 per cent of each of his base pays, family allowance and area allowance until the term of his temporary retirement reaches full two years.
3　In case an employee has sustained mental or physical defects other than those stated in the preceding two paragraphs and has been temporarily retired against his will falling under the cases mentioned in Article 79 item (1) of the National Public Service Law, he may be paid 80 per cent of each of his base pay, family allowance and area allowance until the term of his temporary retirement reaches full one year.
4　In case an employee has been temporarily retired against his will falling under the cases mentioned in Article 79 item (2) of the National Public Service Law, he may be paid 60 per cent or less of each of his base pay, family allowance and area allowance for the term of his temporary retirement.
5　In case an employee has been temporarily retired against his will falling under one of the cases specified by rules of the National Personnel Authority based on Article 79 of the National Public Service Law, he may be paid 70 per cent or less of each of his base pay, family allowance and area allowance for the term of his temporary retirement.
The following one paragraph shall be added to the Supplementary Provisions:
6　With respect to the application of Article 80 paragraph 4 of the National Public Service Law, this Law shall be regarded as the pay regulations prescribed in the said paragraph.
Appendixes No.1 to No.4 inclusive shall be amended as follows:

Remark:　The names of areas, etc. shown in this table shall be the names as of April 1, 1951, unless otherwise prescribed in this table;and the areas specified in this table shall be the areas of the territory bearing any of these names and indicated by use of the areas or location as of the same date, and shall not be affected by any subsequent change in such names or in the areas or location of the territory bearing any of such names.
Supplementary Provisions:
1　This Law shall come into force as from the day of its promulgation and all provisions other than the amended provisions of Article 23 and the Supplementary Provisions shall be applicable as from October 1, 1951.
2　The grade of position of an employee as of October 1, 1951 (hereinafter referred to as "the conversion day" ) shall be the grade of position to which he belonged as of the conversion day under the application of the Law concerning Compensation of Employees in the Regular Goverhment Service before amendments (hereinafter referred to as "the Law before amendments" )(in regard to an employee who began to enjoy the application of the salary schedule for enterprise agency employees on the conversion day, the grade of position which is listed in the salary schedule for enterprise agency employees of Appendix No.1 of the Supplementary Provisions of this Law and which corresponds to the grade of position listed in each salary schedule of Appendixes No.1 to No.4 inclusive of the Law before amendments to which he belonged as of the conversion day under the application of the Law before amendments), and the step of his base pay as of the conversion day shall be the step which is listed in each salary schedule (meaning the respective salary schedules of Appendixes No.1 to No.5 inclusive of the Law concerning Compensation of Employees in the Regular Government Service after amendments (hereinafter referred to as "the Law after amendments" ) the application of which he began to enjoy on the conversion day in connection with the enforcement of this Law) corresponding to the new monthly amount of base pay given in Appendix No.2 of the Supplementary Provisions of this Law and which corresponds to the monthly amount of his base pay receivable as of the conversion day under the application of the Law before amendments.
3　The grade of position of an employee as of a day during the period from October 2, 1951 to the date of the enforcement of this Law (in case he has come to enjoy application of the salary schedule for enterprise agency employees on any of the days during the said period in connection with the enforcement of this Law, the grade of his position as of the day during the said period on which he enjoys application of the said salary schedule is excepted) shall be the grade of position to which he belonged as of the day during the said period under the application of the Law before amendments.
4　In case an employee has come to enjoy application of the salary schedule for enterprise agency employees on any of the days during the period provided for in the preceding paragraph in connection with the enforcement of this Law, the grade of position as of the day on which he enjoys application of the said salary schedule during the said period shall be the grade of position which is listed in the salary schedule for enterprise agency employees in Appendix No.1 of the Supplementary Provisions of this Law and which corresponds to the grade of his position listed in each salary schedule of Appendixes No.1 to No.4 inclusive of the Law before amendments to which he belonged on the day during the said period under application of the Law before amendments.
5　The step of base pay of an employee as of a day during the period provided for in paragraph 3 of the Supplementary Provisions shall be the step which is listed in each salary schedule (meaning each salary schedule listed in Appendixes No.1 to No.5 inclusive of the Law after amendments application of which he comes to enjoy on a day during the said period in connection with the enforcement of this Law) corresponding to the new monthly amount of base pay given in Appendix No.2 of the Supplementary Provisions of this Law and which corresponds to the monthly amount of his base pay received as of the day during the said period under application of the Law before amendments.
6　In case the new monthly amount of base pay of an employee obtained in accordance with the provision of paragraph 2 or the preceding paragraph of the Supplementary Provisions has not been within the range of base pay in the grade of position to which he belongs, the amount shall be made the monthly amount of base pay of the employee.
7　Any decisions relating to base pay of employees that are rendered under the provisions of the Law before amendments during the period from the conversion day to the date of the enforcement of this Law shall be considered as being rendered under the corresponding provisions of the Law after amendments.
8　With respect to the application of the provisions of paragraphs 2 to 5 inclusive of the Supplementary Provisions, the grade of position and the step and the monthly amount of base pay which an employee belonged to or received under application of the Law before amendments must be such ones as are determined in accordance with the Law before amendments and rules of the National Personnel Authority and other regulations based thereon.
9　Compensations for the period provided for in paragraph 7 of the Supplementary Provisions which were already paid to employees prior to the enforcement of this Law in accordance with the provisions of the Law before amendments and paragraph 10 of the Supplementary Provisions of the Law for Partial Amendment to the Law concerning Compensation of Employees in the Regular Government Service (Law No.299 of 1950) before amendments by this Law shall be considered as part payment of compensations to be paid under the provisions of the Law after amendments.
10　The provisions of Article 23 of the Law after amendments shall be applicable to the compensation for the term of temporary retirement after the enforcement of this Law of the employee being temporarily retired against his will at the time of the enforcement of this Law, depending upon the cause of his temporary retirement. In this case, "the term of his temporary retirement" in paragraphs 2 and 3 of the same Article shall read "the term of his temporary retirement after the enforcement of the Law for Partial Amendments to the Law concerning Compensation of Employees in the Regular Government Service (Law No.278 of 1951)."
11　The Law for Partial Amendment to the Law concerning Compensation of Employees in the Regular Government Service (Law No.299 of 1950) shall be partially amended as follows:
Paragraph 10 of the Supplementary Provisions shall be deleted, paragraph 11 of the Supplementary Provisions shall be made paragraph 10 of the Supplementary Provisions, paragraph 12 of the Supplementary Provisions shall be deleted and paragraph 13 of the Supplementary Provisions shall be made paragraph 11 of the Supplementary Provisions.
