Law for Partial Amendments to Court Organization Law, etc.
Article 1. The Court Organization Law (Law No.59 of 1947) shall be partially amended as follows:
Article 31-(3) paragraph 2, Article 53 paragraph 2, Article 54 paragraph 2, Article 55 paragraph 2 and Article 56-(2) paragraph 2 shall be deleted.
In Article 56-(3) paragraph 1, "first class" shall be deleted.
Article 56-(5) paragraph 2, Article 57 paragraphs 2 and 4, Article 58 paragraphs 2 and 4, Article 60 paragraph 2, Article 60-(2) paragraph 2 and Article 61 paragraph 2 shall be deleted.
Article 61-(2) shall be made Article 61-(4), paragraph 2 of the same Article shall be deleted, Article 61-(3) shall be made Article 61-(5), paragraph 2 of the same Article shall be deleted, and the following two Articles shall be added next to Article 61:
Article 61-(2).(Domestic Matters Investigators) In each Family Court there shall be established Domestic Matters Investigators whose number shall be fixed by law separately.
Domestic Matters Investigators shall conduct the necessary research for the judgment and conciliation mentioned in Article 31-(3) paragraph 1 item (1).
Domestic Matters Investigators shall, in exercising their duties, obey the order of judges.
Article 61-(3).(Assistant Domestic Matters Investigators) In each Family Court there shall be established Assistant Domestic Matters Investigators whose number shall be fixed by law separately.
Assistant Domestic Matters Investigators shall, under the order of their superiors, help Domestic Matters Investigators in performing the affairs.
The latter part of Article 63 paragraph 1 shall be deleted.
The heading of Article 64 shall be amended as "(Appointment and Dismissal)" and in the same Article, "The appointment, dismissal and promotion," shall be amended as "The appointment and dismissal."
In Article 65, "Domestic Matters Investigators, Assistant Domestic Matters Investigators," shall be added after "Assistant Court Clerks."
The following one Article shall be added next to Article 65:
Article 65-(2).(Matters as to Court Officials other than Judges) Matters as to court officials other than judges shall be provided for by law separately except those provided for by this Law.
Article 2. The Law for Inquest of Prosecution (Law No.147 of 1948) shall be partially amended as follows:
In Article 6 item 6, "Domestic Matters Investigators, Assistant Domestic Matters Investigators" shall be added after "Assistant Court Clerks."
In Article 20 paragraph 2, "second or third" shall be deleted.
Article 3. The National Public Service Law (Law No.120 of 1947) shall be partially amended as follows:
Article 2 item (12) shall be amended as follows:
12. Judges and other Court officials.
Article 4. The Juvenile Law (Law No.168 of 1948) shall be partially amended as follows:
Article 39 shall be amended as follows:
Article 39. Deleted.
Supplementary Provisions:
1 In this Law, the amended provisions of Article 65-(2) of the Court Organization Law and of Article 2 of the National Public Service Law shall come into force as from January 1, 1952, and the other provisions as from April 1, 1951.
2 With respect to the case in which public actions were instituted in Family Courts before the enforcement of the provisions amending Article 31-(3) paragraph 2 of the Court Organization Law, the former provisions shall still prevail notwithstanding the provisions of the same paragraph.
3 Each Family Court may, for the time being, cause Assistant Domestic Matters Investigators to act for Assistant Domestic Matters Investigators in accordance with the rules provided for by the Supreme Court.
