Article 1. The personnel who were assigned by the Minister of Transportation on the basis of the recommendation of President of the Japanese National Railways in compliance with the decision of the Minister of Transportation after the consultation with the Attorney-General from within the officers or employees of the Japanese National Railways who are in charge of maintaining security on the properties of the Japanese National Railways shall be so called the Railway Security Agent and shall perform the function of investigation on the crimes or troubles against the Transport business and offences committed in the trains, stations, yards and other railway properties directly necessary for transportation of the Japanese National Railways.
Article 2. The scope of investigation of the preceding Article shall be limited in the Trains, Stations, Yards and other Railway properties directly necessary for Transportation of the Japanese National Railways only.
Article 3. With regard to the criminal investigation by the Railway Security Agent, other than those provided for in this Law, the provisions concerning the criminal-investigation by the judicial Police Officials provided for in the Code of Criminal Procedure (Law No.131, 1943) shall apply mutatis mutandis. However, in case of arrest of the flagrant offender or suspect shall be turned over to the public prosecutor or Civil Police Officials.
Article 4. The Railway Security Agent shall not exercise the function beyond the jurisdiction of the office to which he belongs on the criminal-investigation. However, it shall not be limited in case of riding trains in transit for guard and other necessary cases in accordance with the provision of the Cabinet Order.
(協力)
第五條 鉄道公安職員と警察職員とは、その職務に関し、互に協力しなければならない。
Article 5. The Railway Security Agent and Police Official shall co-operate with each other concerning the duties.
(監督)
第六條 鉄道公安職員の捜査に関する職務は、運輸大臣が監督する。
Article 6. The function of criminal-investigation performing by the Railway Security Agent shall be supervised by the Minister of Transportation.
(武器の携帶)
第七條 鉄道公安職員は、その職務を行うため、小型武器を携帶することができる。
Article 7. The Railway Security Agent may carry, a small-sized weapon.
Article 8. The Railway Security Agent may, in performing his designated duties, employ the weapon in cases where there is sufficient reason to deem it inevitable for the protection of his or other people's life or person especially, to such an extent as is reasonably judged necessary to cope with the situation.
附 則
Supplementary Provision:
この法律は、公布の日から施行する。
This Law shall come into force as from the day of its promulgation.
