Law for Partial Amendment to Ministry of Labor Establishment Law and Others
Article 1. The Ministry of Labor Establishment Law (Law No.162 of 1949) shall be partially amended as follows:
Article 4 item (40) shall be amended as follows:
(40) To give approval to the application for the inclusion to, or severance from the Unemployment Insurance when such application has been made by the employer of a plant of voluntary coverage of the said Insurance or by the day laborer of voluntary coverage of the said Insurance.
In Article 8 item (10), "the Industrial Safety Institute" shall be amended as "the Industrial Safety Institute and the Training Institute of the Labor Standards Inspector" .
In Article 10 item (7), "(Law No.146 of 1947)" shall be deleted. This item shall be item (8) and the following one item shall be added next to item (6).
(7) Payment of separation allowance in accordance with the conditions provided for in the Unemployment Insurance Law (Law. No.146 of 1947) to national public employees and other personnel whose compensation is paid by the expenditure budget approved by the Diet.
In Article 11, "Industrial Safety Institute" shall be amended as
"Industrial Safety Institute.
Training Institute of the Labor Standards Inspector
".
The following one Article shall be added next to Article 12.
(Training Institute of the Labor Standards Inspector)
Article 12-(2). The Training Institute of the Labor Standards Inspector shall be the organ which shall give necessary training to the labor standards inspectors for performing their duties.
2 The Training Institute of the Labor Standards Inspector shall be established in Tokyo-To.
3 The internal organization of the Training Institute of the Labor Standards Inspector shall be provided for by Ministry of Labor Ordinance.
In the Table of Article 13 paragraph 1, items of "The Mariners Labor Coordination Conference, the Safety Apparatus Efficiency Test Council, The Labor-market-area Employment Security Council, The Employment Service Coordination Conference and The Labor Statistics and Research Council" shall be deleted, item of the Central Specific Technicians Qualification Examination Council shall be amended as,
"Specific Technicians Qualification Examination Council. |
To make research and deliberation on the standards of the specific technicians qualification examination." |
in item of the Central Employment Security Council, "concerning the functions of public employment security offices" shall be amended as "after consultation with the Minister of Labor concerning the functions of public employment security offices" , and the following one item shall be added next to the said item,
Prefectural Employment Security Council. |
To make research and deliberation after consultation with the To, Do, Fu or prefectural governor concerning the functions of the public employment security offices and other important matters of the enforcement of the Employment Security Law. |
In the Table of Article 16 paragraph 1, items of the Prefectural Specific Technicians Qualification Text Council and the Health Supervisor Examination Council shall be deleted.
In Article 18 paragraph 2 shall be paragraph 3, paragraph 3 shall be paragraph 4 and the following one paragraph shall be added next to paragraph 1:
2 The Public Employment Security Office, besides the business provided for in the preceding paragraph, shall take charge of the business concerning the payment of separation allowance in accordance with the conditions provided for in the Unemployment Insurance Law to national public employees and other personnel whose compensation is paid by the expenditure budget approved by the Diet.
Article 19 shall be amended as follows:
Article 2. The Employment Security Law, (Law No.141 of 1947) shall be partially amended as follows:
In Article 12 paragraph 1, "the national, prefectural, and Labor-market-area Employment Security Council" shall be amended as "the national and prefectural Employment Security Council" , in paragraph 2 of the said Article, "basing upon the application of the prefectural governor" shall be deleted and "Council which have as their jurisdictional area a part of prefectural jurisdiction" shall be amended as "Councils which have as their jurisdictional area a part of To, Do, Fu or prefecture or parts of two or more prefectures" in paragraph 3 of the said Article "the Labor-market-area Employment Security Council shall consult with the Labor Minister or the competent prefectural governor" , shall be deleted, in paragraph 4 "the Labor-market-area Employment Security Council and Additional Employmet Security Council" shall be amended as "Additional Employment Security Council" , and in paragraphs 7 and 8 of the said Article "prefectural, labor-market-area, and additional council" shall be amended as "prefectural and additional councils" .
Supplementary Provision:
This Law shall come into force as from the day of its promulgation.
