I hereby promulgate the Law concerning Measures to be Taken in Regard to the Status of Secretaries, etc. of Ministry of Education in Public Universities.

Law concerning Measures to be Taken in Regard to the Status of Secretaries, etc. of Ministry of Education in Public Universities
1. Those who are secretaries of Ministry of Education or technical officials of Ministry of Education in public universities ((including the public universities, the preparatory course of public universities, the public higher schools and the public colleges under the former provisions mentioned in Article 98 of the School Education Law (Law No.26 of 1947);hereinafter the same)) at the time of the enforcement of this Law shall, unless a with of appointment is issued separately, be regarded as having been appointed as personnel of the local public bodies that establish the public universities concerned.
2 In cases where there are, among the personnel under the preceding paragraph, persons who are under temporary retirement, suspension from duty or pay-reduction, such dispositions shall be regarded as having been made by the heads of the local public bodies under the same paragraph.
3 In cases where the personnel under paragraph 1 have consecutively become secretarial or technical personnel of public schools (including the public schools under the former provisions mentioned in Article 98 of the School Education Law;hereinafter the same)((including the cases where the said personnel continue to be in office as those who are regarded as the educational personnel or assistant educational personnel under the provisions of Article 22 of the Pension Law (Law No.48 of 1923) and have consecutively become secretarial or technical personnel of public schools)), they shall be regarded as continuing to be in office as educational personnel under the provision of paragraph 1 in the same Article, and the provisions of the same Law shall apply mutatis mutandis to them for the time being.
Supplementary Provisions:
1. This Law shall come into force as from the day of its promulgation.
2. The Regulations governing Temporary Establishment of Public School Staff and Others (Cabinet Order No.316 of 1948) shall be abolished.
