Law concerning Exception to the Lawsuit for Recognition
1. With reference to the person who died on the battle field or in an area that may be regarded as such in the last war, or who died abroad while yet undemobilized or otherwise under the same circumstances as that, or who was, in the country, killed by air-raids or other disasters caused by the war, his child, his direct lineal descendant or their legal representative may bring a lawsuit for recognition, notwithstanding the provisions in the proviso to Art.787 of the Civil Code (Law No.222 of 1947), within three years from the date when they have become aware of the death thereof;provided, however, that they may not bring a lawsuit after the end of the period of ten years from the date of death.
2. If the day when the death was known is prior to the enforcement of this Law, the period of three years prescribed in the preceding paragraph shall be counted as from the date of its enforcement.
Supplementary Provision:
This Law shall come into force as from the day of its promulgation.
