審議経過

朕は、昭和二十年勅令第五百四十二号ポツダム宣言の受諾に伴い発する命令に関する件に基く市町村長の立候補禁止等に関する勅令を裁可し、ここにこれを公布せしめる。
I hereby give My Sanction to the Imperial Ordinance concerning the Exclusion from the Candidature for Mayor of City, Headman of Town or Village and Others, under the Imperial Ordinance No. 452 of 1946 relating to the Orders to be issued in consequence of the acceptance of the Potsdam Declaration, and cause the same to be promulgated.

勅令第三号
Imperial Ordinance No. 3
昭和二十二年勅令第一号（公職に関する就職禁止、退職等に関する勅令）第三條第二項の覚書該当者を除く外、昭和二十年九月一日以前から昭和二十一年九月一日まで引き続き市長又は市助役の職に在つた者は、昭和二十一年法律第二十八号による市制の改正規定により初めて行われる市長の選挙において、又はその選挙の日から四年間、市長候補者となり又は市助役となることができない。
Persons who have held position of mayor or deputy-mayor consecutively from the day of or prior to September 1, 1945 till September 1, 1946 shall be barred, even though they do not fall under the provisions of the Memorandum as prescribed in Article III of the Imperial Ordinance No. 1 of 1947, from being candidate for mayorship and also from being appointed to deputy-mayor, at the first election to be held in pursuance of the provisions of the Law No. 28 of 1946 (Law to amend a part of the Law for the Organization of Cities) and furthermore during four years beginning with the day of the said election.
前項の市長又は市助役の職に在つた者で、同項の選挙による市長の就職の際現に市助役の職に在る者は、その日において、その職を失う。
Persons who have held position of mayor or deputy-mayor prescribed in the preceding paragraph who held the office of deputy mayor at the day of assumption of office by new mayors elected by the election mentioned in the preceding paragraph shall be removed from their offices on that day.
前二項の規定は、東京都の区の区長、町長及び町助役、村長及び村助役並びにこれらに準ずる者について、これを準用する。
Provisions of the preceding two paragraphs shall be applied correspondingly to ward headmen of wards in Tokyo Metropolis, headmen or deputy-headmen of towns or of villages and those corresponding to the above.
附　則
Supplementary Provision:
この勅令は、公布の日から、これを施行する。
The present Imperial Ordinance shall come into force as from the day of its promulgation.
