MEMORANDUM FOR

JAPANESE GOVERNMENT.

SUBJECT

Regulations Affecting Restricted Concerns.

1. Rescissions:
a. The following memoranda for the Japanese Government from General Headquarters, Supreme Commander for the Allied Powers, are hereby rescinded;
(1) AG 300.8 (8 Dec 45) ESS/AC, SCAPIN 408, 8 December 1945, subject: Regulations Affecting Restricted Concerns.
(2) AG 095 (20 May 47) ESS/AC, SCAPIN 1690, 20 May 1947, subject: Amendments to Regulations Affecting Restricted Concerns.
(3) AG 095 (5 Dec 47) ESS/AC, SCAPIN 1829, 5 December 1947, subject: Donations by Restricted Concerns to Community Chest Fund.
(4) AG 300.8 (22 May 48) ESS/AC, SCAPIN 408/1, 22 May 1948, subject: Supplement to SCAPIN 408: Regulations Affecting Restricted Concerns; Provision for Specific Criminal Penalties.
(5) AG 004 (8 Dec 45) ESS/AC, SCAPIN 408/2, 6 November 1948, subject: Regulations Affecting Restricted Concerns.
b. The rescission of the above memoranda shall not in any way affect any actions taken pursuant thereto, nor shall it have any retroactive effect whatsoever; and all references to such memoranda in other directives to the Japanese Government shall, from the date hereof, be construed to refer to this memorandum.
2. Reference the following memoranda for the Japanese Government from General Headquarters, Supreme Commander for the Allied Powers:
a. AG 091.3 (20 Oct 45) ESS, SCAPIN 162, 20 October 1945, subject: Dissolution or Liquidation of Major Financial or Industrial Enterprises.
b. AG 004 (8 Dec 45) ESS/AC, SCAPIN 403, 8 December 1945, subject: Establishment of a Schedule of Restricted Concerns; as supplemented and amended.
3. It is directed that the Japanese Government:
a. Continue in effect the provisions of Imperial Ordinance No. 657 of 1945: Restrictions for the Dissolution of Companies, Based upon Imperial Ordinance No.542 of 1945 on Ordinances or Orders to be Issued as the Result of Acceptance of the Potsdam Declaration, in the amended form in which such ordinance exists as of the date hereof, a copy of which is attached hereto.
b. Repeal Law No. 3 of 1944: Law Concerning Temporary Measures of Companies.

2. Reference memoranda la, b, c, d and e regulate the activities of Restricted Concerns established by reference memorandum If. The purpose of the subject SCAPIN is to rescind the five SCAPINs first referred to, and to combine and collate those portions thereof which are still operative into a single SCAPIN. This will result in simplification and clarification of SCAP direction to the Japanese Government without effecting any substantive change.
3. This is an administrative matter and no surveillance by the Eighth Army is required.
