| SUBJECT | Disposition of Properties Belonging to Dissolved Organizations. |
1. Reference is made to the following:
a. Memorandum for the Japanese Government, file AG 386.7 (1 Mar 48) CPC/CD, SCAPIN 1868, 1 March 1948, subject, “Disposition of Properties Belonging to Dissolved Organizations”, as amended by memorandum for the Japanese Government, file AG 386.7 (1 Mar 48) CPC/PLD, SCAPIN 1868/1, 30 December 1948, same subject, from General Headquarters, Supreme Commander for the Allied Powers.
b. Memorandum for Attorney-General’s Office, Japanese Government, file 386.7 (1 Mar 48) CPC/PLD, 30 December 1948, subject, "Implementation of Sales Program as directed in SCAPIN 1868 and SCAPIN 1868/1,” as amended by memorandum for Attorney-General’s Office, file 386.7 (31 Mar 49) CPC/PLD, 31 March 1949, same subject, from General Headquarters, Supreme Commander for the Allied Powers, Civil Property Custodian.
2. Reference 1a above is amended as follows:
a. Paragraph 7d is rescinded and the following substituted therefor: “d. All applications for the purchase of movable properties and all sealed bids for the purchase of real properties, with the exception of such real properties as are appraised for sale in excess of ¥1,500,000.00, will be approved or disapproved by the sales agency designated by the Japanese Government. All sales for real and movable properties will be accomplished on the basis of total cash payment or satisfactory installment payments not to exceed a period of four years.”
b. Paragraph 8 is rescinded and the following substituted therefor: “8. All claims against dissolved organizations presented for payment will be approved or disapproved by the Japanese Government.”
c. Paragraph 11 is rescinded and the following substituted therefor: “11. The Japanese Government is directed to submit monthly reports commencing within (60) days from the date of this memorandum to General Headquarters, Supreme Commander for the Allied Powers, Civil Property Custodian. These reports will be as of the close of business on the 20th day of each month and will be submitted not later than the 25th day of each month. These reports will include:
(1) Type of property recovered, location, value, and from whom recovered.
(2) Description of property sold, name and address of purchaser, and the price received.
(3) Description and amount of claim approved for payment, dissolved organization concerned, and name and address of claimant.
(4) Statement of condition of the Foreign Trade Special Yen Fund in the Bank of Japan, showing in detail all income and expenditures.”
3. The Japanese Government is directed to discontinue, effective 1 August 1949, the submitting of the forms required under reference 1b above.
4. The Japanese Government is further directed to take the necessary section, commensurate with these amendments, to curtail expenditures of funds heretofore required in the administration of the programs as directed under references 1a and 1b above.
5. A report covering the implementation of the instructions contained in paragraph 4 above will be forwarded to General Headquarters, Supreme Commander for the Allied Powers, Civil Property Custodian within thirty (30) days from date of this memorandum.
