Subject

Addition of Toyo High Pressure Company, Ltd., (Toyo Koatsu K. K.), to the Schedule of Restricted Concerns.

2. The Toyo High Pressure Company, Ltd., is hereby added to the Schedule of Restricted Concerns referred to in subparagraph 1c, above.
3. The Imperial Japanese Government will take immediate action to assure that the Toyo High Pressure Company, Ltd., shall comply with the provisions of and make reports required by reference Memoranda listed in paraph 1, above. Wherever reference is made in inclosure 1 and inclosure 2 to reference Memorandum 1a, above, to the year 1944, it shall be amended to read 1946.
4. Direct communications is authorized between the interested Staff Sections of General Headquarters, Supreme Commander for the Allied Powers, and agencies of the Imperial Japanese Government concerned to implement all provisions of this Memorandum.

1. Pursuant to the policy set forth in Joint Chiefs of Staff Directive 1380/15, 3 November 1945, investigations are being made of concerns which are not listed on the inclosure to SCAP Memorandum AG 004 (8 Dec 45) ESS/AC, 8 December 1945 (SCAPIN-403), subject: "Establishment of a Schedule of Restricted Concerns," or subsequent additions thereto.
2. The Toyo High Pressure Company, Ltd. (Toyo Koatsu K. K.), with a capital of ¥48,250,000., is a producer of nitrogenous fertilizer, Mitsui Chemical Industry Company, Ltd., owns 34.6% of the shares. Toyo High Pressure Company, Ltd., is one of the three (3) largest producers of fertilizer in Japan and is now engaged in large scale repairs. After these repairs, the yearly production of the three (3) largest producers will be as follows:

Toyo High Pressure Company, Ltd. 300,000 tons
Nissin (Sumitomo) Chemical Company, Ltd. 250,000 tons
Both Showa Electric Industry Company, Ltd., and Nissin Chemical Company, Ltd., are Restricted Concerns. Although Toyo High Pressure Company plans to produce only fifteen (15) percent of the total production of Japan, because of the stock-ownership of Mitsui Chemical Company, Ltd., as well as the fact that of the big three (3) fertilizer producers only this Company is not at present restricted, it is placed on the Schedule of Restricted Concerns.
3. The interests of USAFIK are not concerned.
4. This is an administrative matter and no surveillance by the Eighth Army is required.
