Export Procedure. |
1. Reference is made to Memorandum for the Imperial Japanese Government from General Headquarters, Supreme Commander for the Allied Powers, AG 091. 31 (14 Mar 46) ESS/IE, (SCAPIN 814), 14 March 1946, subject: “Export Procedure.” Attachment 1 to the reference memorandum is superseded by Attachment 1 (Revised), Export Procedure. This revision clarifies the export procedure originally outlined in Attachment 1 of the memorandum of 14 March 1946 and makes the following substantive changes in case of shipment to countries other than the United States:
a. Documents will be delivered to the Military Port Director rather than to the War Shipping Administration, and certification will be made.
b. Form IE - 200, “Application to Deliver for Export,” will be countersigned by Civilian Merchant Marine Committee when shipment is made in a vessel of Japanese registry.
2. Documents pertaining to all exports since 2 September 1945 will be submitted on or before 1 August 1946 to General Headquarters, Supreme Commander for the Allied Powers.
3. Attachment 7 to the reference memorandum is superseded by Attachment 7 (Revised) - Invoice of Consigned Merchandise.
4. Attachment 9 (Cargo Receipt) is added to the reference memorandum.

1. Submits Form IE-100 in six (6) copies to GHQ, .SCAP. (See attachment 2 - Specimen Form IE-100 and Attachment 3 - Instructions for Submitting Specimen Form IE-100)

2. Processes Form IE-100 within GHQ, SCAP.
a. Approves Form IE-100. Validates and returns two (2) validated copies to BT, or
b. Denies Form IE-100. Notifies BT by memorandum.

3. a. Upon receipt of approved Form IE-100 submits one or more applications on Form IE-200 in eight (8) copies to GHQ, SCAP, as soon as practicable, or
b. Upon receipt of a SCAP directive or instructions to prepare material for export submits Form IE-200 in eight (8) copies to GHQ, SCAP as soon as the material is ready for export.
NOTE : Any number of Forms IE-200 may be submitted within the limits of any one approved Form IE-100. Each Form IE-200 will cover material to be shipped as a single shipment.

4. Processes Form IE-200 within GHQ, SCAP.
a. Approves Form IE-200 - Validates, including information as to country of destination, delivery of material, transfer of title and time and place of shipment. Returns four (4) copies to BT, or
b. Denies Form IE-200. Notifies BT by memorandum.
5. Shipments to the United States.
BT
a. Upon receipt of the four (4) copies of the validated Form IE-200, submits advance draft of the invoice to GHQ, SCAP, and delivers to the Agent of the Carrier the following:
(1) The shipment.
(2) One (1) copy of the Cargo Shipping Order. (See Attachment 6 - Specimen Cargo Shipping Order).

b. Receives shipment and delivers the following to BT.
(1) Three (3) signed copies of On-Board Ocean Bill of Lading.
(2) Three (3) non-negotiable copies of On-Board Ocean Bill of Lading.

c. Delivers four (4) copies of the validated Form IE-200 to WSA at Port of Shipment.

d. Certifies all copies and returns three (3) copies of Form IE-200 to BT.

e. Delivers to the Ship’s Master an envelope addressed to the U. S. Commercial Company or its designee at the U. S. Port of Entry. Envelope will contain the following documents.
(1) One (1) signed copy of On-Board Ocean Bill of Lading. .
(2) One (1) copy of Invoice of Consigned Merchandise. (See Attachment 7 (Revised)), leaving the space for SCAP use blank.
(3) One (1) copy of Packing List, Weight Measurement List, Food Declarations, Test Certificates, Health Certificates and Inspection Sheets as required.

f. Gives receipt for documents listed above to BT.
g. Returns immediately to Eighth Army for transmittal to GHQ, SCAP, the following documents.
(1) One (1) copy of Form IE-200 certified by the WSA.
(2) Five (5) copies of Bill of Sale and Transfer of Title, Invoice of Consigned Merchandise, Packing List, Weight List, Food Declarations, Test Certificates, Health Certificates, and Inspection sheets as required.
(3) Two (2) signed copies and three (3) unsigned copies of the On-Board Ocean Bill of Lading as received from AC in 5 b, above.
(4) The receipt for documents delivered to the SM.

h. (1) Gives receipt for documents listed above to BT.
(2) Transmits documents to GHQ, SCAP.
6. Shipments to Countries other than the United States.

a. Same procedure as in paragraph 5 a, above.

b. Same procedure as in paragraph 5 b, above.

c. Delivers four (4) copies of validated Form IE-200 to MPD at Port of Shipment.

d. Certifies in block indicated for WSA and returns three (3) copies of Form IE-200 to BT.
e. When vessel is of Japanese registry, has three (3) certified copies of Form IE-200 countersigned by an official of the Civilian Merchant Marine Committee.

f. Delivers to the Ship’s Master, two (2) copies of Cargo Receipt Form (attachment 9) and an envelope addressed to the Government Agency at the Port of Discharge. Envelope will contain the documents listed in paragraph 5 e, above.

g. Gives receipt for documents listed above to BT.
h. When shipments to countries other than the U.S. are made in vessels of Japanese registry, obtain signatures of an official of the government agency at port of discharge, two (2) copies of Cargo Receipt, and deliver receipts to BT.

i. Returns to GHQ, SCAP, the following documents:
(1) One (1) copy of Form IE-200 certified by MPD. (Also counter-signed by CMMC when vessels are of Japanese registry.)
(2) Four (4) copies of Invoice of Consigned Merchandise, Packing List, Weight Measurement List, Food Declarations, Test Certificates, Health Certificates, and Inspection sheets as required.
(3) Two (2) signed and two (2) non-negotiable copies of the On-Board Ocean Bill of Lading.
(4) The receipt for documents delivered to the Ship's Master.
(5) Two (2) copies of Cargo Receipt as soon as returned by SM.

j. Gives receipt for documents listed above to BT.
7. Invoice of Consigned Merchandise.
a. It will be noted that a section of the Invoice of Consigned Merchandise is headed "For Official SCAP use only. " This section is not to be filled in by Board of Trade (Boeki Cho), except as indicated in paragraph b, below.
b. In addition to the Invoices of Consigned Merchandise required by Paragraphs 5 and 6 above, Board of Trade will submit one (1) additional copy to GHQ, SCAP, with yen costs of goods to BT, and freight charges, marine insurance charges and miscellaneous charges paid by BT shown under the section headed "For Official SCAP use only. "

1. Boeki Cho, the Japanese Board of Trade, is having difficulty in delivering the records Operations Branch requires, at the proper time, and in the proper form. The problem may be that the present procedure is difficult to understand because of its narrative style.
2. At this time there is a need for the following changes:
a. Clarification of Attachment 1 to SCAPIN 814. (Attached, Exhibit A)
b. Procedure for Shipments to countries other than the United States.
c. A directive requiring Boeki Cho to furnish records of shipment to countries other than the U.S., retroactive to 2 September 1945.
d. A revised invoice of consigned merchandise.
3. a. In order to clarify Attachment 1, it is recommended that it be revised and published in a functional outline form and that sub-paragraph b above be included in the revised procedure. (Draft attached as Inclosure 1 to drafted Memo to IJG.)
b. It is recommended that sub-paragraph c above be included in Memo to Imperial Japanese Government.
c. It is recommended that present invoice of consigned merchandise be revised. (Draft attached as Inclosure 2 to drafted Memo to IJG)
d. It is recommended that cargo receipt be added as Attachment 9. (Draft attached as Inclosure 3 to drafted Memo to IJG)
4. This problem as it relates to Korea has been considered.
