SUBJECT | Addition of Furukawa Mining Company, Ltd., Subsidiaries to Schedule of Restricted Concerns |
1. Reference is made to the following Memoranda:
a. AG 319.1 (22 Oct 45) ESS/IE (SCAPIN - 177), subject: "Reports to be Made by Certain Business Firms."
b. AG 004 (31 Oct 45) ESS (SCAPIN - 215), subject: "Sale or Transfer of Securities of Certain Business Firms."
c. AG 004 (8 Dec 45) ESS/AC (SCAPIN - 403), subject: "Establishment of a Schedule of Restricted Concerns."
d. AG 300.8 (8 Dec 45) ESS/AC (SCAPIN - 408), subject: "Regulation Affecting Restricted Concerns."
e. AG 319.1 (19 Jan 46) ESS/AC (SCAPIN – 625), subject: "Reports to be Made by Certain Business Firms."
f. AG 150 (23 Feb 46) ESS/AC (SCAPIN - 767), subject: "War Damage and Government Indemnity Claims of Companies on the Schedule of Restricted Concerns."
2. The subsidiaries of Furukawa Mining Company, Ltd., listed below are hereby added to the Schedule of Restricted Concerns referred to in Paragraph 1c, above:
Toa Chemical Co., Ltd.
Teikoku Life Insurance Co., Ltd.
3. The Imperial Japanese Government will take immediate action to assure that the concerns named in paragraph 2, above, shall comply with the provisions of and make reports required by reference Memoranda listed in paragraph 1, above. Wherever reference is made in Inclosure l and Inclosure 2 to Memorandum for the Imperial Japanese Government referred to in paragraph la, above, to the year 1944, it shall be amended to read 1945.

MEMO FOR RECORD: (SCAPIN - 862)
1. It is learned that the various Ministries of the Japanese Government as a wartime measure were empowered to take possion of all applications for patents, declare them to be secret and proceed to apply for such patents in the name of the Ministry. In some instances the application was held by the Ministry and no patent ever issued, but manufacture of the article for the use of the Army and Navy was authorized.
2. In view of the fact that these patents are to be considered as essentially of war-making nature the information required in the attached memorandum should be in the possession of this Headquarters.
3. Further, since such patent rights and applications may be an important element in the reparations program, it will be necessary to have a complete inventory and all pertinent available data of same for use by claimant nations.
4. This division has worked closely with the Reparations Commission in recommendation of the establishment of a Patent Custodian who will take into his custody and control all patent rights granted to Japanese Nationals with a view to recovering such assets as may be obtained from these sources.
5. It is our understanding that the Demobilization Ministries are to be dissolved on or about 1 March 1946, and there is danger of this data being dissipated or lost thereafter, and since the furnishing of this information will require considerable time it is believed advisable to commence compilation immediately.
6. All information requested in basic Memorandum is considered essential.
7. This is considered as an administrative matter and no surveillance is required by the army.
