MEMORANDUM FOR

IMPERIAL JAPANESE GOVERNMENT.

Subject

Transactions in Property Outside of Japan.

1. Reference is made to C. L. O. Memorandum No. 1397 (5. 1) dated 27 Dec 1945, subject: “Transactions of the properties held Abroad,” and Memorandum for the Imperial Japanese Government, file AG 130 (22 Sept 45) ESS, subject: “Control of Financial Transactions.”
2. The Imperial Japanese Government is authorized to permit the succession by inheritance to the ownership of property held abroad by persons in Japan in accordance with established succession laws of Japan. In all such cases the Ministry of Finance will require the person succeeding to the ownership to report the property as an external asset as directed by memorandum for the Imperial Japanese Government, file AG 123 (6 Oct 45) ESS, subject: “Reports of Foreign Exchange Assets and Related Matters,” unless such a report has previously been filed by a former owner of the property. In that case an amendment to the report, previously filed, will be submitted specifying the name and address of the person succeeding to the ownership of the property and the name and address of the former owner who filed the original report.
3. The Imperial Japanese Government is also authorized to permit change of the place of registration of Japanese Government bonds from places outside of Japan to places in Japan, by individuals in Japan, provided that the amount of bonds, the place of registration of which is changed, does not exceed 1,000 yen for any individual. The request to permit similar changes in place of registration of debentures of Japanese private enterprises is not approved.
4. The Imperial Japanese Government is authorized to permit payment of salaries and allowances to officials or employees of Japanese concerns who were formerly employed abroad but are now in Japan, provided that the accounts of offices or branches outside of Japan are not debited with the amount of the disbursements and provided that the assets of the concerns in Japan are in excess of total liabilities to branches and offices outside of Japan. The request to permit the repayment in Japan of money deposited by such officials or employees in Japanese offices or branches outside of Japan, is not approved.
5. The request for permission to allow the importation into Japan of deposit pass books issued by branch offices abroad of Japanese banks is denied except insofar as postal savings and Army-Navy field-postal savings pass books may be imported in accordance with Memorandum for the Imperial Japanese Government, file AG 091. 31 (26 Nov 45) ESS/FI, subject: “Postal Savings Pass Books Issued in Japan, Korea, Taiwan, Kwantung Province and North China, “and Memorandum for the Imperial Japanese Government, file AG 091. (3 Jan 46) ESS/FI, subject: “Supplemental Instructions Relating to Import and Export Controls.” This Headquarters has replied to the request to allow withdrawals from deposit pass books issued outside Japan by Memorandum for Imperial Japanese Government, file AG 091. 3 (2 Jan 46) ESS/FI, subject: “Withdrawals from Deposit Pass Books Issued Outside of Japan,” and to the request to import into Japan Japanese Government bonds, expressed in yen, by Memorandum for the Imperial Japanese Government, file AG 168 (4 Jan 46) ESS/FI, subject: “Importation of Japanese Government Bonds by Japanese Repatriates.”
