MEMORANDUM FOR

JAPANESE GOVERNMENT.

SUBJECT

Puppet Government Property in Japan.

1. The Japanese Government is informed that certain properties in Japan are or may become the subject of claims by the present governments of areas formerly under the so-called “Puppet Government Regimes” which existed during World War II. Properties over which the Civil Property Custodian has exercised supervisory control are listed in Annex “A” attached hereto and made a part hereof.
2. For the purpose of determining legal ownership of the various Puppet Government properties in Japan, the Japanese Government, at such time as is mutually agreeable, should enter into separate negotiations with the claimant governments, if and when such governments are recognized by Japan as being eligible as successor governments to the former Puppet Regimes. The Missions in Japan of the respective claimant governments will be informed by the Supreme Commander for the Allied Powers to submit their claims directly to the Japanese Government.
3. Effective 15 December 1951 the Japanese Government will assume custody, pending final determination of legal ownership, of the properties listed in the attached Annex “A” and any additional properties which may be claimed in Japan as property of former puppet governments or of former officials of puppet governments. Personal and other movable property presently located in the Office of the Civil Property Custodian and in the Warehouse at Setagaya, Tokyo will be transferred to Japanese Government custody in accordance with paragraph 4 below. Monies held in custody of the Civil Property Custodian, General Headquarters, Supreme Commander for the Allied Powers will be transferred to the custody of the Japanese Government on or before 1 February 1952 under a subsequent directive.
4. Supervisory control of Puppet Government properties will be retained by the Supreme Commander for the Allied Powers until coming into force of the Peace Treaty. The Japanese Government will report to the Civil Property Custodian, General Headquarters, Supreme Commander for the Allied Powers before 22 December 1951, the name of the agency which shall be designated to receive the funds listed in Annex A, and the name of a representative who shall sign for the personal and movable property also referred to in Annex A presently being held by the Civil Property Custodian, General Headquarters, Supreme Commander for the Allied Powers on behalf of former puppet governments or former officials of these governments. Until the coming into force of the Peace Treaty the Japanese Government will submit to the Supreme Commander for the Allied Powers a monthly report of any actions taken with respect to puppet property including copies of all agreements arrived at between the Japanese Government and the recognized successor governments in relation to such properties.
5. For the information of the Japanese Government the Supreme Commander for the Allied Powers has released to the respective governments the property listed in Annex “B”. This property was determined to have been brought into Japan by personnel connected with the puppet regimes and was not acquired in Japan.
