Removal of Certain Companies from the Schedule of Restricted Concerns

1. Reference the following memoranda for the Japanese Government from General Headquarters, Supreme Commander for the Allied Powers
a. AG 004 (8 Dec 45) ESS/AC, (SCAPIN-403), 8 December 1945, subject: Establishment of a Schedule of Restricted Concerns.
b. AG 004 (31 Oct 45) ESS/AC, (SCAPIN-215), 31 October 1945, subject: Sale or Transfer of Securities of Certain Business Firms.
c. AG 004 (10 Jan 43) ESS/AC, (SCAPIN-572), 10 January 1946, subject: Addition of Oji Paper Manufacturing Company, Ltd. and Subsidiaries on Schedule of Restricted Concerns.
d. AG 004 (8 Jun 46) ESS/AC, (SCAPIN-1004), 8 Jun 1946, subj: Addition of Certain Textile Companies to Schedule of Restricted Concerns.
2. The following companies, placed on the Schedule of Restricted Concerns by reference memoranda paragraphs 1b, c and d, above, are hereby removed from the Schedule of Restricted Concerns, reference memorandum paragraph 1a, above:

Okaya Musen K.K. Kokaseki Kogyo K.K.

1. Reference is SCAP Memorandum AG 004 (8 Dec 45) ESS/AC, (SCAPIN 403), subject: "Establishment of a Schedule of Restricted Concerns."
2. The following companies were placed on the Schedule of Restricted Concerns, reference paragraph 1, above, because they were first line subsidiaries of designated holding companies:
Shin Osaka Hotel K.K. (New Osaka Hotel)
Okaya Musen K.K. (Okaya Radio Company)
Kyoei Clay K.K.
Kokaseki Kogyo K.K. (Toyo Industry Company)
3. The following chart indicates the company, its parent company, the number of shares the parent company owned and the date was added to the Schedule of Restricted Concerns.

4. In compliance with Law No. 233 of 1946 the parent company, in all the above cases, transferred the stock it held in its subsidiaries to the Holding Company Liquidation Commission. This prevented the holding company from dissipating the assets of its subsidiaries through management of the company. Since the HCLC has now disposed of these stocks either to employees of the issuing company or to individuals having no connection with the parent concern, none of the companies own any stock in other companies, United Nations Nationals interests are not involved, and the companies are neither designated (Law 207) nor special accounting companies, there is no reason to keep them on the Schedule of Restricted Concerns.
5. This is an administrative matter and no surveillance by the Eighth Army is required.
6. The interests of USAFIK are not concerned.
