Subject | Report on United Nations Nationals’ Property Subject to Destruction, Removal or Assignment to Reparations. |
1. Reference is made to the following memoranda for the Japanese Government from General Headquarters, Supreme Commander for the Allied Powers:
a. File AG 091.112 (13 Sep 45) MG, SCAPIN 26. 13 September 1945, subject, “Protection of Allied and Axis Property.”
b. File AG 130 (22 Sep 45) ESS, SCAPIN 45, 22 September 1945, subject, “Control of Financial Transactions.”
c. File AG 600.3 (30 Nov 46) CPC/FP, SCAPIN 1370, 30 November 1946, subject, “Preservation of Property in Japan Owned by United Nations and Their Nationals.”
2. It is directed that the Japanese Government prepare and submit to General Headquarters, Supreme Commander for the Allied Powers, Civil Property Custodian, by 15 July 1947, a list of all properties which have been set aside for reduction by destruction or removal or have been designated as available for reparations in which United Nations nationals owned an interest on 7 December 1941.
3. It is further directed that the Japanese Government immediately notify General Headquarters, Supreme Commander for the Allied Powers, Civil Property Custodian of any additional properties so segregated.
4. For the purpose of this directive, the following will be regarded as United Nations property:
a. Property owned by nationals of members of the United Nations;
b. Property which has been treated as enemy property by the Japanese Government.
c. Property owned by a corporation, the stock of which is substantially owned directly or indirectly by nationals of members of the United Nations;
d. Property owned by a corporation in which a minority of the stok is owned by nationals of members of the United Nations but nationals of members of the United Nations nevertheless have controlling rights.
