Subject | Supplemental Instructions Concerning Protection and Preservation of Property |
1. Reference is made to the following memoranda for the Imperial Japanese Government from General Headquarters, Supreme Commander for the Allied Powers:
a. File AG 091.112 (13 Sep 45) MG, SCAPIN 26, 13 September 1945, subject, “Protection of Allied and Axis Property.”
b. File AG 130 (22 Sep 45) ESS, SCAPIN 45, 22 September 1945, subject, “Control of Financial Transactions.”
2. The Imperial Japanese Government is directed to take appropriate measures to prevent the forfeiture, witout the approval of General Headquarters, Supreme Commander for the Allied Powers, of property and /or property rights of United Nations nationals who, by reason of the state of war, have been, or are, unable to take judicial action or to comply with the formalities necessary to safeguard their rights.
3 It is further directed that periods of prescription or limitation of right of action or of the right to take conservatory measures with respect to relations affecting persons or property shall not be applied to the United Nations nationals mentioned above or to the property thereof.
4. A plan of action to be taken in compliance with paragraph 2 and 3 above will be submitted for approval to General Headquarters, Supreme Commander for the Allied Powers, prior to 30 June 1947.
