I hereby promulgate the Law for Partial Amendments to the Japanese National Railways Law. Signed:HIROHITO, Seal of the Emperor This third day of the twelfth month of the twenty-sixth year of Showa (December 3, 1951) Prime Minister YOSHIDA Shigeru Law No.292 Law for Partial Amendments to the Japanese National Railways Law The Japanese National Railways Law (Law No.256 of 1948) shall be partially amended as follows: Article 30 paragraph 2 shall be amended as follows: 2 The term of temporary retirement in the case of any employee's being forced to retire temporarily falling under the provision of item (1) of the preceding paragraph, shall, except in cases where he has been forced to retire temporarily falling under the provision of the same item because of his official injury or disease, be determined by the President within the limits not exceeding three (3) years, according to the extent of necessity of his rest. In case the said trouble of the said person ceases to exist during the term of temporary retirement, the President shall reinstate him without delay. The latter clause of Article 30 paragraph 4 shall be deleted, and next to the same paragraph shall be added the following five paragraphs: 5 In cases where any employee has been forced to retire temporarily falling under the provision of paragraph 1 item (1) because of his official injury or disease, he shall be granted the whole amount of his pay during the term of temporary retirement. 6 In cases where any employee has been forced to retire temporarily falling under the provision of paragraph 1 item (1) because of his tuberculous disease, other than the case as provided for in the preceding paragraph he, may be granted an amount of eighty (80) per cent of each of his base pay, family allowance and area allowance until the term of temporary retirement reaches full two (2) years. 7 In cases where any employee has been forced to retire temporarily falling under the provision of paragraph 1 item (1) because of his mental or physical trouble other than tuberculous disease, other than the case as provided for in paragraph 5, he may be granted an amount of eighty (80) per cent of each of his base pay, family allowance and area allowance until the term of temporary retirement reaches full one (1) year. 8 In cases where any employee has been forced to retire temporarily falling under the provision of paragraph 1 item (2), he may be granted an amount not exceeding sixty (60) per cent of each of his base pay, family allowance and area allowance during the term of temporary retirement. 9 Other than those as provided for in this Article, any employee who is forced to retire temporarily shall not be granted his pay.
