      <Article Num="1">
        <ArticleCaption>(Purpose and Establishment)</ArticleCaption>
        <ArticleTitle>Article 1.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>For the purpose of conducting public opinion research fairly and autonomously in order to contribute to the establishment of policy and the operation of administration, the National Public Opinion Research Institute (hereinafter to be referred to as "the Institute" ) shall be established udder this Law as an auxiliary organ of the Prime Minister's Office.</Sentence>
          </ParagraphSentence>
        </Paragraph>
      </Article>
      <Article Num="2">
        <ArticleCaption>(Functions and Powers)</ArticleCaption>
        <ArticleTitle>Article 2.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>The Institute shall be an autonomous organ independent of partisan political controls and pressures and shall administer the following matters for the implementation of the purpose mentioned in the preceding Article:</Sentence>
          </ParagraphSentence>
          <Item Num="1">
            <ItemTitle>(1)</ItemTitle>
            <ItemSentence>
              <Sentence>To conduct scientific research of public opinion concerning Government policy and administration;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="2">
            <ItemTitle>(2)</ItemTitle>
            <ItemSentence>
              <Sentence>To submit reports upon the results of public opinion research to the Cabinet and Government agencies concerned and to make public the said results;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="3">
            <ItemTitle>(3)</ItemTitle>
            <ItemSentence>
              <Sentence>To give necessary advises to and cooperate with local public bodies and other organizations conducting public opinion research;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="4">
            <ItemTitle>(4)</ItemTitle>
            <ItemSentence>
              <Sentence>To study public opinion and methods of public opinion research and to collect necessary materials thereof;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="5">
            <ItemTitle>(5)</ItemTitle>
            <ItemSentence>
              <Sentence>To promote the dissemination and development of public opinion research.</Sentence>
            </ItemSentence>
          </Item>
        </Paragraph>
      </Article>
      <Article Num="3">
        <ArticleTitle>Article 3.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>The Institute and the personnel of the Institute, in the execution of the functions mentioned in the preceding Article, shall not make the following conducts:</Sentence>
          </ParagraphSentence>
          <Item Num="1">
            <ItemTitle>(1)</ItemTitle>
            <ItemSentence>
              <Sentence>To make surveys for the benefit of specific political parties and factions;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="2">
            <ItemTitle>(2)</ItemTitle>
            <ItemSentence>
              <Sentence>To utilize the findings of surveys for the benefit of specific political parties and factions;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="3">
            <ItemTitle>(3)</ItemTitle>
            <ItemSentence>
              <Sentence>To utilize surveys for control over or surveillance of thought;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="4">
            <ItemTitle>(4)</ItemTitle>
            <ItemSentence>
              <Sentence>To release individual privacy attained from surveys;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="5">
            <ItemTitle>(5)</ItemTitle>
            <ItemSentence>
              <Sentence>To compel answers for questions put for the purpose of surveys.</Sentence>
            </ItemSentence>
          </Item>
        </Paragraph>
      </Article>
      <Article Num="4">
        <ArticleTitle>Article 4.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>When necessary, the Institute may commission its researches to other organizations or may make researches commissioned by other organizations.</Sentence>
          </ParagraphSentence>
        </Paragraph>
      </Article>
      <Article Num="5">
        <ArticleCaption>(Board of Governors)</ArticleCaption>
        <ArticleTitle>Article 5.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>The Board of Governors (hereinafter to be referred to as "the Board" ) shall be established in the Institute.</Sentence>
          </ParagraphSentence>
        </Paragraph>
        <Paragraph Num="2">
          <ParagraphNum>2</ParagraphNum>
          <ParagraphSentence>
            <Sentence>The Board shall administer the following matters:</Sentence>
          </ParagraphSentence>
          <Item Num="1">
            <ItemTitle>(1)</ItemTitle>
            <ItemSentence>
              <Sentence>To determine the general policy of the Institute;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="2">
            <ItemTitle>(2)</ItemTitle>
            <ItemSentence>
              <Sentence>To determine research program of the Institute;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="3">
            <ItemTitle>(3)</ItemTitle>
            <ItemSentence>
              <Sentence>To determine the form of publication of results;</Sentence>
            </ItemSentence>
          </Item>
          <Item Num="4">
            <ItemTitle>(4)</ItemTitle>
            <ItemSentence>
              <Sentence>To determine other important matters concerning the management of the Institute, other than those mentioned in each of the preceding items.</Sentence>
            </ItemSentence>
          </Item>
        </Paragraph>
      </Article>
      <Article Num="6">
        <ArticleTitle>Article 6.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>The Board shall consist of seven members.</Sentence>
          </ParagraphSentence>
        </Paragraph>
        <Paragraph Num="2">
          <ParagraphNum>2</ParagraphNum>
          <ParagraphSentence>
            <Sentence>The members shall be appointed by the Prime Minister with the consent of the Board from among men of learning and experience recommended by non-government organizations related to public opinion research.</Sentence>
          </ParagraphSentence>
        </Paragraph>
        <Paragraph Num="3">
          <ParagraphNum>3</ParagraphNum>
          <ParagraphSentence>
            <Sentence Function="main" Num="1">The term of office of the Board members shall be two years, but the term of office of members appointed to fill vacancies shall be the remainder of that of their predecessors.</Sentence>
          </ParagraphSentence>
        </Paragraph>
        <Paragraph Num="4">
          <ParagraphNum>4</ParagraphNum>
          <ParagraphSentence>
            <Sentence>The Board members may be reappointed.</Sentence>
          </ParagraphSentence>
        </Paragraph>
      </Article>
      <Article Num="7">
        <ArticleTitle>Article 7.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>The Board shall have a Chairman.</Sentence>
          </ParagraphSentence>
        </Paragraph>
        <Paragraph Num="2">
          <ParagraphNum>2</ParagraphNum>
          <ParagraphSentence>
            <Sentence>The Chairman shall act as the presiding officer, and shall preside over the affairs of the Board.</Sentence>
          </ParagraphSentence>
        </Paragraph>
        <Paragraph Num="3">
          <ParagraphNum>3</ParagraphNum>
          <ParagraphSentence>
            <Sentence Num="1">The Chairman shall be elected by mutual vote from among the Board members. In case the Chairman is prevented from performing his duties, a person designated by the Chairman beforehand shall act far him.</Sentence>
          </ParagraphSentence>
        </Paragraph>
      </Article>
      <Article Num="8">
        <ArticleCaption>(Director)</ArticleCaption>
        <ArticleTitle>Article 8.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence Num="1">The Institute shall have one Director. He shall be in charge of the management of the Institute.</Sentence>
          </ParagraphSentence>
        </Paragraph>
        <Paragraph Num="2">
          <ParagraphNum>2</ParagraphNum>
          <ParagraphSentence>
            <Sentence>The Director shall be appointed by the Prime Minister with the consent of the Board from among persons having technical knowledge in public opinion research.</Sentence>
          </ParagraphSentence>
        </Paragraph>
      </Article>
      <Article Num="9">
        <ArticleCaption>(Personnel)</ArticleCaption>
        <ArticleTitle>Article 9.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>With respect to appointment, dismissal, promotion, disciplinary punishment and other matters concerning personnel administration of the Institute, the National Public Services Law (Law No.120 of 1947) shall apply.</Sentence>
          </ParagraphSentence>
        </Paragraph>
      </Article>
      <Article Num="10">
        <ArticleTitle>Article 10.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>The fixed number of personnel of the Institute shall be provided for separately by law.</Sentence>
          </ParagraphSentence>
        </Paragraph>
      </Article>
      <Article Num="11">
        <ArticleCaption>(Delegation to Orders)</ArticleCaption>
        <ArticleTitle>Article 11.</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>Necessary matters related to the Board shall be provided for by Cabinet Order and those related to internal organization and management of the Institute by Prime Minister's Office Ordinances, excepting those provided for in this Law.</Sentence>
          </ParagraphSentence>
        </Paragraph>
      </Article>
    </MainProvision>
    <SupplProvision>
      <SupplProvisionLabel>Supplementary Provisions:</SupplProvisionLabel>
      <Paragraph Num="1">
        <ParagraphNum>1</ParagraphNum>
        <ParagraphSentence>
          <Sentence>This Law shall come into force as from June 1, 1949.</Sentence>
        </ParagraphSentence>
      </Paragraph>
      <Paragraph Num="2">
        <ParagraphNum>2</ParagraphNum>
        <ParagraphSentence>
          <Sentence>In spite of the provision of Article 6 paragraph 2, the appointment of Board members shall be made by the Prime Minister from among men of learning and experience recomended by nongovernment organizations related to public opinion research.</Sentence>
        </ParagraphSentence>
      </Paragraph>
      <Paragraph Num="3">
        <ParagraphNum>3</ParagraphNum>
        <ParagraphSentence>
          <Sentence>The term of office of the first Board members shall be decided by lot at the first meeting in such a way that the term of three members shall be one year and that of the other four shall be two years.</Sentence>

      </Paragraph>
