I hereby promulgate the Law for Partial Amendments to the Code of Criminal Procedure. Signed:HIROHITO, Seal of the Emperor This twenty-eighth day of the fifth month of the twenty-fourth year of Showa (May 28, 1949) Prime Minister YOSHIDA Shigeru Law No.116 Law for Partial Amendments to the Code of Criminal Procedure The Code of Criminal Procedure (Law No.131 of 1948) shall be partially amended as follows: In paragraph 2 of Article 23, "or a judge of a Family Court" shall be added next to "a sole judge of a District Court" . In paragraph 2 of Article 24, "a judge of a Summary Court" shall read "a judge of a Family Court or of a Summary Court" . In paragraph 2 of Article 31, ", Family Court" shall be added next to "the Summary Court" . In paragraph 4 of Article 43, paragraphs 1 to 3 inclusive of Article 66, the proviso to paragraph 1 of Article 70, paragraphs 1 to 3 inclusive of Article 125, paragraphs 1 to 3 inclusive of Article 163, paragraph 1 of Article 349, Article 372, paragraph 2 of Article 393 and Article 445, ", Family Court" shall be added next to "District Court" . In paragraph 3 of Article 55, "the 1st, 2nd or 4th of January" shall read "the 1st, 2nd or 3rd of January" . In paragraph 1 of Article 97, "the detention is to be rescinded" shall read "the detention is to be renewed or rescinded" . In paragraph 2 of Article 218, "in the preceding paragraph" shall read "in the first paragraph" , and next to paragraph 1 of the same Article, the following one paragraph shall be added: In the case where a suspect is under physical restraint, his finger-prints or footprints may be taken, his height or weight measured, or his photographs taken without the warrant mentioned in the preceding paragraph, provided that he cannot be stripped naked. In item 2 of paragraph 1 of Article 429, "release on bail," shall be added next to "detention," and in paragraph 3 of the same Article, "or Family Court" shall be added next to "District Court" . The latter part of paragraph 2 of Article 468 shall be deleted and, in paragraph 3 of the same Article "the former part of the preceding paragraph" shall read "the preceding paragraph" .
