Law concerning the Compensation, etc. of Judges

Article 1. The compensation and all other allowances received by judges shall be determined by this Law.

Article 2. The monthly amount of compensation for judges shall be as prescribed in the annexed list.

Article 3. The classification of compensation for each judge, each assistant judge and each summary court judge, as mentioned in the annexed list shall be determined by the Supreme Court.

Article 4. The compensation for a judge shall be paid as from the day on which his appointment is officially announced. However a person who has lost his position as judge is appointed as judge on the same day when he has lost his position as judge, the compensation shall be paid as from the day after the day on which his appointment is officially announced. In cases where the compensation for a judge has been raised, a new account of compensation shall be paid as from the day on which the amount of compensation has been raised.

Article 5. When a judge dies or loses his position, compensation shall be paid until that day.

Article 6. The compensation for a judge shall be paid every month at a time stipulated by the Supreme Court. However, in the case mentioned in the preceding Article, it shall be paid at that time.

Article 7. In respect of the payment of compensation as prescribed in Articles 4 and 5, one twenty-fifth of monthly amount shall be deemed to be the daily amount of compensation and the payable amount of compensation shall be reckoned accordingly;provided that when the total exceeds the monthly amount of compensation, the monthly amount of compensation shall be paid.

Article 8. The retiring allowance for a judge shall be given in accordance with the determination by the Supreme Court according to the provisions laid down for ordinary government officials. However, it shall not be given to a judge whose dismissal has been decreed by an impeachment court.

Article 9. Allowance other than compensation and retiring allowance for the President of the Supreme Court, judges of the Supreme Court and the President of the High Court shall be given following the examples laid down in the Law concerning Salary and Others of the Prime Minister and Others in accordance with the determination by the Supreme Court, and the said allowance for judges other than those officials above-mentioned shall be given following the examples laid down for ordinary government officials in accordance with the determination by the Supreme Court. However, the overtime allowance prescribed in the Law concerning the Emergency Measure for Allowance of the Government Personnel with the Enforcement of the Labor Standard Law and Others (Law No.16 of 1947) shall not be paid.

Article 10. When the Government takes measures for the raising of salaries or other allowances, or for the payment of special allowances for ordinary government officials on account of the remarkable charge in cost of living and current prevailing wage soales, the Supreme Court shall increase the compensation and other allowances for judges or grant special allowances for them after the examples laid down for ordinary government offcials as provided elsewhere by law.

Article 11. The detailed regulations of judge's compensation and other allowances shall be determined by the Supreme Court.

Supplementary Provisions:

Article 12. The present Law shall come into force as from the day of its promulgation. However, the provisions concerning the amount of compensation and other allowances (The travelling expenses shall be excluded. The same shall apply hereinafter) shall apply retroactively from January 1, 1948. Compensation and other allowances already given on and after January 1, 1948 shall be deemed to be partial payment of compensation and other allowances to be given in accordance with the provisions of the proviso of the preceding paragraph, and the amount exceeding the former compensation and other allowances (excluding the amount of retiring allowance and money grant for death) shall be deemed to be the allowance mentioned in Article 38, Paragraph 1, Item 5 of the same Law, as to the application of the Income Tax Law (Law No.27 of 1947).

Article 13. The monthly amount of compensation for summary court judges holding the judgeship in addition shall be determined in accordance with the monthly amount of compensation for judge for the time being.

Article 14. The Law for Emergency Measures concerning the Compensation, etc. of Judges (Law No.65 of 1947) shall hereby be abrogated. However, allowance for judicial apprentices shall be the same as up to now.
