        <ArticleTitle>第一條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>本法ニ於テ借地權ト稱スルハ建物ノ所有ヲ目的トスル地上權及賃借權ヲ謂フ</Sentence>

      <Article Num="2">
        <ArticleTitle>第二條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence Function="main" Num="1">借地權ノ存續期間ハ石造、土造、煉瓦造又ハ之ニ類スル堅固ノ建物ノ所有ヲ目的トスルモノニ付テハ六十年、其ノ他ノ建物ノ所有ヲ目的トスルモノニ付テハ三十年トス</Sentence>

            <Sentence>契約ヲ以テ堅固ノ建物ニ付三十年以上、其ノ他ノ建物ニ付二十年以上ノ存續期間ヲ定メタルトキハ借地權ハ前項ノ規定ニ拘ラス其ノ期間ノ滿了ニ因リテ消滅ス</Sentence>

        <ArticleTitle>第三條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>契約ヲ以テ借地權ヲ設定スル場合ニ於テ建物ノ種類及構造ヲ定メサルトキハ借地權ハ堅固ノ建物以外ノ建物ノ所有ヲ目的トスルモノト看做ス</Sentence>

        <ArticleTitle>第四條</ArticleTitle>

            <Sentence>借地權消滅ノ場合ニ於テ建物アルトキハ借地權者ハ契約ノ更新ヲ請求スルコトヲ得</Sentence>

            <Sentence>土地所有者カ契約ノ更新ヲ欲セサルトキハ時價ヲ以テ建物其ノ他借地權者カ權原ニ因リテ土地ニ附屬セシメタル物ヲ買取ルヘキコトヲ請求スルコトヲ得</Sentence>

        <ArticleTitle>第五條</ArticleTitle>
        <Paragraph Num="1">

            <Sentence>當事者カ契約ヲ更新スル場合ニ於テハ借地權ノ存續期間ハ更新ノ時ヨリ起算シ堅固ノ建物ニ付テハ三十年、其ノ他ノ建物ニ付テハ二十年トス此ノ場合ニ於テハ第二條第一項但書ノ規定ヲ準用ス</Sentence>

            <Sentence>當事者カ前項ニ規定スル期間ヨリ長キ期間ヲ定メタルトキハ其ノ定ニ從フ</Sentence>

        <ArticleTitle>第六條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>借地權者借地權ノ消滅後土地ノ使用ヲ繼續スル場合ニ於テ土地所有者カ遲滯ナク異議ヲ述ヘサリシトキハ前契約ト同一ノ條件ヲ以テ更ニ借地權ヲ設定シタルモノト看做ス此ノ場合ニ於テハ前條第一項ノ規定ヲ準用ス</Sentence>

      <Article Num="7">
        <ArticleTitle>第七條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence Function="main" Num="1">借地權ノ消滅前建物カ滅失シタル場合ニ於テ殘存期間ヲ超エテ存續スヘキ建物ノ築造ニ對シ土地所有者カ遲滯ナク異議ヲ述ヘサリシトキハ借地權ハ建物滅失ノ日ヨリ起算シ堅固ノ建物ニ付テハ三十年間、其ノ他ノ建物ニ付テハ二十年間存續ス</Sentence>

            <Sentence>前二條ノ規定ハ借地權者カ更ニ借地權ヲ設定シタル場合ニ之ヲ準用ス</Sentence>

            <Sentence>前七條ノ規定ハ臨時設備其ノ他一時使用ノ爲借地權ヲ設定シタルコト明ナル場合ニハ之ヲ適用セス</Sentence>

            <Sentence>第三者カ賃借權ノ目的タル土地ノ上ニ存スル建物其ノ他借地權者カ權原ニ因リテ土地ニ附屬セシメタル物ヲ取得シタル場合ニ於テ賃貸人カ賃借權ノ讓渡又ハ轉貸ヲ承諾セサルトキハ賃貸人ニ對シ時價ヲ以テ建物其ノ他借地權者カ權原ニ因リテ土地ニ附屬セシメタル物ヲ買取ルヘキコトヲ請求スルコトヲ得</Sentence>

      <Article Num="11">
        <ArticleTitle>第十一條</ArticleTitle>
        <Paragraph Num="1">

          <ParagraphSentence>
            <Sentence>第二條、第四條乃至第八條及前條ノ規定ニ反スル契約條件ニシテ借地權者ニ不利ナルモノハ之ヲ定メサルモノト看做ス</Sentence>

        <ArticleTitle>第十二條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence Function="main" Num="1">地代又ハ借賃カ土地ニ對スル租稅其ノ他ノ公課ノ增減若ハ土地ノ價格ノ昂低ニ因リ又ハ比隣ノ土地ノ地代若ハ借賃ニ比較シテ不相當ナルニ至リタルトキハ契約ノ條件ニ拘ラス當事者ハ將來ニ向テ地代又ハ借賃ノ增減ヲ請求スルコトヲ得</Sentence>

        <ArticleTitle>第十三條</ArticleTitle>
        <Paragraph Num="1">

            <Sentence>土地所有者又ハ賃貸人ハ辨濟期ニ至リタル最後ノ二年分ノ地代又ハ借賃ニ付借地權者カ其ノ土地ニ於テ所有スル建物ノ上ニ先取特權ヲ有ス</Sentence>

            <Sentence>前項ノ先取特權ハ地上權又ハ賃貸借ノ登記ヲ爲スニ因リテ其ノ效力ヲ保存ス</Sentence>

            <Sentence Function="main" Num="1">前條ノ先取特權ハ他ノ權利ニ對シテ優先ノ效力ヲ有ス</Sentence>
            <Sentence Function="proviso" Num="2">但シ國稅徵收法ニ依リ徵收スルコトヲ得ヘキ請求權、共益費用不動產保存不動產工事ノ先取特權及地上權又ハ賃貸借ノ登記前登記シタル質權抵當權ニ後ル</Sentence>

            <Sentence>本法施行ノ期日ハ勅令ヲ以テ之ヲ定ム</Sentence>

            <Sentence>本法施行ノ地區ハ勅令ヲ以テ之ヲ定ム</Sentence>

        <ArticleTitle>第十七條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence Function="main" Num="1">本法施行前設定シタル地上權又ハ賃借權ニシテ建物ノ所有ヲ目的トスルモノノ存續期間ハ旣ニ經過シタル期間ヲ算入シ堅固ノ建物ノ所有ヲ目的トスルモノニ付テハ三十年、其ノ他ノ建物ノ所有ヲ目的トスルモノニ付テハ二十年トス</Sentence>
            <Sentence Function="proviso" Num="2">但シ建物カ此ノ期間滿了前朽廢シタルトキハ借地權ハ之ニ因リテ消滅シ堅固ノ建物ニ付三十年ヲ超エ、其ノ他ノ建物ニ付二十年ヲ超ユル存續期間ノ定アル地上權ハ其ノ期間ノ滿了ニ因リテ消滅ス</Sentence>

            <Sentence>建物ノ所有ヲ目的トスル地上權又ハ賃借權ニ付存續期間ノ定ナキ場合ニ於テ本法施行前二十年以上ヲ經過シタルトキハ當事者ハ二十年每ニ契約ヲ更新シタルモノト看做シ前項ノ規定ヲ適用ス</Sentence>
