            <Sentence>本法ニ於テ立木ト稱スルハ一筆ノ土地又ハ一筆ノ土地ノ一部分ニ植栽ニ依リ生立セシメタル樹木ノ集團ニシテ其ノ所有者カ本法ニ依リ所有權保存ノ登記ヲ受ケタルモノヲ謂フ</Sentence>

        <ArticleTitle>第二條</ArticleTitle>

            <Sentence>立木ハ之ヲ不動產ト看做ス</Sentence>

            <Sentence>立木ノ所有者ハ土地ト分離シテ立木ヲ讓渡シ又ハ之ヲ以テ抵當權ノ目的ト爲スコトヲ得</Sentence>

            <Sentence>土地所有權又ハ地上權ノ處分ノ效力ハ立木ニ及ハス</Sentence>

        <ArticleTitle>第三條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>立木ノ所有者ハ立木カ抵當權ノ目的タル場合ニ於テモ當事者ノ協定シタル施業方法ニ依リ其ノ樹木ヲ採取スルコトヲ妨ケス</Sentence>

            <Sentence>立木ヲ目的トスル抵當權ハ前條ノ規定ニ依ル採取ノ場合ヲ除クノ外其ノ樹木カ土地ヨリ分離シタル後ト雖其ノ樹木ニ付之ヲ行フコトヲ得</Sentence>

            <Sentence Function="main" Num="1">抵當權者ハ債權ノ期限ノ到來前ト雖前項ノ樹木ヲ競賣スルコトヲ得</Sentence>

            <Sentence>樹木ノ所有者ハ競賣ヲ爲スヘキ地ノ區裁判所ニ相當ノ擔保ヲ供託シテ競賣ノ免除ヲ申立ツルコトヲ得</Sentence>

          <ParagraphSentence>
            <Sentence>樹木ノ所有者ハ抵當權者ニ對シテ一箇月以上ノ期間ヲ定メ競賣ヲ爲スヘキ旨ヲ催吿スルコトヲ得若抵當權者カ其ノ期間內ニ競賣ヲ爲ササルトキハ其ノ樹木ニ付抵當權ヲ行フコトヲ得ス</Sentence>

            <Sentence>第一項ノ規定ハ民法第百九十二條乃至第百九十四條ノ規定ノ適用ヲ妨ケス</Sentence>

        <ArticleTitle>第五條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence Function="main" Num="1">立木カ土地ノ所有者ニ屬スル場合ニ於テ其ノ土地又ハ立木ノミカ抵當權ノ目的タルトキハ抵當權設定者ハ競賣ノ場合ニ付地上權ヲ設定シタルモノト看做ス</Sentence>

        <ArticleTitle>第六條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence Function="main" Num="1">立木カ地上權者ニ屬スル場合ニ於テ其ノ地上權又ハ立木ノミカ抵當權ノ目的タルトキハ抵當權設定者ハ競賣ノ場合ニ付地上權ノ存續期間內ニ於テ其ノ土地ノ賃貸借ヲ爲シタルモノト看做ス</Sentence>

            <Sentence>前項ノ場合ニ於テ地上權ノ存續期間ノ定ナキトキハ其ノ期間ハ當事者又ハ賃借人ノ請求ニ依リ地方ノ慣習ヲ斟酌シテ裁判所之ヲ定ム</Sentence>

            <Sentence>民法第六百四條及第六百十二條ノ規定ハ第一項ノ賃貸借ニ之ヲ適用セス</Sentence>

        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>前條ノ規定ハ轉貸ヲ爲スコトヲ得ル土地ノ賃借人ニ屬スル立木カ抵當權ノ目的タル場合ニ之ヲ準用ス</Sentence>

        <ArticleTitle>第八條</ArticleTitle>
        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>地上權者又ハ土地ノ賃借人ニ屬スル立木カ抵當權ノ目的タル場合ニ於テハ地上權者又ハ賃借人ハ抵當權者ノ承諾アルニ非サレハ其ノ權利ヲ抛棄シ又ハ契約ヲ解除スルコトヲ得ス</Sentence>

        <ArticleTitle>第九條</ArticleTitle>

            <Sentence>立木カ抵當權ノ目的タル場合ニ於テ其ノ所有者カ樹木ノ運搬ノ爲土地ヲ使用スル權利ヲ有スルトキハ立木ノ競落人ハ其ノ權利ヲ行使スルコトヲ得此ノ場合ニ於テハ相當ノ對價ヲ支拂フヘシ</Sentence>

            <Sentence>前項ノ規定ハ水ノ使用ニ關スル權利ニ之ヲ準用ス</Sentence>

            <Sentence>第二條第三項及第三條乃至第九條ノ規定ハ先取特權ニ之ヲ準用ス</Sentence>

            <Sentence>土地又ハ地上權カ質權ノ目的タル場合ニ於テハ其ノ土地ニ生立スル樹木ニ付所有權保存ノ登記ヲ爲スコトヲ得ス</Sentence>

            <Sentence>不動產登記法第十四條第二項及第十九條ノ規定ハ前項ノ登記簿ニ之ヲ準用ス</Sentence>

        <ArticleTitle>第十三條</ArticleTitle>
        <Paragraph Num="1">

            <Sentence>立木登記簿ハ一箇ノ立木ニ付一用紙ヲ備フ</Sentence>

          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>立木登記簿ハ其ノ一用紙ヲ登記番號欄、表題部及甲乙ノ二區ニ分チ表題部ニ表示欄、表示番號欄ヲ設ケ各區ニ事項欄、順位番號欄ヲ設ク</Sentence>

          <ParagraphSentence>
            <Sentence>登記番號欄ニハ各立木ニ付登記簿ニ始テ登記ヲ爲シタル順序ヲ記載ス</Sentence>

            <Sentence>表示欄ニハ立木ノ表示ヲ爲シ及其ノ變更ニ關スル事項ヲ記載シ表示番號欄ニハ表示欄ニ登記事項ヲ記載シタル順序ヲ記載ス</Sentence>

            <Sentence>甲區事項欄ニハ所有權ニ關スル事項ヲ記載ス</Sentence>

            <Sentence>乙區事項欄ニハ先取特權及抵當權ニ關スル事項ヲ記載ス</Sentence>

            <Sentence>順位番號欄ニハ事項欄ニ登記事項ヲ記載シタル順序ヲ記載ス</Sentence>

            <Sentence>登記ノ申請書ニハ不動產登記法第三十六條ニ揭ケタル事項ノ外左ノ事項ヲ記載スヘシ</Sentence>

            <ItemSentence>
              <Sentence>樹木カ一筆ノ土地ノ一部分ニ生立スル場合ニ於テハ其ノ部分ノ位置及段別、其ノ部分ヲ表示スヘキ名稱又ハ番號アルトキハ其ノ名稱又ハ番號</Sentence>

              <Sentence>樹種、數量及樹齡</Sentence>

        <ArticleTitle>第十六條</ArticleTitle>

            <Sentence>不動產登記法第百六條及第百七條ノ規定ハ所有權保存ノ登記ニ之ヲ準用ス</Sentence>

        <Paragraph Num="1">
          <ParagraphNum/>
          <ParagraphSentence>
            <Sentence>所有權保存ノ登記ヲ申請スル場合ニ於テ其ノ保存登記ニ付土地ノ登記簿上利害ノ關係ヲ有スル第三者アルトキハ申請書ニ其ノ承諾書又ハ之ニ代ルヘキ裁判ノ謄本ヲ添附スヘシ</Sentence>

        <ArticleTitle>第十八條</ArticleTitle>

            <Sentence Function="main" Num="1">旣登記ノ土地ニ生立スル樹木ニ付所有權保存ノ登記ノ申請アリタル場合ニ於テ土地ノ登記用紙中土地又ハ地上權ヲ目的トスル先取特權又ハ抵當權ノ登記アルトキハ立木登記簿ニ其ノ登記ヲ轉寫スヘシ</Sentence>

            <Sentence>旣登記ノ土地ニ生立スル樹木ニ付所有權保存ノ登記ヲ爲シタルトキハ土地ノ登記用紙中表示欄ニ立木ノ登記番號ヲ記載シ登記官吏捺印スヘシ立木ノ區分ノ登記ヲ爲シタルトキ又ハ立木ノ存スル土地ニ付所有權保存ノ登記ヲ爲シタルトキ亦同シ</Sentence>

            <Sentence>立木ノ登記用紙ヲ閉鎖シタルトキハ前項ノ規定ニ依リテ記載シタル登記番號ヲ朱抹シ登記官吏捺印スヘシ</Sentence>

            <Sentence>不動產登記法中建物ノ滅失及其ノ表示ノ變更ノ登記ニ關スル規定ハ前二項ノ登記ニ之ヲ準用ス</Sentence>
